Date: 01 août 2007 - 06h00

Inspection of the surrounding areas.

Date: August 1st - 6am

After evaluation of the area surrounding the Ocean Club tourist village, based in Praia da Luz, taking account of the characteristic topography of the ground and the distance from where the small child Madeleine McCann disappeared, an inspection was carried out with the help of dogs specialised in the detection of cadaver odour, in various places, such as described:

1 - At 6.40am, an area between the "Piteira" road and the "Oliveira" road, was inspected. At 7.15am the inspection was completed with nothing being detected by the dogs.

2 - At 7.25am, an area adjacent to the "BEIJAFLOR" property on the "Figueira," road, defined by the "Ramalhete" road. An inspection of the whole area was made and nothing abnormal was noted. The inspection was completed at 7.45am.

3 - At 7.55am, an area between the "Casa Azul" residence on the "Figueira" road and the "Casa Pandora" residence as well as a dirt road on the left of the "Figueira" road was inspected by the dogs without anything abnormal being noted. The inspection ended at 8.05am.

4 - At 8.20am, an area between the residences "Casa Pandora" on the "Figueira" road, "Quinta Mimosa" and "Casa Ladeira" without anything abnormal being noted. The inspection ended at 8.40am.

A photographic report of the places inspected is attached.

Initial conclusion.

To the coordinator of the criminal investigation.

Faced with new elements revealed by the dog handling unit's search, attached to the report, and on the basis of Mark Harrison's report, there is every reason to believe that the small child Madeleine McCann died in apartment 5A where she was spending her holiday with her parents at the Ocean Club in Praia da Luz. Following the markings by the cadaver odour detecting dogs and traces of human blood inside the apartment from which the child disappeared, we have done further extensive research, revealing that there was never a death, or a body, notified in this same apartment before. In this report, several places were marked, signaling the presence of cadaver odour and human blood. In addition, we can observe that a cadaver odour was detected in the garden adjacent to apartment 5A. Nothing was detected in the other residences.

It follows from this investigation that there are indications, in practice and in the facts, of the crime of murder such as defined in ArticleQI310 of the Penal Code.

So as to go further with this lead, of which certain results may reveal new evidence, we request authorisation to carry out further inspections, within the legal framework, in two distinct places:

1 - Rue des Fleurs no...The McCann family's current residence in Portugal.
2 - Rented vehicle Renault Scenic, registration ...DA - 27.

We suggest that this inspection is entrusted to the PJ and ask the Public Prosecutor for a 20 day mandate. Thus, we consider that there are indications that consolidate strong suspicions according to which, there are elements of evidence of a crime, inside the vehicle used by the McCanns and, moreover, likely to reveal important details of fundamental importance for the investigation.

Villa rue des Fleurs.

Report:

August 2nd 2007 -6.14pm - 27 Rue das Floras- Praia Da Luz - Lagos

Participants:

PJ: Ricardo P & J. Carlos P., inspectors.
UK: Mark Harrison, Martin Grime & Eddie.

On that date, within the context of a residential search, carried out at the McCann couple's current residence, an inspection by a dog handling team was made. Thus, at the time indicated at the beginning of the report, all areas of the property were inspected and the following results obtained:

6.36pm - The dog Eddie, who detects cadaver odours, "marked" the area of a cupboard in the living room. On checking, the dog was indicating a pink soft toy belonging to MadeleineMcCann.

The clothes.

Date: August 2nd 2007 - 11.20pm

On that date, following the home visit made to the McCanns' current residence, on the Rue des Fleurs, various items of clothing were laid out in an appropriate place for this purpose, to carry out an inspection by the dog handling unit.

The collected items of clothing were set out individually with the agreement and under the directions provided by the British technicians, the dogs having previously covered the space where the clothing was laid out.

1 - 11.20pm: Prior reconnaissance of the place by the two canine units to guarantee that the space was clear of all odours being sought. The reconnaissance was completed at 11.30pm without anything being signaled by the dogs.

2 - 11.30pm: An initial inspection by the human blood detecting dog, began with the clothing packed in the box bearing the notation: "Living room." At 11.40pm, the inspection was completed without the dog showing anything abnormal.

11.41: The canine human remains recovery dog started its inspection and "marked" various clothes. The inspection was completed at 11.52pm. The clothes were returned to their box for later use.

From 12.02am until 1.30am, (03/08/07) all the other boxes, containing clothing from the twins' bedroom, from the friends' bedroom, from the bedroom of the couple labeled 1 & 2, as well as the empty luggage, was inspected by the two dogs without conclusive results.

