Also, Clarence, even if the McCanns were not arguidos, I don't think the police would hand over confidential files to them. Those files will contain not just information about and collected from the McCanns, but statements from and about other people who have been involved or gave statements about the case. It would hardly be acceptable, especially under UK law, Data Protection Act and all, for that information to be handed over to a private company. I don't think it's gonna happen Clarrie!

Plusieurs témoins ont déjà manifesté leur disponibilité pour retourner à Praia da Luz, le village d’où Madeleine McCann à disparue, en réponse à la demande de la Police Judiciaire (PJ) qui souhaite effectuer une reconstitution plus complète des événements du 3 mai 2007.

Her witness statement is corroberated by a second witness, an official of the Ocean Club.

Sur les rideaux de cette fenêtre la police à retrouvé des traces minuscules de sang, malgré le fait qu’ils avaient été nettoyés, tout comme le mur.

In apartment 5A of the Ocean Club, the British polcie dogs indicated a cadaver odour behind the sofa which is located near the rear window. On the curtains of that window the police found microscopic traces of blood, in spite of the fact that they had been cleaned, like the wall.

Plus tard, dans la Renault Scénic loué le 27 mai par les McCann, l’équipe luso-britannique retrouve l’odeur à cadavre mais également des fluides humains et des cheveux. Les expertises effectués dans les laboratoires auxquelles la police à fait appel ont révélé une forte probabilité de qu’il s’agissait de Madeleine, les enquêteurs ne parlent pas de 100% car ce degré de fiabilité n’est jamais donné par les scientistes quand il s’agit d’ADN.

Later, in the Renault Scenic, rented on May 27th by the McCanns, the Luso-British team found cadaver odour and also human fluids and hair. The evaluations carried out in the laboratories the police called upon revealed a strong possibility that they were Madeleine's. José Maria de Almeida Rodrigues, né le 10 août 1958 à Viseu, nord du Portugal, s’est licencié en Droit par l’Université de Coimbra avant de rentrer, il y a 26 ans, dans les cadres de la Police Judiciaire.

Sous-directeur national adjoint de la PJ au moment de la démission d’Alipio Ribeiro, il est connu pour son travail sans faille comme coordinateur d’investigation criminelle.

Parmi son curriculum vitae officiel ont retrouve plusieurs fonctions de direction au sein de la PJ mais également des missions à l’étranger, notamment auprès de l'Assemblée-General d'Interpol et de la police du Cap-Vert, ou il fut honoré par le gouvernement local pour son travail.

José Maria de Almeida Rodrigues, born on August 10th 1958, in the north of Portugal, is a law graduate of the University of Coimbra before entering the service of the PJ twenty-six years ago.

Deputy director of the PJ when Alipio Ribeiro resigned, he is known for his unstinting work as coordinator of criminal investigation.

His CV includes several management jobs for the PJ but also placements abroad, notably with the Interpol General Assembly and the Cap-Vert police, where he was honoured by the local government for his work.

If Josef Ftitzl knew that what he was doing was wrong, then in my opinion, he is responsible for his actions. If he managed to be organised enough to maintain two very separate families, living in such close proximity, then he is surely not insane within any legal definition. He may be bad, but that does not make him insane. Josef Fritzl planned the imprisonment of his daughter, built his dungeon and lured her into it. He kept up the evil charade for 24 years. Not the work of an insane man, just the actions of a very evil one.

"Depraved Josef Fritzl opened the doors yesterday to the dark cellar kingdom where he caged his daughter for 24 years, and admitted: "I know now I'm insane."

I don't know what to say to that. He knows now he is insane? No, words fail me at this point.

According to the Daily Mail, Fritzl may be charged with murder in connection with the death of Elisabeth's baby son twelve years ago, at just three days old.

"The 73-year-old, who imprisoned and repeatedly raped his own daughter, fathering seven children by her, is expected to be formally accused of murder through negligence following the death of his three-day-old son."
"It needs to be proved that the baby would have survived had he got proper medical attention."

Josef Fritzl, who has confessed to having kept his daughter locked up and raped her for 24 years in his cellar in Amstetten, Austria, denied having abused her from the age of 11, as she stated to the police, according to the suspect's lawyer, quoted on Thursday by the local magazine News.
"It is not true. I am not the kind of person to sexually abuse children," stated Josef Fritzl, aged 73, according to his lawyer Rudolf Mayer who revealed to the daily journal the contents of several hours of recent interviews with his client. The rapes, "started later, only when she was down below," locked up at the age of 18, in the cellar, 60m square with a 1.70 metres high ceiling, and no windows, which he had organised in order to create a new family there, he added.

