Reconstitution toujours en attente des McCann et des "Tapas" sept

Rogério Alves, un des avocats de Kate et Gerry McCann, à affirmé aujourd’hui à Faro que les autorités portugaises ont déjà determiné la date de la reconstitution des événements de la nuit de la disparition de Madeleine, affirmant que Kate et Gerry McCann seraient présents.

"Les deux ont déjà manifesté leur intention d'être présents," à dit l’avocat soulignant que la présence des autres témoins "ne dépendent pas d'eux."

Rogério Alves, one of the lawyers for Kate and Gerry McCann, stated today in Faro that the Portuguese authorities have already set the date for the reconstruction of the events of the night of Madeleine's disappearance, stating that Kate and Gerry MCann would be there.

"They have both already shown their intention to be there," said the lawyer, stressing that the presence of the others, "does not depend on them."

Selon le défenseur de Kate et Gerry McCann, le couple continue à être sceptique à propos de la reconstitution mettant en cause son utilité après un an, position qui surprend même les officiers de la police britannique qu’avaient accompagné l’affaire à Praia da Luz.

According to Kate and Gerry McCann's defence lawyer, the couple are still skeptical about the reconstruction questioning its usefulness after a year, a position which surprised even the British police officers who had been involved with the case in Praia da Luz.

Moins surpris avec la situation d’impasse sont les enquêteurs de la Police Judiciaire (PJ) que depuis plusieurs semaines essaient d’arriver à un compromis entre tous les arguidos et témoins nécessaires à cette diligence : "Pour le moment ca coince toujours au sein du groupe formé par les parents et ses sept amis, " reconnaît une source de la PJ, pour qui la date du 29 mai, avancée aujourd’hui par plusieurs médias, est une possibilité encore en attente.

"Tout dépend de leur volonté d’aider la police à élucider la disparition de Madeleine," affirme encore la même source.

Selon un des officiers britanniques qu’avaient fait le déplacement à Praia da Luz dans le cadre de l’enquête à la disparition de Madeleine, "la reconstitution demandée par la Police Judiciaire est un acte incontournable pour Kate et Gerry McCann. "

Why a reconstruction after a year?

According to British officers who went to Praia da Luz in the context of the enquiry into Madeleine's disappearance, "the reconstruction requested by the PJ is something that Kate and Gerry McCann cannot get away from."

"It is a necessary action in the enquiry and has every reason to be because it has several objectives," states the officer contacted in the United Kingdom.

Selon lui, le premier le premier objectif est celui de pouvoir constituer un album d’images qui sera ensuite utilisé pour démontrer de quelle façon la scène s'est déroulée.

Le deuxième, probablement le plus important, est celui de pouvoir confronter et vérifier les déclarations des arguidos et des témoins avec les constatations matérielles réalisées sur place. Il arrive, par exemple, qu'ont se rende compte que tel témoignage ne colle pas avec la configuration des lieux.

According to him, the primary objective is that of being able to build an album of images which would then be used to show how the scene unfolded.

The second, and probably the most important, is that of being able to compare and check the statements of arguidos and witnesses with the physical findings made on the spot. It happens, for example, when accounts are taken that some witness statements do not tally with the layout of the places.

Les déclarations des personnes liés à l’enquête peuvent varier entre ce qu’à été dit aux enquêteurs dans les installations de la police et le lieu du crime.

Des informations, des détails, peuvent aussi leur revenir en mémoire : l’arguido ou le témoin peut ainsi apporter des précisions ou faire de nouvelles déclarations.

The statements of people linked to the enquiry may vary between what was said to the investigators at the police stations and at the scene of the crime.

Some information, some details, may also come back to them: the arguido or the witness may also bring clarity or make new statements.

"On peut progresser énormément dans une enquête avec les déclarations faites sur la scène du crime, une fois que la personne s'exprime dans une situation particulière… Elle est obligée à refaire les gestes qu’elle prétend avoir fait, cette fois-ci sous les regards des autres et en particulier celui des enquêteurs, " affirme l’officier.

Une reconstitution permet également de confronter les points de vue des différents "acteurs", notamment celui du suspect avec celui des témoins.

"Enormous progress can be made in an enquiry with statements made at the scene of the crime, once the person is placed in a particular situation...She is obliged to repeat the actions she claims to have made, this time under the eyes of others and in particular of the investigators," states the officer.

A reconstruction also allows the viewpoints of the various, "actors," to be compared, notably those of the suspect with those of the witnesses.

