David Payne May Hold the Key to Maddie's Mystery

Since the 16th of May 2007, the British authorities possess an official formal complaint presented by Katherine and Arul Gaspar, regarding suspicions about David Payne's behaviour which might be consistent with paedophilia acts.


These statements only entered the Portuguese Public Ministry's Process of investigation into Madeleine McCann's disappearance in January 2008 - the third version of the famous rogatory letters had already been sent to the Home Office - read: 'English tantrum delays McCanns process'. It is unknown if these statements were followed up by both forces in the United Kingdom and in Portugal.

The Gaspars, both doctors and former friends of the Paynes and of the McCanns, explain in the following statements what led them to present the criminal complaint: the time was in September of 2005, the place Mallorca.

As requested, appended are the statements of Arul and Katherina Gaspar.

I read carefully the written statements given by David Payne but was not able to extract any other information besides what is already known.

He declares that he saw Madeleine, for the last time, at 17H00 on 3/5/07 in the McCann’s apartment. Also present there were Kate and Gerry. He did not indicate the motive for being there or what he was doing. Similarly he does not indicate for how long he stayed.

When asked with whom he was on the afternoon of May 3rd, he declares that this information was already offered to the police and he cannot remember if anyone else was there.

He does not remember what he was wearing that afternoon.

He took part in the searches, having carried out most of them alone. He was at times accompanied by Matthew Oldfield.

He did not partake in the searches realized on the 4th of May, because, on this day, he spent to majority of time in the police headquarters.

For many of the questions, he does not give a complete answer, affirming simply that he has already given this information/declaration to the Portuguese police.

I examined again the declarations of Fiona Payne. In her depositions, she states that she went to the McCann apartment, around 19H00, on the 3rd of May, together with Kate. She states that 10 minutes later, the husband arrived; it is not clear which husband she refers to, if to Gerry or her own husband.

Her responses to the written questionnaire are vague, given that, she continues to answer to the questions with “they conform to my earlier deposition” or some similar statement.

I give this declaration in relation to the McCANN family who are currently in Portugal. The McCANN family is composed of Gerry McCANN, his wife, Kate McCANN and their three children, Madeleine, of 4 years old, and Sean and Amelie, who are twins and of 2 years of old.

As is profusely divulged in the news, Madeleine is not with her family, at present, and has been missing for the last two weeks.

I will begin by explaining that I am married to Savio Gaspar and that we have two daughters. E. of almost 3 years old and I. which is now 1 year old. I have been married to Savio for 11 years. I am a general practitioner as is my husband. I met my husband when we were (page 1) working together in Exeter, around 14 years ago.

In order to explain how we know the McCANN family, I would like to state that my husband knows Kate as they both attended Dundee University between 1987 and 1992. At that time, Kate name was Kate HEALY. I met Kate and Gerry at the occasion of their wedding, in 1998, in Liverpool. Both Savio and I went to the wedding, since Savio was an old friend of Kate, we were invited to the event.

From what I know, Savio did not know Gerry before the said wedding. After this time, we mat as friends, probably around three times a year, and we would go out together for the weekend. I would say that we become intimate friends of Gerry and Kate.

I remember that in 2002 or 2003, Savio and I spent a weekend with Gerry and Kate in Devon. We maintained contact with each other via telephone.

In 2002/2003 Savio and I were living in Birmingham and the McCANNS in Leicester.

In September of 2005 Savio, myself and E., who at the time was 1 and a half years old, spent our holidays abroad, in Mallorca. We went (page 2) on holidays with Kate, Gerry, and Madeleine, who should have been around 2 and a half years old, and the twins, Sean and Amelie, who were only months old. I remember that I was pregnant with I.

On those holidays we also met Gerry and Kate’s friends.

There was a couple, whose names were Dave and Fiona, and whose surname was PAYNE, I think. I believe that they were married and had one daughter, 1 year old, named L. I remember that on these holidays, Fiona was pregnant.

There was another couple, whose names were T. and S., and whose family name I cannot remember who were also on holiday with us. They had two boys, of 1 and 3 years old, whose names I do not remember. I did not know these two families until we went on holidays together. As I recall, I think that David organised the holidays and we all stayed together in a big house while we stayed in Mallorca.

We spend a week on holidays, however, the McCANN family, and the PAYNE family stayed for two weeks. I believe that T. and S., and their two children, also stayed for one week.

Two or three days passed in Mallorca where we had fun (Page 3) with our children. Possibly around the fourth or fifth day abroad, I remember an incident that stayed recorded in my head. I say this in this way, because I have thought many times about the incident that I am about to describe.