Le 28 avril dernier, le père incestueux a livré des aveux complets sur la séquestration et les viols pendant 24 ans de sa fille Elisabeth aujourd'hui âgée de 42 ans, dans sa cave sans que personne ne s'en soit apparemment aperçu dans son entourage. Sept enfants sont nés de ces viols, dont l'un est décédé peu après la naissance. Trois de ces enfants, âgés de 5 à 19 ans, ont été séquestrés avec la mère dans la cave, trois autres (entre 15 et 12 ans) ont été adoptés officiellement par les "grands-parents", Josef et son épouse Rosemarie, 69 ans. Celui-ci avait fait croire aux autorités que les bébés avaient été déposés, à plusieurs années d'intervalle, par la fille indigne qui vivait dans une secte.

Avant la séquestration, le père incestueux avait eu et élevé sept enfants, dont Elisabeth, avec sa femme Rosemarie.

"The truth is that I wanted to have children with Elisabeth," explained Josef Fritzl, currently in preventive detention in Sankt Polten, quoted by his lawyer, and adding: "I was pleased with the children. It was also nice to have a real family in the cellar with a wife and children."

"When I went into the cellar, I took flowers to my daughter and soft toys for the children," he related, stressing that he watched adventure films with the children while his daughter Elisabeth cooked their favourite meals. "And then we sat down together to eat round the kitchen table." Before the locking up, the incestuous father had had and raised seven children, one of them Elisabeth, with his wife Rosemarie.

"Je savais pendant les 24 ans que ce que je faisais n'étais pas bien mais en même temps cela devenait tout à fait normal d'avoir une deuxième famille dans la cave", a encore indiqué le suspect, selon son avocat.

"During the 24 years, I knew that what I was doing was not good but at the same time it became altogether normal to have a second family in the cellar," was further stated by the suspect, according to his lawyer.

La décision de l'adoption de trois des enfants par les "grands-parents" aurait été prise parce que ces trois bébés étaient plus maladifs que les autres, selon les déclarations relatées par l'avocat. Josef Fritzl a également confié à son défenseur avoir grandi comme enfant unique dans une famille modeste. Son père a quitté le domicile lorsqu'il avait 4 ans et c'est sa mère "une femme forte, qui (lui) a appris la discipline et l'ordre".

The decision for the adoption of three of the children by the, "grand parents," was taken because these three babies weaker than the others, according to statements related by the lawyer. Josef Fritzl also confided to his defence lawyer having grown up as an only child in a family of modest means. His father left when he was four years old and it was his mother, "a strong woman who taught him discipline and order."

"J'ai grandi à l'époque nazie, lorsque régnait la discipline et l'obéissance. J'ai probablement inconsciemment adopté un peu de cela mais je ne suis pas un monstre", a-t-il souligné.
L'avocat de Fritzl a d'ores et déjà annoncé qu'il allait plaidé l'irresponsabilité pénale de son client. Un expert psychiatre a été mandaté par le parquet pour examiner prochainement l'état de santé mentale du suspect. (cyberpress.)

Fourniret Trial: Michel Fourniret's brother speaks

The Ardennes Court of Assizes began the examination of Michel Fourniret's character on Tuesday. Amongst those called to give evidence was his brother André.

C'est ainsi que le frère de Fourniret, qui ne peut « défendre un assassin d'enfants» ni «attaquer trop fort un consanguin», a évoqué son cadet Michel. André, 78 ans, a lancé à l'adresse du forestier ardennais : «Je veux qu'il sache que c'est toujours mon frère».

Au premier jour de l'examen de sa personnalité par la cour d'assises des Ardennes, André, de douze ans l'aîné de Michel, a évoqué l'enfance de son frère né en avril 1942 à Sedan de parents ouvriers, avant de s'étendre sur son propre "dilemme" face à une telle parenté. L'allure bonhomme, il brosse le tableau d'une famille "respectable" où la mère "élevait très bien ses enfants". Contrairement aux confidences faites par écrit en 1987 à Monique Olivier -son épouse et complice présumée-, son frère n'a pas vécu une "scène incestueuse" avec sa mère.