Diplomatie britannique toujours présente

L’annonce du départ de l’ambassadeur John Buck le 10 septembre 2007 n’a rien changé à l’attitude de la diplomatie britannique dans l’enquête à la disparition de Madeleine McCann. John Buck, quittant définitivement la carrière diplomatique, a été rapidement remplacée par Alexander Wykeham Ellis en provenance de Bruxelles ou il avait travaillait avec le Président de la Commission Européenne.

British diplomacy is always present.

The announcement of the departure of the ambassador John Buck on September 10th 2007, changed nothing about the attitude of British diplomacy in the enquiry into Madeleine McCann's disappearance. John Buck, leaving the diplomatic service for good, was quickly replaced by Alexander Wykeham Ellis from Brussels where he had worked with the President of the European Commission.

La reconstitution aura probablement lieu avant la fin du mois de mai.

Un des avocats portugais engagé dans la défense du couple McCann, Rogério Alves, a déclaré, aujourd'hui à Faro, avoir de "fortes indications" que la reconstitution du déroulement de la soirée durant laquelle Madeleine a disparu sera encore réalisée en mai. Nous vous le précision déjà dans un article précédent, la reconstitution semble être planifiée avant la fin de ce mois. L'avocat s'adressait aux journalistes en marge d'un séminaire à l'Université d'Algarve.

The reconstruction will probably take place before the end of May.

Today in Faro, Rogério Alves, one of the Portuguese lawyers involved in the McCann couple's defence, stated that there were, "strong indications," that the reconstruction of the unfolding of events of the evening during which Madeleine disappeared would still be carried out in May. We told you already in a previous article, the reconstruction seems to be planned for before the end of the month. The lawyer was addressing journalists on the sidelines of a seminar at the University of the Algarve.

Kate et Gerry McCann ont été déclarés "arguidos" dans l'enquête où cette mesure est emprunte de polémique. Rogério Alves a surpris en déclarant que le couple McCann n'a imposé aucune condition pour participer à la reconstitution. Cette affirmation prend à contre pied les déclarations du porte-parole des parents, Clarence Mitchell, qui a toujours soutenu que les parents ne participeraient à la reconstitution que si ils avaient des garanties et que leur statut de suspects - arguidos - était levé. L'avocat insiste en soulignant que les parents n'émettent qu'une seule réserve: celle de l'utilité de cette reconstitution. "Déjà, Kate et Gerry, ont manifesté leur intention d'être présent. Seulement la présence ou non des autres témoins ne dépend pas d'eux. Les parents sont sceptiques quant à l'utilité de cette reconstitution, un an après les faits. Il est peu probable que ce devoir d'enquête puisse permettre de savoir ce qui est arrivé à l'enfant" a rapporté l'avocat, en soulignant que parfois régnait une certaine "confusion" avec les manifestations publiques des parents.

Kate and Gerry were declared, "arguidos," in the investigation in which this measure has raised controversy. Rogério Alves surprised by stating that the McCann couple is imposing no conditions on participating in the reconstruction. This statement goes against those of the parents' spokesperson, Clarence Mitchell, who has always maintained that the parents would not participate in the reconstruction unless they had guarantees and their status as suspects - arguidos - was lifted. The lawyer insists, stressing that the couple have only one reservation: that of the usefulness of this reconstruction. "Kate and Gerry have already shown their intention to attend. Only the presence or not of the other witnesses does not depend on them. The parents are skeptical as to the usefulness of this reconstruction, a year after the events. It is unlikely that this exercise in the investigation could help to find out what happened to the child," the lawyer reported, stressing that sometimes some, "confusion," prevailed over the parents' public expression.

Incité par les journalistes à commenter la prorogation du secret de justice de trois mois, Rogério Alves, a affirmé que l'élargissement était prévisible. "L'élargissement du secret de justice pour trois mois est une réalité qui, à moi, me semble normal et tout à fait prévisible" a-t-il dit, en affirmant être en désaccord sur le fait que le délai commence à compter à partir de la réforme du Code de Procédure Criminelle. "C'est une interprétation avec laquelle je ne suis pas d'accord, mais à laquelle je me suis conformé" répète Rogério Alves, en ajoutant que le délai de justice aurait du commencer à être compter au mois de mai lors de la disparition. C'est la seconde fois que le délai du secret de justice, qui aurait du se terminer le 15 mai, soit demain, est prolongé. En janvier, déjà, le Ministère Public avait déclaré l'exceptionnelle complexité de l'affaire. L'avantage de soulever le secret de justice réside dans le fait que les parents sauront quelles recherches ont été faites et si la police est proche d'une solution. "Ce qui résulte du secret de justice est l'interdiction à l'accès du dossier et à la connaissance du contenu tel qu'un père et une mère aimeraient avoir afin de savoir ce que la police est en train de faire pour découvrir une chose fondamentale pour eux: ce qui est arrivé à leur fille" a conclu Rogério Alves.

