The case is scheduled for July 7th as a public hearing before the family section of the court where the Leicestershire police will contest access to the documents

Jusqu'à présent la police britannique à toujours refusé aux McCann et ses avocats l’accès à tous les documents concernant l’enquête justifiant qu'ils sont liés par les clauses d'un accord avec la police portugaise.

The information, revealed yesterday afternoon, was confirmed by a source from the Enderby police.

So far the British police have always refused access by the McCanns and their lawyers to all the documents relating to the investigation with the justification that they are bound by clauses of an agreement with the Portuguese police.

"Les documents ne permettent pas de retrouver Madeleine, mais la divulgation de leur contenu met sérieusement en risque l’aboutissement de l’enquête," affirme un officier britannique à Enderby soulignant que "dans ces documents il y a l’identité de tous les témoins entendus au Royaume-Uni et ses déclarations, aussi bien que les résultats des expertises effectués par le FSS (Forensic Science Service). Leur révélation prématurée met sérieusement en cause les possibilités d’aboutissement de l’enquête."

"The documents don't help to find Madeleine, but the disclosure of their contents puts the success of the investigation seriously at risk," states a British police officer at Enderby, stressing that, "in the documents there is the identity and the statements of all witnesses heard in the United Kingdom, as well as the results of the tests carried out by FSS (Forensic Science Services) The premature revealing of them seriously calls into question the possibility of success with the investigation."

Selon le porte-parole des McCann, Clarence Mitchell, la demande aurait été faite par Kate et Gerry McCann agissant "au nom de Madeleine" visant "la divulgation de certains documents".

According to the McCanns' spokesman, Clarence Mitchell, the request would have been made by Kate and Gerry McCann acting, "in Madeleine's name," regarding, "the disclosure of certain documents."

A few weeks after their daughter's disappearance, Kate and Gerry would have requested and obtained, at the highest level of confidentiality, that Madeleine be placed on a ward of court order, a status which is now being used to back their request for access to the documents.

Arrivés au Royaume-Uni en septembre, après leur départ précipité du Portugal, Kate et Gerry McCann ont vu Madeleine être mise sous la tutelle judiciaire de la Cour Suprême de l'Angleterre et du Pays de Galles — statut destiné à protéger les intérêts de l’enfant malgré sa disparition.

On arrival in the United Kingdom in September, after their sudden departure from Portugal, Kate and Gerry McCann saw Madeleine being placed under the legal supervision of the High Court of England and Wales - a status designed to protect the interests of the child in spite of her disappearance.

Selon Clarence Mitchell, ancien responsable de l’Unité de surveillance des médias et actuel porte-parole des McCann, la mise sous tutelle judiciaire de Madeleine aurait pu être faite sous "l’instigation" du couple, mais une source du County Council de Leicestershire, contactée par téléphone, s’est refusée à confirmer cette version affirmant que "les autorités ont agi dans l’intérêt exclusif de Madeleine".

According to Clarence Mitchell, former head of the Media Monitoring Unit and currently spokesperson for the McCanns, placing Madeleine under legal supervision would have been done at the couple's instigation, but a source from Leicestershire County Council, contacted by telephone, refused to confirm that version, stating that, "the authorities acted in the sole interests of Madeleine."

Kate et Gerry McCann ont l’espoir que leur demande à la juge Mary Claire Hogg soit entendue et que la police du Leicestershire soit obligée à leur donner l’accès au dossier de manière à "aider leurs recherches privées," à reconnu Clarence Mitchell.

Amy Fitzpatrick: Clarence Mitchell promises media interest.

Clarence Mitchell has promised to take Amy's story to the major UK TV channels. Amy, aged 15, disappeared in the Malaga region of Spain, where she had been living for five years with her mother and her step-father. Now, while I feel that Amy is deserving of media interest, I wonder why Clarence has singled out this case for his expertise and connections with the media. In the UK, there are many young people of Amy's age who go missing every year. Could it be that Amy's case attracted media interest in the first place because she disappeared in Spain? Could it be because Amy's name is already known, unlike those of the many, many others who have since gone missing from home and family?

Why choose Amy rather than one of the anonymous young people, who have attracted no media interest whatsoever? Amy's case is not unusual. What is unusual is the interest which resulted from a media, sensitised to the disappearance of British children on the other side of the channel, following the disappearance of Madeleine McCann.