It is thus that Fourniret's brother, who cannot, "defend a child-killer," nor "attack too strongly a blood relative," talked about his younger brother Michel. André, aged 78, began for the benefit of the Ardennes forester: "I would like him to know that he is still my brother."

Le Michel blanc et le Michel noir, il les a connus séparément, quant il tuait ou quand il m'embrassait. Il va être obligé de recoller les deux morceaux et ce jour-là, il se suicidera, ou il deviendra fou. Son mutisme le protège, il faut le respecter.»

"I bought the five books (published about the case), in the last of which he went back on his statements," he said before formulating his own explanation about his brother's personality and his silence.

"What do you think of his silence?" asked Me Didier Seban of the witness. The 78 year-old man, with a serious voice and the demeanor of a kindly professor of letters, very white hair and a very short tie, replied, "He is trapped. The white Michel and the black Michel, he has experienced them separately, when he killed and when he embraced me. He is going to be obliged to stick the pieces back together and on that day, he will kill himself, or he will go mad. His silence protects him. We must respect it."

Mais Me Seban insiste. À l'accusé : «Qu'avez-vous à dire à votre frère ?» Car le témoin, qui vient de définir le clivage plus clairement que bien des experts psychiatres, n'est autre qu'André, l'aîné des trois enfants Fourniret. (Le témoin a changé de patronyme, comme la plupart des parents de Michel Fourniret. )

L'accusé, sans surprise : «Pas dans le cadre d'un procès public.»

Le grand frère, délicat et protecteur : «Je souhaiterais qu'on ne l'importune plus. Vous en savez assez, de toute façon. Pour lui, c'est une forme d'autoprotection. Je veux qu'il sache que c'est toujours mon frère, malgré tout.»

But Me Seban insists. To the accused: "What do you have to say to your brother?" Because the witness who had just defined the split more clearly than all of the psychiatric experts, is none other than André, the eldest of the three Fourniret children. (The witness has changed his surname, like most of Michel Fourniret's relatives.)

The accused, no surprise: "Not within the framework of a public trial."

The older brother, gentle and protective: "I would wish that he is not bothered any more. You know enough, anyway. For him, it is a kind of self-protection. I want him to know that he is still my brother, in spite of everything."

Peu avant, il s'était tourné vers les parties civiles, alors que le président l'interrogeait sur la difficulté d'être un parent de l'Ardennais : «Les ennuis qu'il nous a causés n'ont rien à voir avec votre douleur. A little later, he turned towards the civil parties, while the president questioned him about the difficulty of being the relative of the Ardennes man: "The trouble he has caused us is nothing compared to your pain. I do not feel I have the right to complain in front of the families. I would like to say to them, looking them in the eye, my best regards." From the benches concerned were a few sincere, "thank yous."

André strongly impresses the assizes, because this sparkling old man picks up where he left off, without, "defending a child-killer," nor, "attacking too strongly a blood relative." He does not spare in any way, this, "pseudo-intellectual, or failed intellectual," which does not prevent him from acknowledging the, "excellent technician."

André, donc, navigue dans un inconfortable entre-deux. Le voici cependant qui, bravement, tente de décrypter l'itinéraire criminel de celui qui a eu le même père et la même mère que lui : «Pour dominer quelqu'un, il veut l'abandon total, ce n'est pas sexuel.» Comprendre : le «Michel noir» obéit à une pulsion de mort. «Il veut dominer le monde… Il aurait pu diriger une usine, ou faire de la politique», sourit malicieusement le témoin. Malheureusement, le «Michel blanc» n'avait pas les moyens de ces bourgeoises ambitions. Pour son frère, «la présence de Monique Olivier a permis à Michel de déclencher ses pulsions. En tuant devant quelqu'un, on montre sa toute-puissance».

André then navigates through an uncomfortable space. He is here, however, trying to work out the criminal career of the the person who had the same father and the same mother as himself: "To dominate someone, he wants total abandonment. It is not sexual." To understand: the, "black Michel," obeys a compulsion for death. "He wants to dominate the world....He could have run a factory, or been in politics," smiles the witness mischievously. Unfortunately, the "white Michel," did not have the resources for these middle-class ambitions. For his brother, "the presence of Monique Olivier allowed Michel to trigger his compulsions. Killing in front of someone, he shows his total power."