One night, on holidays, the adults, that is, the couples aforementioned, were in a patio outside of the house where we were staying. We had been eating and drinking.

I was seated between Dave and Gerry who I believe were both speaking about Madeleine. I don’t remember the conversation in its entirety, but it seemed they were discussing a possible scenario. I remember David telling Gerry something like “she”, referring to Madeleine, “would do this”.

When he mentioned “this”, Dave was sucking on one of his fingers, pushing it inside and outside his mouth, while with the other hand he made a circle around his nipple, with a circulatory movement over his clothes. This was done in a provocative manner and carried an explicit insinuation in relation to what he was doing and making.

I remember that I was shocked at this, and looked at Gerry, and also at Dave, to gauge their reactions. I looked around (page 4) as if saying “did someone else hear that, or was it just me”. There was a nervous silence registered in all the conversations and afterwards, everyone began talking again.

I never spoke to anyone about this, but I always felt that it was very strange and it wasn’t something that someone should do or say.

Besides this [incident], I remember that Dave did the same thing once again. When I refer to this, I want to clarify that it was during a conversation in which he was talking about an imaginary situation, though I could not say exactly what about.

I believe that he was talking about his own daughter, L., although I cannot be certain. He put one of his fingers in his mouth and slide it in and out, and with the other hand, drew a circle around his nipple in a sexually and provocative way. I believe that he was referring to the way that L., would behave or do it.

I believe that he did this later on, during the holidays, but I cannot be sure. The last time, besides this one, when I was with Dave and Fiona was several weeks after the holidays, when Savio and I met Gerry, Kate, Dave and Fiona at a restaurant in Leicester.

I am absolutely certain that he said what he said and that he repeated the same gestures that I referred, however that could have occurred in a restaurant in Leicester, though (page five) I believe that it was later on, in Mallorca. When I heard Dave doing and making this a second time, I took it more seriously.

I remember thinking whether he looked at the girls in a manner different from me or from the others. I imagined that maybe he had visited Internet sites related to small children. In short, I thought he was interested in internet child porn.

During our holidays I was more attentive at bath time after hearing Dave saying that.

During our vacation in Mallorca, it was the fathers who took care of the children baths. I had the tendency to walk close to the bathroom, if Dave was bathing his children. I remember telling Savio to be careful and to be there, in case it was Dave helping to bathe the children and, in particular, to my daughter E. I was very clear about this, as having heard him disturbed me, and did not trust him to give bath to E. alone.

When I heard Dave say that a second time, it reinforced what I already thought in relation to his thoughts about little girls. During our stay in Mallorca, Dave and his wife, Fiona, accompanied by this daughter L., took Madeleine (page 6) with them to spend the day together, and to give Kate and Gerry a bit of rest and time to be with the twins. When I say this, it is not that I was worried about Madeleine’s safety, since she was also with Fiona and L., and also with Dave, as far as I know.

As I already mentioned, I was only with Dave and Fiona on one occasion, after Mallorca, and I have not spoken to them since that time. In the last two years, we have met, as a family, with the McCANNS, once in a while. That happens mainly at the children’s birthday, a time when we get together.

The first time I had knowledge of the terrible news about Madeleine’s disappearance through the radio, my thoughts went immediately to Dave. I asked Savio if Dave was also on holidays with the McCANNs in Portugal but he did not know.

I watched TV meticulously, and seeing the coverage of the news, I understood that Dave was there, because I saw him, in the background, on the television images during the first days after the Madeleine’s disappearance. Based on that, I believed that he was on holidays with the McCANNs in Portugal.

Today, Wednesday, the 16th of May of 2007, at 17:40, I gave DC Brewer an A4 page containing 2 photographic images. I am going to reference these images as (ref KZG/1) (probatory element) that may (page seven) be presented as mean of proof, if necessary.

These photographs were taken during the holidays in Mallorca. In the photographs, Dave is wearing a white t-shirt and the woman in the photograph is his wife Fiona. The man who is holding the cup of wine in the photograph is S. These photographs were taken whilst we were in Mallorca.

These statements are produced in relation to the missing girl, Madeleine McCann.

I currently work as a GP at Saint Clements Surgery, Nechells, Birmingham, where I have been employed for the last nine years.

Madeleine is the daughter of Kate and Gerry McCann and our families are friends.

I have known Kate since 1987, when we met at Dundee Medical School, having since then, become friends. We have remained in touch during all this time and, in a general way, we meet up 3 to 4 times a year, speaking regularly on the phone or by email.