So, Clarence, if you are so keen on being the media spokesperson for missing young people, why not pick a name, any name from the Salvation Army's web site, or the web site of Missing People, or the web site of CROP? I am sure there are many others, who are deserving of your attention.

Amy Fitzpatrick est la jeune Irlandaise âgée de 15 ans disparue depuis le premier janvier en Mijas, dans la région de Malaga, en Espagne, où elle vit depuis cinq ans en compagnie de sa mère et de son beau-père. "He is only doing this because he wants to help find Amy. We are very grateful to him. We have been trying for a long time to get the British media to take an interest in the search for Amy," stated her mother, currently in Dublin, Ireland. (If Clarence is so keen on finding a missing child, why not encourage his clients to return to Portugal and help the PJ by participating in the reconstruction of the events surrounding their daughter's disappearance? Amy Fitzpatrick, is the young Irish girl, aged 15, missing since January first in Mijas, in the Malaga region of Spain, where she had been living for five years with her mother and step-father. Since her disappearance on January 1st, the Guardia Civil has carried out a number of searches in the whole province, using sniffer dogs and helicopters.

Well, I wonder if Clarence would have hit the media with the story if he had chosen the 15 year-old daughter of Joe Bloggs from Hull, on whom to bestow his beneficence? Unfortunately, Joe Bloggs' daughter would be seen as one of many and perhaps the media and the general public would have wondered what Clarence was up to? Distracting attention from something? The wider agenda, maybe? Who knows?

L’article 116 du Règlement du Parlement européen est pourtant clair sur ce point : "Une déclaration écrite inscrite au registre depuis plus de trois mois et n'ayant pas été signée par la moitié au moins des membres qui composent le Parlement devient caduque".

The McCanns' spokesman stated at the time that the delay in the lifting of Kate and Gerry's arguido status was inhuman. He welcomed the Portuguese magistrate's statement with satisfaction. Clarence Mitchell stated that the couple had not been informed that the secrecy of justice would be lifted on July 14th, but he added: "If such is the case, it is clearly a good thing." The couple's lawyers have again urged the authorities to lift the parents' arguido status as soon as possible. Judicial secrecy is usually lifted after eight months. But the magistrate, Pedro Frias, extended the secrecy, by agreement with the prosecutor, stating the complexity of the case. The McCanns' Portuguese lawyers have said that they do not believe they will have access to the file before August and that they would try to get all the charges dropped.

SOS Madeleine McCann: journalists and deputies provoke the McCanns' anger

Journalistes et députés ont provoqué la colère des McCann

En déplacement au Parlement européen à Strasbourg, Kate et Gerry McCann quand confrontés aux questions des journalistes à propos de la forme comme le couple à laissé, à plusieurs reprises, les enfants seules et sans surveillance la nuit de la disparition de Madeleine, ont perdu leur calme en soutenant que la "vraie question" est l’enlèvement.

On a visit to the European Parliament in Strasbourg, Kate and Gerry McCann lost their cool when confronted by questions from journalists about how the couple had left the children alone and unsupervised, as on several occasions, on the night of Madeleine's disappearance, arguing that the, "real question," is the abduction.

As in Brussels, several European deputies preferred to miss Kate and Gerry McCann's visit, protesting against the fact that the five authors of the declaration could associate the couple with this document because of their arguidos status in the investigation into their daughter's disappearance.

The McCanns' visit and the presentation of a written declaration requesting the setting up of a European alert system, apart from the fact that the Commission has been working on it since 2006, was seen by a large number of members of the Parliament as an attempt at media manipulation.

Gerry McCann a d’ailleurs très mal accueilli le manque de réponse des parlementaires à leur déclaration : le but officiel de leur visite à Strasbourg était d’obtenir la signature de 182 députés, mais, après tout une journée, ils ne sont parvenus qu’à obtenir 15, ce que laisse présager que le document, que finalement n’a aucun poids juridique ou politique, ne sera pas publié.

The statements by the French Jacques Barrot, current Vice-President of the European Commission and future commissioner for, "Justice, Liberty and Security," indicating that, "amongst his priorities," is the setting up of the European rapid alert system in cases of child abduction, following the strategy adopted by the parliament on the issue of child protection, were heard as a veiled response to criticisms made by the McCanns.