À la question d'un assesseur, André poursuit : «Le Michel Fourniret qui est là se considère comme un martyr. Pour lui, on est dans un procès stalinien ! C'est le Michel blanc qui est en prison, c'est comme ça qu'il se protège.»

La mère d'Élisabeth, la plus jeune des victimes, demande : «S'il avait obtenu le huis clos, aurait-il parlé ?» Le témoin : «Oh oui, mais il n'aurait rien dit.»

On the question of an assessment, André continues: "The Michel Fourniret who is there sees himself as a martyr. For him, he is in a Stalinist trial! It is the white Michel who is in prison. It is as that that he protects himself."

The mother of Elisabeth, the youngest of the victims, asks: "If he had obtianed, "huis clos," would he have spoken?" The witness: "Oh yes, but he would have said nothing."

Comme le cadet refuse de parler, le président Latapie interroge son aîné sur trois de ses prétendues réminiscences enfantines : un épisode incestueux dont Mme Fourniret mère aurait été à l'initiative (André n'y croit absolument pas) ; une humiliation subie, très jeune, par leur sœur Huguette lors d'un repas de famille (André n'y accorde aucun crédit) ; enfin, Michel Fourniret aurait un jour surpris la même Huguette sur un «seau d'aisance», et il en aurait été durablement perturbé. André, lui, ne croit guère au traumatisme scatologique : «Qu'est-ce qu'il allait faire dans ces chiottes ? interroge-t-il gaiement, arrachant un sourire à son frère. Rimbaud a écrit sur une scène de ce genre.»

As the younger brother refuses to speak, Latapie, the president, questions the elder about three of his claimed childhood memories: an incestuous incident, which the mother, Mme Fourniret initiated (André absolutely disbelieves this); a humiliation suffered by the sister Huguette, during a family meal when she was very young (Andrégives no credit to this.) finally, Michel Fourniret had one day surprised Huguette on a, "toilet bucket," and he had been deeply disturbed by it. André does not believe very much of this scatalogical trauma: "What was he going to do in these toilets?" he asks brightly, flashing a smile at his brother. "Rimbaud wrote about a scene like this."

Fourniret pleure.

Pendant ce premier témoignage, jamais Fourniret, jugé pour sept meurtres aggravés de jeunes filles, ne daigne s'adresser à son frère. C'est en revanche l'évocation de figures importantes de son passé d'ouvrier fraiseur qui va l'émouvoir jusqu'à le faire pleurer, une première depuis l'ouverture du procès. A la barre Dominique Catoire, 55 ans, fille d'un ancien patron d'usine pour lequel Fourniret a travaillé dans les années 1960, le supplie pendant dix longues minutes de livrer enfin les explications dont il prive la cour depuis six semaines. "Ce que Papa t'a enseigné, c'est l'amour de ton prochain et surtout d'admettre tes erreurs et de les assumer. Fais-le pour lui", implore-t-elle.

"Dominique, je n'ai pas pris une décision à la légère (celle de ne rien dire faute de huis clos), je ne peux en changer".

During this first witness statement, Fourniret, on trial for seven aggravated murders of young girls, never deigned to address his brother. However, it is important people from his past as a milling machine operator who are going to move him to make him cry, a first since the start of the trial. Replacing the director of the PJ gives new impetus to the McCann case

The appointment of José Maria d'Almeida Rodrigues to replace the outgoing director of the PJ seems to be widely popular with serving police officers in Portugal. The fact that Rodrigues is an officer from within their ranks would appear to be the reason.

Au Portugal, plusieurs inspecteurs contactés ce soir, ont affirmé leur surprise et satisfaction avec la nomination de leur collègue Almeida Rodrigues à la tête de la Police Judiciaire (PJ), en remplacement d’Alipio Ribeiro, le directeur national démissionnaire.

L’inspecteur José Maria d'Almeida Rodrigues, âgé de 49 ans, est licencié en droit et occupait jusqu’à présent le poste de coordinateur du DIC de Coimbra. Inspector José Maria d'Almeida Rodrigues, aged 49, is a law graduate and until now held the post of coordinator of the DIC in Coimbra. Throughout his carrer in the PJ he has been faced with a few difficult, and high profile media cases, notably the investigation of crimes of satanic inspiration in Aveiro and of the serial killer of Santa Comba Dao. More recently he was behind the arrest of public enemy number one in Spain, known as, "El Solitario," charged with the murder of three people and of thirty armed bank robberies.