When we first became friends, in 1987, Kate was known as Kate HEALY, this was the case until she married Gerry at the end of 1990s. Kate and I completed our medical degrees in 1992, when each carried on with our lives, once we had begun our careers.

After I finished my degree I began my career in EXETER, and I think Kate went to GLASGOW. (page one)

I only met up with Kate again in 1997 or 1998. By then I was married to Katherina, we had both been invited to attend her wedding with Gerry.

After their wedding we lost contact again and I believe they went to NEW ZEALAND.

We only met up again in 2001, this time in Birmingham.

The couple visited us in the house where we then lived, in A.G., and this was, in fact, the first time I talked to Gerry.

I believe that at the time Kate and Gerry were living in Queeniborough, Leicestershire.

From 2001 and 2005 we were in regular contact and every once in a while visited each other’s homes.

We had planned holidays for the first week of September 2005 in MALLORCA, SPAIN, along with three other couples including Kate and Gerry. We did not know the other two couples, they were friends of Kate and Gerry, and we had never been with them before.

We all had children.

At the time of this holiday we had one daughter, E., aged 18 months.

Kate and Gerry had 3 children, Madeleine, almost two years old, and the twins, Sean and Amelie, both six months old.

The other couples were Dave and Fiona PAYNE, who had a daughter L., who was one year old, and S. and T. who had two boys, one aged three and the other one aged one. I do not remember S. and T.'s surname, nor the names of their children.

Katherine and I had booked the holiday for one week and the others two for two weeks. We stayed together in a holiday house [villa], which was large. (page two)

Although all of us arrived at this holiday house separately, Katherina and I arrived at the first day of the booking, extending our stay up to the end of the first week of the holiday period of two weeks.

During the period that we stayed at the holiday house, I remember a gesture made by Dave PAYNE.

I do not remember which was the context of the conversation that Dave and Gerry were having then, however I do recall vaguely, Dave using his left index finger to rub, with circular movements, his left nipple; whilst he put the head of his right index finger to his lips, touching it with his tongue. This happened during a meal, at the end of the day, in the holiday house, and though I do not quite remember the time or the day, I can safely say that we would usually dine between 19.30 and 21.00 every day. I believe this happened in the middle of our holidays.

I remember seeing that gesture, and I immediately thought it to be of extreme bad taste, independently of the context of the conversation that they were having. We were sitting around a plastic, rectangular shaped, white table in the garden of the house. I don’t know if anyone else noticed Dave’s gesture, apart from my wife Katherina. After this incident with Dave’s gesture, no comments were made and as far as I know, the gesture was not repeated.

During the rest of the holidays, no one made comments about that incident and I thought no more about it.

I can describe Dave as being a man of Caucasian race, measuring 1.78m [5’10’’], and of average physical complexion. He had brown, receding hair and used glasses/contact lenses, depending on the circumstances.

I can say that Dave was a pleasant person. I do not remember him having any unusual characteristics. (page three)

During the holidays, I have never seen Dave behaving in an inappropriate manner with Madeleine or with any of the other children. Dave was popular among the children, which I attributed to the fact that he was a close friend of the family.

I never mistrusted Dave. After the holidays there was just one other occasion when we were with Kate and Gerry and Fiona and Dave were also present.

That was in a restaurant in Leicester in 2005. I do not remember the name of the restaurant. Nor the exact date.

We were having a pleasant afternoon, just the three couples, without the children.

I do not remember Dave having behaved inappropriately on this occasion. Since December 2005, we have not seen or spoken to Dave or Fiona, only due to the fact of them being friends of Kate and Gerry, not for any other reason.

The last time I saw Kate, Gerry, Madeleine, Sean and Amelie was in March 2007 when they came to our house for the first birthday celebration of my daughter I. On Friday morning, the 4th of May 2007, Katherine and I had knowledge of Madeleine’s kidnapping on the TV news. We were very shocked and worried given that I considered them to be close friends.

It was during the days following the news of the abduction that we discovered that Dave and Fiona PAYNE were also with them in Portugal.

It was at that moment that Katherina showed apprehension at the gesture made by Dave in Spain, during our holidays, in September 2005. Katherina thought that when Dave made the gesture, he was referring to Madeleine.

I only understood that Katherina had also seen Dave’s gesture at (page four) at this time, given that I had forgotten the incident, never having been, therefore, a subject of conversation.

At the time, I did not have the impression that the gesture was referring to Madeleine.

It is my wish that the police are aware of my concern about the gesture made by Dave Payne.