Apartment 5A - OCEAN CLUB

As joinder to the procedure. It is made known and according to superior orders that today at 8pm, specialists from LPC (Police forensics lab) Fernando V. and Lino R., after having seen the recorded images resulting from the inspection by the dog handling unit on 31/07/07 in apartment 5A, duly mandated, proceeded with the collection of whole floor tiles where the dogs used in the inspection indicated the possible existence of traces of human blood as well as the presence of a body in the apartment. The tiles were lifted so as to preserve possible samples to be analysed by the appropriate laboratory. This entire action was filmed in order to illustrate the way in which the lifting was accomplished and with what tools so that the experts had a better idea of the work.

Robert Murat/Casa Liliana

Report:

August 4th and 5th 2007.

Casa Liliana, residence of the suspect Robert Murat, situated on "Ramalhete" road - Praia da Luz - Lagos.

Participants:

PJ: Tavares A., chief inspector, J. Carlos P., Ricardo P, inspectors
UK: Mark Harrison, Martin Grime and Eddie.

On that date, within the context of residential visits, which were carried out at the home of the suspect ROBERT MURAT, an inspection by the dog handling unit was made in the gardens and inside the residence of the accused.

August 4th 2007 - 7.28pm: Start of the inspection of the gardens of the residence. Eddie, human remains recovery dog, covered the whole perimeter outside the dwelling and nothing abnormal was signaled.

August 5th 2007 - 3.22pm: The same dog inspected all rooms of the residence and nothing in particular was signaled.

RUSSELL O'BRIEN

To the coordinator of the criminal investigation.

In the context of the investigation, we have collected information concerning a vehicle used by RUSSELL O'BRIEN, friend and member of the group who spent their holiday with the McCann family in the Algarve . At the time of the request for vehicles considered important to the procedures that follow, we were not aware of the identification details of this vehicle. Meantime, our investigation has led us to establish that it may be a vehicle of the "Opel" range, a "Corsa" model, registration....AG - 62. At the present time, we do not have a mandate to search for and seize the vehicle to allow us to add the vehicle to the planned inspections. As a consequence, we request such a legal mandate in order to be able to realize the planned inspections.

Samples sent to the lab.

Between 3pm on August 4th 2007 and 6.30am on August 5th 2007, the following samples were recovered in the living room of apartment 5A at the OCEAN CLUB where a murder probably took place.

SOS Madeleine McCann: Witnesses have taken apart the McCanns' version about the apartment's shutters.

http://sosmaddie.dhblogs.be/

4/08/08

Witnesses have, "taken apart," the McCanns' version about the apartment's shutters.

Apartment 5A, where the McCanns were staying until Madeleine's disappearance, had been occupied by other British people, all of whom the PJ found, confirmed the good state of the shutters, initially described by relatives of Kate and Gerry as old, worn and broken.

Amongst these witnesses, Saleigh and Paul Gordon, accompanied by their two children, occupied apartment 5A before the McCanns, between April 21st and 28th 2007. Questioned several times by the investigators, the couple maintain that, "the doors, windows and shutters of the apartment were all in good condition," even stressing that given the noise made by the bedroom shutters, it would be impossible to open or shut them without it being noticed by neighbours or passers-by.

From the beginning, the McCanns have claimed that the shutters were broken and that the door had been forced. That is the version that Kate gave to a close friend, Jon Corner, to whom she reportedly said, "that they have smashed the shutter on the window and taken my little girl."

The same version was, meanwhile, given by Gerry to Madeleine's grandfather, Brian Healy: "Gerry told me that when they got back, the shutters on the bedroom window were smashed (....) The door was open." (See McCannfiles)

"The bedroom, facing the car park, was also overlooked by other apartments. Given that, I find that if someone had tried to open the shutters from the outside, somebody would have noticed," Saleigh Gordon insists. Her husband Paul also confirms that the couple always felt safe and that the front door was equipped with a double lock, while the one at the back only locked from inside the apartment.

The, "strange," man was actually not.

It was also Paul Gordon who saw and spoke to a man described by several British media, quoting sources close to the McCanns, as strange and suspicious. However, in his statements to the police, Paul maintains that the individual never, "watched," the children or the apartment: "I would describe the man as well-educated, of good appearance (...) I remember him as looking tidy and shaved with light downy facial hair. "

"I went over to the man who asked me if I would be interested in making a donation to an orphanage (...) I spoke with him and noticed that he had an indentification badge and that he had what looked to me like a receipt book," Paul Gordon stated to the police, adding that he had even received a receipt which he had left behind in Portugal.