L'ex-compagnon de Monique Olivier, épouse et complice présumée de Michel Fourniret, jugé par les assises des Ardennes pour sept meurtres, a dépeint lundi l'accusée comme une "paumée" lors d'un témoignage fantasque qui a poussé la cour jusqu'aux éclats de rire. "C'est une paumée. Je ne comprends pas cette fille. Elle ne fait que raconter des âneries", à déclaré à la barre André Michaux, ex-compagnon de Monique Olivier pendant une douzaine d'années dans les années 70, et père de deux de ses trois garçons.

The ex-partner of Monique Olivier, wife and alleged accomplice of Michel Fourniret, on trial at the Ardennes assizes for seven murders, described the accused on Monday as, "loser," during a whimsical witness statement which brought the court to outbursts of laughter. "She is a loser. I don't understand that girl. All she does is talk rubbish," stated André Michaux at the bar, Monique Olivier's partner for a dozen years in the 1970s, and father of her three sons.

Il y a quelque chose qui cloche, il lui manque une case", a-t-il ajouté, en niant toutefois l'avoir violentée.

Monique Olivier was again described today as a woman under the influence, victim of both her husband and co-accused Michel Fourniret and her ex-partner André Michaux, who defended himself in a whimsical manner on accusations of violence carried out on her. Née en octobre 1948 à Tours dans une famille d'artisans, Monique Olivier est une élève moyenne, dont les parents s'occupent peu. Sans son diplôme de secrétaire malgré les cours suivis, elle quitte la maison à 22 ans pour suivre le patron d'une auto-école voisine.
Cet homme, André Michaux, de treize ans son aîné, qui sera le père de deux de ses trois fils, se montrera rapidement, selon ses dires, «violent» et «jaloux».
«Il n'aimait pas que je parle avec qui que ce soit (...) Si je frôlais un homme dans la rue, il s'imaginait que je lui faisais des avances», a-t-elle expliqué Monique Olivier.
Un jour, raconte-t-elle, il la traîne par les cheveux, lui immerge de force la tête dans la baignoire, «comme on faisait avec les Arabes en Algérie», un autre jour il l'oblige à pratiquer une fellation à un inconnu.

She leaves home aged 22 to fall intot the hands of a violent husband.

Born in October 1948 in Tours into a family of craftsmen, Monique Olivier was an average pupil, with whom the parents spent very little time. Without her secretarial diploma, in spite of courses taken, she leaves home at 22 to follow the manager of a driving school nearby.
That man, André Michaux, thirteen years her senior, who was to be the father of her three sons, showed himself quickly, according to what she says, "violent," and, "jealous."
"He didn't like me to talk to anyone at all (...) If I brushed against a man in the street, he imagined that I was making advances," explained Monique Olivier.
One day, she recounts, he grabbed her by the hair, forcibly immersing her head in the bath tub, "as happens with the Arabs in Algeria." Another day he forced her to perform fellatio on a stranger.

JE NE SUIS PAS CAPABLE DE DIRE NON

Toute sa vie, elle n'aurait pas trouvé les moyens de se révolter contre ce que les hommes lui faisaient subir: «je ne suis pas capable de dire non, c'est dommage, je fais ce qu'on me demande».
Au cours du procès entamé le 27 mars, elle avait déjà justifié sa complicité avec Fourniret par «la peur permanente» qu'il lui inspirait.
«Je n'ai pas eu la vie que j'aurais aimée», concède-t-elle à voix basse au président Gilles Latapie qui lui lance «qui êtes vous Monique Olivier?».
Une fois de plus les avocats des parties civiles n'obtiennent aucune réponse lorsqu'ils tentent de savoir pourquoi elle est restée seize ans au côté de Michel Fourniret sans jamais le dénoncer.

I AM NOT CAPABLE OF SAYING NO.

All her life she had not found the means to revolt against what men made her suffer: "I am not capable of saying no. It is a pity. I do what I am asked."
During the trial which started on March 27th, she had already justified her complicity with Fourniret by, "permanent fear," which he inspired in her.
"I have not had the life which I would have liked," she concedes in a low voice to the president Gilles Latapie, who asks her, "who are you Monique Olivier?"
Once again the lawyers for the civil parties obtain no response while trying to find out why she stayed with Michel Fourniret for sixteen years without denouncing him.