David Payne's statements were taken the day after Madeleine's disappearance, May 4th 2007 at 2.45pm. As with all the others, David Payne was accompanied by a, "sworn," interpreter, A. Francisco M. The statement was recorded by inspector Patricia D.
The words at the beginning of an interview are invariably the same. They are mandatory type words. They form the legal basis of the document. Recited often, they are like:
"We, Patricia D., police inspector, in the service of the PJ, Portimao Section, note:"

On the subject we are recording it is shown:

That the interviewee made this statement voluntarily. That he has been on holiday in Portugal since April 28th 2007, staying at the Ocean Club, Praia da Luz. That he plans to return to England on May 5th 2007 (Saturday). That he has known Madeleine's parents for around 5 years. That he was on holiday with Madeleine and her parents. That he came with a group. That the group is composed of nine adults and eight children. The adults are: Diane, the interviewee and his wife (children: ***** and ***), Russell and Jane (children: **** and ****), Matthew and Rachael (child: ******), Gerry and Kate (children: Amelie, Sean and Madeleine).
That they came to Portugal via a tour operator. That it was the interviewee who booked the trip.

Concerning the days spent in Portugal, the interviewee describes them as being all very much the same. He states that his family, composed of his mother-in-law Diane, his wife Fiona and their two children, spent their days more independently than other members of the group. They were most often with the couple Russell and Jane.


Concerning the remaining membes of the group, normally they got up and went for breakfast at the, "Millennium," restaurant, after which they left their children at the Kids Club and the adults went to do sports inside the tourist complex or they went to the beach. The couple Gerry and Kate had breakfast in the apartment. It was usual to have dinner together every night. With the exception of Saturday, when they all dined at the, "Millennium," restaurant, every evening the group was to be found at the, "Tapas," restaurant at around 8.45 for dinner. While the adults were dining, the children were sleeping in their respective apartments.

In answer to our question, the interviewee states that during all the meals, he never went to his apartment or to any of the group's apartments, because he has an, "intercom," and the signal carries from the apartment to the restaurant. The other members of the group went, randomly, every 20 minutes, to their apartments to make sure their respective children were asleep.

Concerning yesterday evening, he states that he, his wife and his mother-in-law arrived at the restaurant at around 8.55pm. According to what he remembers, when they arrived, all the members of the group were present, apart from the children, who were in bed. During the evening, Gerry, Jane and Matthew went, alternately, to their children's bedrooms to check if they were sleeping. He thinks they physically went into the apartments. He no longer remembers in what order they went see their children.

Towards 10pm, Kate went to her apartment, and less than 5 minutes later, she came back to the restaurant, breaking down, reporting that Madeleine had disappeared. Then everybody went to the apartment occupied by Madeleine's family. He remembers comments concerning the fact that the window and the shutters were open, while they had remained closed throughout the week.

That the apartment occupied by Madeleine's family comprises two bedrooms, a small kitchen, a lounge and a bathroom. That the lounge has a door which gives outside access in the direction of the restaurant. He does not recall any more details of the apartment but he remembers that the bedroom occupied by the children has a window that looks onto the main road. That he never went into the said bedroom occupied by the children but he could see that there were two beds and two cots. The cots were placed in the middle of the bedroom. One of the beds was placed against the window and the other, the one occupied by Madeleine, was against the wall facing the one which has a window.

In answer to our question, the interviewee doesn't know how many times Madeleine left the tourist complex, but he knows she went, at least once, to the beach. That during the holiday, he saw nothing abnormal concerning the couple Gerry and Kate, neither with their children nor, notably, with Madeleine. In the context of the group, he noticed nothing abnormal. That during the whole holiday, and particularly during the day and the night yesterday, nothing unusual happened in the tourist complex, which attracted his attention, or which could be correlated with Madeleine's disappearance.

He describes Madeleine as being a communicative girl, happy, obedient and very well behaved. Madeleine's parents are very sociable people, known by lots of people, kind and affectionate. Madeleine is indeed the daughter of both elements of the couple. She was wanted and is the result of, "In Vitro," fertilisation. There was no difference in treatment between Madeleine and the twins. He doesn't know if Madeleine suffers from any illness, nor if she is on medication. He has nothing more to say that could help the progress of the investigation.

This was posted on the Enfants Kidnappés site on Sunday 20th July. I thought it was worth posting, even in the light of today's announcement of the archiving of the Madeleine McCann case because of the details about the forensic analyses of DNA samples.

Ne pas lever l'entièreté du secret de justice.

Un magistrat et deux policiers, parmi lesquels Stuart Prior, officier de liaison avec la PJ, se sont rendu au Tribunal de Portimao afin de demander au Ministère Public de ne pas libérer le secret de justice sur la totalité du dossier "Maddie".