Meanwhile, the lack of response from parliamentarians to their declaration was very badly received by Gerry McCann: the official object of their visit to Strasbourg was to obtain the signatures of 1882 deputies, but, after a whole day, they had only managed to obtain 15, which leaves us to predict that the document, which in the end has no legal or political weight, will not be published.

In December 2006, an extraordinary meeting of the member States approved the initiative of the European Commission, reserving the telephone numbers beginning with 116 in all the member States, "for social services," including the number 116 000, to become, "a number for emergency calls to help in the search for missing children." In February 2007, the Commission officially adopted, "reserving the telephone number 116 000 in all member States as a call number to carry information about missing children."

Selon la BBC, Viviane Reding, alors Commissaire européenne pour les Télécommunications, s’était dit "enchantée qu'aujourd'hui la plus importante mesure vers un numéro d’appel unique, commun à toute l’Union européenne, pour les enlèvements d’enfants ait été prise."

According to the BBC, Viviane Reding, then European Commissioner for Telecommunications, had said she was, "delighted that today the most important step has been taken towards a unique call number for abducted children, common to the whole European Union."

So far, four European countries have set up the call number 116 000 as the emergency number to help in the search for missing children - Belgium, Greece, Portugal and Denmark - in France the number comes into service this summer and others will follow.

(Shouldn't someone tell Gerry McCann that while he has been getting a bit worked up about those deputies not signing, that the project has been underway since 2006, and doing quite well without his help?)

The European Federation for missing and sexually exploited children (Missing Children Europe) was invited by the Commission to assist with the project and, following a meeting on August 17th 2007, Missing Children Europe brought together an interdisciplinary group of NGOs and statutory organisations, who met on August 31st 2007 and prepared some preliminary recommendations, which serve as the basic guidelines for a commission on missing children, discussed during an informal meeting of Justice and Home Affairs Ministers in Lisbon on October 2nd 2007.

Yesterday, the Vice-President of the European Commission, the Frenchman Jacques Barrot, named as the new post-holder for, "Justice, LIberty and Security," replacing Franco Frattini, indicated that, "amongst his priorities," is the setting up of the European rapid alert system in cases of missing children, strengthening the protection of minors in divorce cases and a new proposal for the fight against sexual exploitation of children.

Jacques Barrot a d'ailleurs souligné que sur la question de la protection des enfants il donnait suite à la stratégie adoptée par le Parlement en janvier.

Dans son blogue, le 13 juin, Gerry McCann a fortement critiqué le projet de l’Union européenne, réclamant que le numéro d’appel 116 000 "jusqu’ici, soit uniquement opérationnel dans un des 27 pays européens (Grèce)." En outre, il considère que le système d’alerte que l’Union européenne met en action, depuis 2006, ne signifie pas qu’"une alerte Amber sera émise pour un enfant enlevé, car un tel système n'existe pas." Les McCann, qui sont aujourd’hui à Strasbourg, ont toujours besoin de la signature de 182 parlementaires européens pour "la déclaration écrite", mais le document n’a aucun poids légal dans l’Union européenne.

Jacques Barrot also stressed that on the issue of child protection, he follows the strategy adopted by the Parliament in January.

In his blog, on June 13th, Gerry McCann strongly criticised the European Union's project, claiming that the number 116 000, "was so far only operational in one of the 27 European countries (Greece)." In addition, he considers that the alert system which the European Union has had in place since 2006, did not mean that, "an Amber alert would be issued for an abducted child, because such a system does not exist." The McCanns, who are in Strasbourg today, still need the signatures of 182 European parliamentarians for, "the written declaration," but the document has no legal weight in the European Union.

(Now that's odd, Gerry! Recently there was a simulated alert carried out by the four EU countries, which are said to have already set up the 116 000 call facility. Who didn't do his homework?)

Les parents de Madeleine McCann se déplacent, demain, au Parlement Européen à Strasbourg afin d'essayer de convaincre 182 eurodéputés de soutenir la création d'un système d'alerte européen pour enfants disparus. "Jusqu'à présent nous avons recueillis 211 signatures. Précisons qu'il faut 393 signatures de députés européens afin d'atteindre la majorité simple au Parlement" a avancé le porte-parole de Kate et Gerry McCann, Clarence Mitchell.