The lawyer comments on the extension of the secrecy of justice.

Urged by the journalists to comment on the extension of the secrecy of justic for three months, Rogério Alves stated that the extension was predictable. "The extension of the secrecy of justice is a reality which, to me, seems normal and totally predictable," he said, stating that he disagrees with the fact that the extension is counted from the start of the reform of the Code of Criminal Procedure. "It is an interpretation with which I am not ok, but with which I have complied," Rogério Alves repeats, adding that the extension of justice should start to be counted from the month of May, the time of the disappearance. Tomorrow is the second time that the secrecy of justice, which should have ended on May 15th, is extended. In January, the Public Ministry had already declared the exceptional complexity of the case. The advantage of lifting the secrecy of justice resides in the fact that the parents would find out what searches had been done and if the police were close to a solution. "The result of the secrecy of justice is the banning of access to the file and knowledge of the details that any father and mother would like to have in order to find out what the police were in the process of doing to discover something fundamental to them: what had happened to their daughter," Rogério Alves concluded.

Plusieurs témoins prêts à aider la PJ mais pas encore les McCann

Plusieurs témoins ont déjà manifesté leur disponibilité pour retourner à Praia da Luz, le village d’où Madeleine McCann à disparue, en réponse à la demande de la Police Judiciaire (PJ) qui souhaite effectuer une reconstitution plus complète des événements du 3 mai 2007.

Several witnesses have already shown their readiness to return to Praia da Luz, the village from which Madeleine McCann disappeared, in response to the request by the PJ who would like to carry out a more complete reconstruction of the events of May 3rd 2007.

L’information à été doublement confirmée aujourd’hui à Portimão (Portugal) et à Enderby (Royaume-Uni), même si les deux sources ont reconnu qu’il n’y a pas encore une date bien déterminé pour cette diligence.

The information was confirmed today at both Portimao (Portugal) and at Enderby (United Kingdom) although both sources acknowledged that there is still no date set for this activity.

"Nous avons encore l’espoir que les parents de Madeleine se décident à participer... logiquement, ils devraient être les premiers à s’y intéresser," affirme un officier de la police du Leicestershire.

"We are still hopeful that Madeleine's parents will decide to participate...;ogically, they should be the first to be interested," states an officer of the Leicestershire police.

Malgré les déclarations de ses avocats au Portugal, Kate et Gerry McCann ont fait savoir qu’ils n’avaient pas l’intention d’effectuer le voyage tant que les autorités ne ce décident pas à lever leur statut d’arguidos, ce que, dans la pratique, semble impossible, comme le couple doit le savoir.

In spite of the statements by their lawyers in Portugal, Kate and Gerry McCann have made it known that they have no intention of undertaking the journey as the authorities have not decided to lift their arguido status, which in practice, seems impossible, as the couple must know.

Sans aucune aide de son gouvernement, l’autre arguido dans l’enquête à la disparition de Madeleine, le britannique Robert Murat, est disponible à participer à une reconstitution même si son avocat, maître Francisco Pagarete, contacté par SOS Madeleine, affirme ne pas avoir reçu une demande officielle dans ce sens.

Eight months later, the diplomats are no longer is post and the promise has been forgotten by the British side.

Without any assistance from his government, the other arguido in the enquiry into Madeleine's disappearance, the British man Robert Murat, is ready to participate in a reconstruction although his lawyer, Me Francisco Pagarete, contacted by SOS Madeleine, confirms not having received an official request in this regard.

Le statut d’arguido peux être maintenu, sous certaines conditions, pendant vingt ans, et Murat voudrait bien que l’enquête soit accéléré de forme à reprendre une vie aussi normale que possible, même si pour le moment, le britannique essaie de comprendre pourquoi, comment et qui serait derrière les accusations qui ont été faites à sa rencontre.