Since January Paul Gordon has been contacted several times by Brian Kennedy, Kate and Gerry McCann: "There are times when I feel like a chess pawn."

"The McCanns manipulated the evidence."

The PJ are convinced that the McCanns manipulated evidence and simulated the abduction of the daughter and put forward that Maddie's parents changed the arrangement of the furniture and some objects in the apartment. The information is published this morning by the Portuguese daily newspaper Correio da Manha, quoting the PJ's investigation.

Duarte Levy & Paulo Reis

According to the daily newspaper, the correlation between the alerting to cadaver odour and to blood behind the sofa, by Eddie and Keela, the two British sniffer dogs, proves beyond doubt that this was backed up against the wall after the child's death. The investigators, given the poor evidence found on this piece of furniture, concluded that it may be that it had been washed.

A detail also quoted by Correio da Manha, Cuddle Cat, the pink soft toy belonging to Madeleine and which Kate took everywhere, was placed in the child's bed after her death, given that, in contrast to the soft toy, no cadaver odour was indicated on the bed.

Madeleine McCann: second birthday away from her parents (Enfants Kidnappés)

Enfants Kidnappés 13/05/08

13 mai 2008

Second birthday away from her family.

Yesterday, Madeleine's parents, Sean, Amélie and the whole family spent a second birthday without her. The little girl's fifth birthday was spent in private at their home. Kate and Gerry's spokesperson, Clarence Mitchell, stated that the couple had organised a small, symbolic celebration, primarily for the benefit of the twins Sean and Amélie. "
Without Madeleine's being there with them, this is unfortunately just another day without her in many ways. Gerry and Kate have, of course, organised something to mark Maddie's fifth birthday, more for Sean and Amélie than for anyone else, but they did it in private," said their spokesperson. "We spent Madeleine's fifth birthday quietly, in private at home. It was one of the hardest of the last 375 days," Gerry wrote in his blog.

On this occasion, Gerry McCann once again launched an appeal to all those who had been on holiday at the Ocean Club at the time of Madeleine's disappearance, asking them to contact the new telephone line created by the couple to find out the details of witness statements made to the Portuguese and British police. Clarence Mitchell revealed that following this recent appeal, the couple have received thousands of emails and hundreds of telephone calls. "There is a very very good and encouraging response so far," stated Clarence Mitchell, and now Metodo 3 have several, "promising," leads.

Madeleine in Brazil?

Since her disappearance, Madeleine has, "
appeared," in several countries. Interpol has confirmed that some of these, "appearances," have taken place in Brazil but none of the witness statements have been shown to be convincing. This information is revealed by an official Interpol source. The last witness statement showed up about a month ago and the enquiry there is ongoing. The head of Interpol in Brazil, Jorge Pontes, confirmed that this, "potential lead is in the course of being checked out," and he cannot, therefore, provide any details. A witness is sure about having seen the little British girl on a flight to Sao Paulo. Interpol's delegate in Brasilia, Marilia Moreira Marques, states that: "Since last year we have checked out five leads in Brazil. Unfortunately nothing has been found which would lead to Maddie's discovery."

The abduction theory can't be explained.

The British press lists several potential hiding places for a predator inside apartment 5a of the Ocean Club on the evening of May 3rd, towards 21.05, the time that Gerry stated he had gone into the apartment to check on the children. Photos published by the News of the World and reproduced her may serve the interests of the couple in showing the possible hiding places. Only, far from helping the parents, these photos put forward show the blatantly obvious. According to the Portuguese press, there is great difficulty, not to say an impossibility, for the abductor to take Madeleine through the bedroom window, jumping through there with a three year-old child in, or under, his arms.

Another detail, and not the least of them, revealed by the Portuguese press on the basis of these photos, is that the twins' cots were beside the bed, near the window. Thus if an abductor had had to flee through the bedroom window, he would have had to climb over the bed, carrying a child or move the bed to reach the window but the bed being found there as well as the twins' cots renders the theory of an abductor fleeing through the window of the children's bedroom, incredible, not to say impossible. Kate had stated that the window of the children's bedroom was open and that it was probably through there that a potential abductor would have fled. Note that no other window had been found open. From the photos, the Portuguese press goes on to say, it can be observed that if a third party had been present in the apartment at the moment when Gerry entered by the patio door, the suspect would have had a space of less than ten seconds in which to hide.