Madeleine McCann's parents travel to the European Parliament in Strasbourg tomorrow, to try to convince 182 Euro-deputies to support the creation of a European alert system for missing children. "We have so far gathered 211 signatures, and we need 393 signatures from Euro-deputies to reach a simple majority in the Parliament," Kate and Gerry McCann's spokesperson, Clarence Michell stated.

La déclaration écrite avait déjà été présentée par les McCann et un groupe d'eurodéputés le 10 avril dernier à Bruxelles et exhortait les États membres de l'UE d'adopter un système d'alerte pour enlèvement d'enfants au niveau européen, similaire au système en place aux États-Unis. Les forces de l'ordre pourraient ainsi lancer une Alerte Enlèvement en utilisant les médias et si des accords sont établis avec les pays voisins, permettre une réponse rapide au niveau transfrontalier en cas de disparition inquiétante. Les députés n'ont plus que deux sessions parlementaires pour souscrire au projet et signer le document.

During a one-day visit, the couple will meet with a few deputies in private and they will launch an appeal for those who have not yet signed, to do so, ending the day with a press conference. "Kate and Gerry are confident. They think they will get the 182 missing signatures," their spokesperson added. The written declaration had already been presented by the McCanns and a group of Euro-deputies on April 10th in Brussels, urging the EU's member Sates to adopt, at European level, an alert system for abducted children, similar to the system in place in the United States. Police forces could thus launch an Abduction Alert, using the media and if agreements were reached, with neighbouring countries, allowing a rapid response at cross-border level in the case of a worrying disappearance. The deputies have only two more parliamentary sessions to support the draft and sign the document.

On April 10th, while the McCann couple were addressing the press after having discussions with a few European deputies, the Commissioner for Justice, Liberty and Security, and Vice-president of the European Commission, Franco Frattini, was holding a meeting in an adjacent room to the McCann couple, about child abductions. The example cited was that of Denise Pipitone, kidnapped in September 2004, whose kidnappers probably travelled the length of the country before crossing its borders. We note that in that case little Denise is probably still alive. It was a serious conference bearing on the cooperation between member States. Franco Frattini is a fervent defender of a European Alert System. In 2006, the Commissioner was already referring to a mechanism for European cooperation on the subject. He proposed a European Alert system be established by each member country of the EU instead of legislation by the European Parliament.

Comme on peu le voir, les parents de Madeleine n'ont pas placé la moindre virgule dans ce projet. Nous aurions préféré qu'ils fassent pression sur leurs "AMIS" afin qu'ils participent à la reconstitution demandée par la PJ plutôt que d'assister à un show médiatique. Je me demande si Piera, la maman de Denise, trouverait inutile, absurde ou déplace de faire une reconstitution 4 ans et 9 mois après l'enlèvement de sa fille avec tous les acteurs impliqués permettant de voir qui faisait quoi, où, comment et de quelle manière ?!!

As might be said, Madeleine's parents have not placed a single comma in this draft. We would have preferred them to put pressure on their, "FRIENDS," to participate in the reconstruction requested by the PJ rather than attend a media show. I wonder if Piera, mother of Denise, would find it useless, absurd or misplaced to do a reconstruction, with all the involved players, 4 years and 9 months after her daughter's abduction, allowing it to be seen who did what, where, how and in what way? !!

Gerry and Kate McCann will be in Strasbourg next Tuesday, to try to obtain more support from members of the European Parliament for a, "written declaration," about the creation of a European Amber alert system, covering each of the 27 states of the European Union.

The first reference to this idea was made by the European Commissioner for Justice, Liberty and Security, Franco Frattini, in 2006. However, the McCanns, their communications advisors and Clarence Mitchell have never mentioned this detail. M. The Divisional Commissioner, Richard Bryan, one of the most senior British police officers, head of Missing Persons for the Association of Chief Police Officers, told the media last May: "there is no reason to take as a model the American system of immediate dissemination of information to the general public following notices of missing children."

"The written declaration," is just a way of, "launching or relaunching discussion on a subject that falls within the mandate of the EU," but it has no legal implication for the member countries.

On June 12th, the police forces of several European countries tested their level of cooperation, with the simulation of a child abduction, in order to evaluate the current system of coordination, in this kind of case.