Under certain conditions, arguido status can be maintained for twenty years, and Murat would like the enquiry to be speeded up for the sake of resuming as normal a life as possible, although for the moment, the British man is trying to understand why, how and who was behind the accusations which were made about meeting him.

Au Royaume-Uni, Robert Murat a déjà accusé de diffamation 13 journaux et une chaine de télévision. Le britannique demande aux médias la somme record de 2 millions de livres, plus de 2,5 millions d’euros, une des plus grandes indemnisations dans l'histoire du Royaume-Uni, ce qu’explique que certains médias ont pris la décision d’effacer sur internet plusieurs articles à propos des accusations faites par le passé.

In the United Kingdom, Robert Murat has already accused 13 journals and a television channel of defamation. The Britsh man is demanding from these media the record sum of 2 million pounds, more than 2.5 million Euros, one of the largest claims in UK history, which explains why certain media have taken the decision to delete several internet articles about the accusations made in the past.

Parmi les témoins que la police compte voire revenir à Praia da Luz, il y a une touriste allemande qu’à affirmé aux enquêteurs avoir vu Kate McCann retourner à l’appartement pendant le diner, bien avant l’heure à laquelle la maman de Madeleine à donné l’alarme. Son témoignage est corroboré par un deuxième témoin, fonctionnaire de l’Océan Club.

The clues are against the McCanns.

Amongst the witnesses that the police count on seeing return to Praia da Luz, there is a German tourist who has told the investigators that she saw Kate McCann return to the apartment during the dinner, well before the time at which Madeleine's mother raised the alarm. Her witness statement is corroberated by a second witness, an official of the Ocean Club.

These witness statements could assist in the reconstruction of the movements of each of the group of friends, the Tapas Bar Nine, but alone do not explain the clues which the special British police team had found with the PJ inspectors.

Dans l’appartement 5A de l’Océan Club, les chiens de la police britannique ont signalé l’odeur d’un cadavre derrière le sofa qui se trouve à proximité de la fenêtre arrière. Sur les rideaux de cette fenêtre la police à retrouvé des traces minuscules de sang, malgré le fait qu’ils avaient été nettoyés, tout comme le mur.

In apartment 5A of the Ocean Club, the British polcie dogs indicated a cadaver odour behind the sofa which is located near the rear window. On the curtains of that window the police found microscopic traces of blood, in spite of the fact that they had been cleaned, like the wall.

Les seules impressions digitales retrouvées sont celles de Kate, Gerry et des amis du couple.

Plus tard, dans la Renault Scénic loué le 27 mai par les McCann, l’équipe luso-britannique retrouve l’odeur à cadavre mais également des fluides humains et des cheveux. Les expertises effectués dans les laboratoires auxquelles la police à fait appel ont révélé une forte probabilité de qu’il s’agissait de Madeleine, les enquêteurs ne parlent pas de 100% car ce degré de fiabilité n’est jamais donné par les scientistes quand il s’agit d’ADN.

The only finger prints found were those of Kate, Gerry and the couple's friends.

Later, in the Renault Scenic, rented on May 27th by the McCanns, the Luso-British team found cadaver odour and also human fluids and hair. The evaluations carried out in the laboratories the police called upon revealed a strong possibility that they were Madeleine's. The investigators do not talk of 100% because that degree of reliability is never given by scientists where DNA is concerned.

José Maria de Almeida Rodrigues, né le 10 août 1958 à Viseu, nord du Portugal, s’est licencié en Droit par l’Université de Coimbra avant de rentrer, il y a 26 ans, dans les cadres de la Police Judiciaire.

Sous-directeur national adjoint de la PJ au moment de la démission d’Alipio Ribeiro, il est connu pour son travail sans faille comme coordinateur d’investigation criminelle.

Parmi son curriculum vitae officiel ont retrouve plusieurs fonctions de direction au sein de la PJ mais également des missions à l’étranger, notamment auprès de l'Assemblée-General d'Interpol et de la police du Cap-Vert, ou il fut honoré par le gouvernement local pour son travail.

José Maria de Almeida Rodrigues, born on August 10th 1958, in the north of Portugal, is a law graduate of the University of Coimbra before entering the service of the PJ twenty-six years ago.

Deputy director of the PJ when Alipio Ribeiro resigned, he is known for his unstinting work as coordinator of criminal investigation.

His CV includes several management jobs for the PJ but also placements abroad, notably with the Interpol General Assembly and the Cap-Vert police, where he was honoured by the local government for his work.