Enfants Kidnappés: the McCanns' holiday apartment is to be re-let.

The apartment is to be re-let.

The owner of the apartment, from which Madeleine disappeared in Portugal, wishes to let it. Ruth McCann, the owner of apartment 5a in Praia da Luz, wants to put up the Ocean Club property for rent. The legitimate income from letting the apartment to tourists, holidaying in Praia da Luz, is raised to £19,500 a year. The apartment comprised of two rooms, has been empty since August. The loss of income is undeniable. However, the re-letting will not be able to be done before the month of June. According to certain sources in Portugal, this is due to the fact that the PJ still need the apartment during the reconstruction planned for the month of May.

The journalist sticks to what he said.

The Spanish journalist, Nacho Abad, who divulged to, "Telecino," passages from the McCann couple's interview, said he had documents proving what he says. "if you ask me if I have proof of what I have put forward, yes I have written proof. I have documents." The assertion comes from Nacho Abad, a contributing journalist on Anne Quintana's programme for Telecino. The journalist apologised for not saying more about it and is not surprised that people are looking to refute the information. "What I can say, is that the McCanns themselves have tacitly confirmed this version by talking of a leak of information on the part of the PJ, without denying the information itself," the journalist says. Last week, Telecino revealed an extract from a police report, mentioning Madeleine's crying the day before her disappearance and Kate's subsequent suggestions about Madeleine's reactions.
"Mummy, why didn't you come, last night, when we were crying?" Madeleine is quoted as saying.

Quoted in the same report is: "Gerry and I discussed it for several minutes and we decided to be more watchful of the children at night." The PJ continues to deny that any leak came from them. It is curious to note that it is the first time that the McCanns' spokesperson directly accuses the PJ of leaks in the investigation. At all other times the accusations were more vague. Anyway, Correio da Manha publishes interesting information. According to the latter, the documents in question divulged by the Spanish journalist were copies of a report by a detective agency hired by the parents before they hired Metodo3. Note that the Spanish journalist had promised more revelations in the Telecino broadcast of April 15th, but there was nothing about it.

Vanity Fair: Unanswered Prayers.

Interior of the bedroom at apartment 5A, where Madeleine and the twins slept.

Viewing the front page headlines last night on Sky News web site, several of the dailies were leading with Gerry and Kate McCann's regrets about the events of the evening in May 2007 when their daughter Madeleine disappeared. This looked like new news and there was speculation of various online forums that the timing of the expressed regrets had something to do with the imminent visit to the UK of Portuguese police officers to re-interview the seven friends the McCanns went on holiday with. Or maybe, as some suggested, it was an attempt to regain public sympathy and bring the cash rolling in for the depleted Find Madeleine fund.

The UK dailies were, in fact, quoting an article in Vanity Fair magazine about an interview Kate and Gerry gave in October 2007. It is not unusual for magazines like Vanity Fair to have such a long period between interview and publication.

The newspapers that were leading with Gerry's regrets seem to have journalists who have done very selective reading of the Vanity Fair feature.

Vanity Fair

"
I wish I hadn’t gone to the tapas bar. I wish I’d stayed in the apartment that night. I wish I’d stayed in the room when I checked on her five minutes longer,” Gerry recalls thinking in the days that followed his child’s disappearance."

Later in the interview, though, it seems that Gerry is not quite so regretful.

"
On the couple’s return, there was further pain to contend with. More than 17,000 people had signed a petition suggesting that Leicestershire social services investigate them for leaving their three small children completely alone in the villa.

At the time we did it, it was not irresponsible!” Gerry snaps. It is the one subject on which he is quite defensive, arguing first one way, then conceding the opposite: “Of course we feel guilty about not having been there, and that is just something we have to deal with for the rest of our lives. You are not asking anything we don’t think about on a daily basis. We live this 24 hours a day.”

So, Gerry said he wished he had not gone to the tapas bar, but thought it was not irresponsible to do so? I guess there is some kind of logic there. He's not admitting to having been in error, in fact in other interviews Gerry said he had been assured by Social Services that his behaviour had been well within the bounds of, "reasonable parenting." He didn't say he wished he hadn't left the kids alone and he didn't say he wished he had hired a babysitter, just that he wished he hadn't gone to the tapas bar.