According to Enfants Kidnappés, the police in four European countries, Belgium, Luxembourg, The Netherlands and France, carried out a simulation exercise recently, to test out how well the system, already in place, works to help find children who have been abducted and thought to have been taken across national boundaries.

Alerte Enlèvement: Victoria a disparu

Il s'agit d'un exercice commun du plan "Alerte Enlèvement", mis en place en février 2006 en France pour aider à résoudre rapidement des affaires de disparitions d'enfants, entre la France, la Belgique, le Luxembourg et les Pays-Bas. Victoria, une petite luxembourgeoise, a échappé à la surveillance de son oncle en gare de Tourcoing cet après-midi. Un témoin affirme avoir vu la fillette en compagnie d'un homme. D'après ses dires l'individu a poussé Victoria dans une voiture immatriculée aux Pays-Bas qui s'est ensuite dirigée vers la frontière belge…

Abduction alert: Victoria has disappeared. It is a shared exercise of the, "Abduction Alert," plan which was set up in February 2006 in France, to help to rapidly resolve cases of missing children, between France, Belgium, Luxembourg and The Netherlands. Victoria, a little Luxembourg girl, slipped away from her uncle's supervision in the Tourcoing train station this afternoon. A witness confirms having seen the little girl in the company of a man. From what was said, the individual pushed Victoria into a car registered in The Netherlands, which then headed towards the Belgian border.

Ces faits ne se sont heureusement pas produits dans la réalité. Il s'agit juste du scénario imaginé par les autorités policières et judiciaires de quatre pays : la Belgique, la France, les pays Bas et le Luxembourg. Scénario destiné à tester un système d'Alerte Enlèvement.

Fortunately, these events did not arise out of a real situation. It was just a scenario created by the police and judicial authorities of four countries: Belgium, France, The Netherlands and Luxembourg, a scenario intended to test out an abduction alert system.

The fake, "Abduction Alert," plan was triggered at 2.30pm, an hour and a half after the imagined abduction. The objective of the exercise was to coordinate the activity of the police forces and judicial authorities of the participating countries, and especially to evaluate language barriers to the effective diffusion of the alert message and the exchange of information.

J'ai pris l'initiative de proposer ce dispositif à nos voisins après l'enlèvement du petit Enis à Roubaix en août 2007. Si le ravisseur était passé en Belgique, le dispositif se serait arrêté à la frontière. L'intérêt des enfants est que le plan puisse continuer de fonctionner dans des pays transfrontaliers.

Why extend the, "abduction alert," to neighbouring countries?

I took the initiative of suggesting this operation to our neighbours following the abduction of little Enis in Roubaix in August 2007. If the abdcutor had crossed into Belgium, the operation would have stopped him at the border. It is in the interests of children that the plan can continue to work across national borders.

Il s'agit d'abord de convaincre nos partenaires européens. Nous avons procédé de la même manière avec l'interconnexion des casiers judiciaires qui était une initiative franco-allemande : six pays sont aujourd'hui effectivement connectés et six autres s'y préparent. Certains pays comme la Belgique ou les Pays-Bas utilisent des dispositifs d'alerte en cas d'enlèvement, mais aucun ne va aussi loin que le nôtre.

What was the objective of the simulation? It was first of all to convince our European partners. We have worked in the same way with the sharing of criminal records, which was a French-German initiative: six countries are now effectively connected and six others preparing to be. Some countries, like Belgium or The Netherlands use alert operations in cases of abduction, but none goes as far as ours.

Y a-t-il des points de blocage chez nos voisins ?

La simulation doit servir à démontrer à tous l'efficacité et donc l'utilité d'un tel dispositif. Le Luxembourg, les Pays-Bas et la Belgique participeront avec nous de manière active à la simulation, tandis que l'Espagne, le Portugal, l'Allemagne, la République tchèque et la Suède seront présents en tant qu'observateurs.

Are there any sticking points with our neighbours?

The simulation may serve to demonstrate to everyone the effectiveness and therefore the usefulness of such an operation. Luxembourg, The Netherlands and Belgium will actively participate with us in the simulation, while Spain, Portugal, Germany, the Czech Republic and Sweden will be present as observers.

Quand souhaitez-vous qu'« alerte enlèvement » soit opérationnel dans ces pays ?

C'est un dispositif que la France leur propose. Il ne s'agit pas de contraindre nos partenaires à adopter un dispositif unique en la matière : certains d'entre eux disposent, en effet, déjà de leur propre mécanisme de recherche et d'aide à l'enquête. L'objectif est de les inciter à ne pas limiter la mise en oeuvre de ces plans aux seules frontières de leur territoire national. Il y aura début juillet une présentation de cet exercice à l'ensemble de nos partenaires. Le fait que la France prenne la présidence de l'Union européenne est un atout pour la poursuite de ce projet.

When do you want the, "abduction alert," to be operational in these countries? It is an operation which France is proposing to them. It is not to compel our partners to adopt a single system on the subject: some indeed already have their own system for search and assistance in an investigation. The objective is to encourage them not to limit the setting up of these plans only to their own national borders. At the beginning of July, there will be a presentation of this exercise to an assembly of our partners. The fact that France takes up the presidency of the European Union is an advantage for the continuation of this project.

Au niveau national, envisagez-vous d'améliorer le dispositif existant ?

Je considère que le système est assez efficace. Il y a des conditions strictes pour déclencher cette alerte : ce doit être un enlèvement avéré et non une disparition, avec des informations précises pour permettre de localiser le ravisseur, la victime doit être mineure, sa vie ou son intégrité physique doit être en danger et il faut le consentement des parents. A six reprises, « alerte enlèvement » a été utilisé, à chaque fois avec succès.

At a national level, do you envisage improving the existing system?

I consider that the system is effective enough. There are strict conditions for triggering that alert: it must be established to be an abduction and not a disappearance, with accurate information to help locate the abductor, the victim must be a minor, his life or his physical integrity must be in danger and there must be parental consent. On six occasions the, "abduction alert," has been used, each time successfully.

It is reported that Kate and Gerry McCann will be in Strasbourg next week, to encourage more MEPs to sign up to the Europe-wide Amber alert system. As the above article reports, several European countries have already been working with a cross-border alert system and others have been observing the recent exercise to test out the effectiveness of the system.

I really doubt that the alert system would have helped or been triggered by Madelein McCann's disappearance. Rachida Dati, the French Justice Minister lists the strict conditions for triggering an alert:

• It must be an established abduction and not a disappearance.
• There must be accurate information to help locate the abductor.
• The child must be a minor.
• The child's life must be in danger or the child must be at risk of physical harm.
• There must be parental consent.

So, would the circumstances of Madeleine's disappearance have met these strict conditions?

1. The Portuguese police are still investigating abduction as one of the possible scenarios, but there does not seem to be absolutely clear evidence of an abduction: no trace, apparently, of the abductor was found in the apartment and there was no evidence of forced entry.
2. At the time, Jane Tanner reported having seen a man carrying, "a bundle, which could have been a child," though later this was improved to a man carrying a child wearing pyjamas like Madeleine's. The vague information given at the time would not have helped locate an abdcuctor.
3. Madeleine is a minor.
4. If Madeleine had been abducted, her life would surely have been in danger.
5. I am sure the McCanns would have consented.

In my opinion, criteria 1 and 2 were not met by the circumstances of Madeleine's disappearance and so an abduction alert would not have been triggered. There was no accurate description of a possible abductor, no description of a possibly suspicious vehicle and a lack of physical evidence in the apartment. So, what information could have been disseminated in an alert message?

• A small blonde child was last seen in her parents holiday apartment. She is not there now.
  

• A man was seen, near the apartment, carrying a bundle which could have been a child.
  

What might an alert message have said, then? Stop every vehicle crossing the border in which there is a small blonde child? Maybe! But then, if Madeleine had been transported in an abductor's vehicle, the chances are that she would not be sitting looking at the scenery. No doubt she would have been hidden. What then? Stop and search every vehicle crossing the border? Not a very useful exercise I think!

In my opinion, it would be a much more useful exercise for the McCanns to be warning other parents about the dangers of leaving small children alone, rather than their supporting the introduction of a European alert system, which would not have helped nor been triggered in the circumstances of their daughter's disappearance. Also, it appears that work towards a European abduction alert system has been progressing nicely for some time without the McCanns' help. So, given that Madeleine's disappearance would not have triggered an alert, and there were already moves to set up a Europe-wide system, I really don't understand the McCanns' involvement.