Clarence Mitchell was interviewed by Jon Gaunt of The Sun and Talksport, on Wednesday 9th January. Clarence was asked if Kate and Gerry thought it had been wrong to leave the children alone. The answer was that Kate and Gerry were sorry that they were not with her when she was taken and that they had made a mistake on the night. What mistake? Not being there? Well, all we have is that Kate and Gerry were sorry they were not there when Madeleine was taken. Strange! If Madeleine was abducted, surely this would not have happened if they had been there at that moment? And a mistake on the night? What about all the other nights when, by their own admission, Kate and Gerry left the children on their own?

The Vanity Fair article is a very long one and ploughing one's way through, it might be easy to miss at least one contradiction to reports elsewhere. Herein lies one of them; Gerry talking about what was found at the apartment when Kate returned at 10pm to check on the children.

"
On one bed the twins lay sleeping. In the next lay only the plush cat toy Madeleine was never without."

The twins were lying together on one of the beds? Surely all other witness statements about the scene say that the twins were in cots?

From the Times Online, quoted on the web site
, The McCann Files

"
Silvia Batisa, head of administration at the complex, helped to comfort the family and interpret their interviews with the police: "The parents were devastated, in a panic. They wanted more police and dogs immediately. Kate said all the time, 'Please find my daughter’ and ‘Madeleine is beautiful'."
She recalled that the twins were still asleep in their two cots and there was the small, bright pink wool blanket that Madeleine likes to hold when she sleeps. "We walked out quickly so as not to wake up the twins. The parents immediately said, 'She’s been kidnapped'," said Batisa."

Considering that the interview was done in October, 2007, it seems strange to see that there is reference to the window of the apartment having been, "jemmied," when very early on the police and the Mark Warner management both stated that the neither the shutters nor the window had been tampered with.

There is mention of Madleine's distinctive right eye, the coloboma. This quite rare feature would make Madeleine immediately recognisable.

"
Although initially reluctant, the McCanns finally informed the media of Madeleine’s unique right eye—a risky revelation. Whoever had taken the child now held a universally recognizable little girl.

Gerry understood that. But, he says, the iris “is Madeleine’s only true distinctive feature. Certainly we thought it was possible that this could potentially hurt her or”—he grimaces—“her abductor might do something to her eye.… But in terms of marketing, it was a good ploy.

A good marketing ploy? Good God! You'd think he was selling double-glazing, not risking a child's life! And let's not forget how Kate and Gerry courted publicity, in an attmept they say, to keep Madeleine's profile high in the media.

"
The media were constantly sought out. Reporters followed the McCanns on trips to Washington (where then U.S. attorney general Alberto Gonzales met with the couple); to Morocco—just in case Madeleine had been taken there—where they met with Charki Draiss, director-general of national security; and to Amsterdam, where the McCanns had once lived. If the networks needed fresh footage, they would be told the exact time the McCanns might be walking to church in Praia da Luz."

Kate, having said that she would not leave Portugal witout Madeleine, she and Gerry left within a couple of days of having been made arguidos. Perhaps the lease on their rented villa had run out, but it did seem like a rather hasty exit, and well covered by the media.

"It was time to go home, Gerry decided by September 9. But not alone. When Gerry and Kate were about to go home to Britain, Gerry phoned Sky News and said, ‘We’re going home on EasyJet, be on it!’ ” recalls Esther Addley, who has written incisively about the McCanns for The Guardian."

So, that was the big news, as reported by several of the UK's daily newspapers today, Gerry's regrets or lack of them! Then there was that film...and Clarence telling folks that if they wished to contribute to the fund, they could just, "..put a cheque or anything into an envelope," and address it to the McCanns, Rothley, as many people from around the world were already doing.
There you have it folks! We've had articles about blood found in the McCanns holiday apartment and in the hired car having been identified as Madeleine's and reports that the Portuguese police will be returning soon to the UK to re-interview the seven friends of Kate and Gerry with whom they went on holiday to Praia da Luz.

We've had denials about making a movie, but an admission that the McCanns want to make a film about Madeleine's disappearance. (Listen to the Clarence interview with Jon Gaunt) And now the Vanity Fair feature. Anyone else wondering if maybe there are some attempts to distract from the important news about DNA tests, police visits and the resignation of several directors of the Find Madeleine fund?

Still, as far as the McCanns and the fund are concerned, I guess there is an upside to all this. As Clarrie said, "Every time Gerry and Kate do any media, the money comes in."