Les motivations de cette démarche seraient diverses, selon la presse portugaise. Il y aurait, d'une part, le fait que la police britannique souhaite maintenir secret le contenu de la liste des ressortissants britanniques classés "pédophiles" vivant en Algarve. Ces pédophiles connus ont été clairement identifiés sur une liste que les autorités britanniques ont remise à la PJ et qui fait partie du dossier "Maddie". La levée du secret de justice rendrait le contenu de la liste accessible au publique. L'autre raison, toujours selon la presse portugaise, serait la demande de ne pas levée le secret de justice sur les résultats des tests ADN.

Do not lift the whole of the secrecy of justice.

A magistrate and two police officers, one of them, Stuart Prior, liaison officer with the PJ, went to the Portimao appeal court to ask the Public Minister not to open the secrecy of justice on the whole of the, "Maddie," case. There would be various reasons for this approach, according to the Portuguese press. On the one hand there is the fact that the British police wish to keep secret the contents of the list of British citizens, classified as, "paedophiles," living in the Algarve. These known paedophiles are clearly identified in the list which the British authorities gave to the PJ and which form part of the, "Maddie," file. The lifting of the secrecy of justice would make the contents of the list accessible to the public. The other reason, still according to the Portuguese press, would be the request not to lift the secrecy of justice on the results of the DNA tests.

Il semblerait que les anglais ne souhaitent pas voir divulguer le rapport préliminaire du labo de Birmingham dans lequel est établi que 15 des 19 marqueurs génétiques coïncident parfaitement avec l'ADN de Madeleine McCann. Ce rapport a été contre dit par la suite. Les vestiges rassemblés derrière le sofa, selon le premier rapport, coïncident, également, avec le profil ADN de Madeleine McCann. C'est ce rapport qui a réconforté la PJ, ainsi que l'officier de liaison britannique, dans leurs soupçons quant au fait que Madeleine soit morte entre 17h30 et 22h00 à l'Ocean Club de Praia da Luz et que le corps fut transporté dans la voiture loué par les parents, 22 jours plus tard. Avec la levée du secret de justice, certains de ces documents seront rendu publique. Ce dit rapport, ajouté aux éléments rassemblés durant l'enquête ont conduit les inspecteurs à soupçonner les parents du décès de Madeleine. Un autre rapport, signé par Mark Harrisom, policier britannique désigné pour assister les autorités portugaises, affirmait péremptoirement que la fillette était décédée. Le policier évoquait même la possibilité que le corps de Madeleine ait été jeté à la mer.

It would appear that the English do not wish to see the preliminary report from the Birmingham lab divulged in which it was established that 15 out of 19 genetic markers coincide perfectly with Madeleine McCann's DNA. This report was contradicted by the one that followed. The samples gathered behind the sofa, according to the first report, also coincide with the DNA profile of Madeleine McCann. it was this report which reassured the PJ, as well as the British liaison officer, in their suspicions about the fact that Madeleine had died between 5.30 and 10pm at the Ocean Club in Praia da Luz and that the body was transported in the car rented by the parents, 22 days later. With the lifting of the secrecy of justice, certain of these documents will be made public. the said report, added to the details gathered during the investigation led the inspectors to suspect the parents in Madeleine's death. Another report, signed by Mark Harrison, British police officer, assigned to help the Portuguese authorities, affirmed categorically that the young girl was dead. The police officer even suggested the possibility that Madeleine's body had been thrown into the sea.

Technique de pointe.

La technique utilisée par les spécialistes britanniques, pour analyser les vestiges rassemblés dans l'appartement et dans la voiture des parents, est une des plus sophistiquée du Monde. Cette technique est utilisée aux États-Unis parce qu'elle permet d'extraire des profils ADN précis à partir de vestiges très ténus par l'augmentation des cycles d'amplification. Dans ces rapports, envoyés à la PJ avec quelques mois de différences l'un de l'autre, les autorités commencent à expliquer la technique utilisée et rendent compte comment ils ont utilisés un échantillon d'ADN de référence de Madeleine McCann. Cet échantillon a été obtenu via des taches de salives existantes sur le coussin de la petite.

Cutting-edge technique.

The technique used by the British specialists, to analyse the samples gathered in the apartment and in the parents' car, is one of the most sophisticated in the world. This technique is used in the United States because it allows the extraction of clear DNA profiles from very subtle samples by the augmentation of the amplification processes. In these reports, sent to the PJ a few months apart, the authorities began to explain the technique used and how they used a reference sample of Madeleine McCann's DNA. This reference sample was obtained from samples of saliva on the young girl's pillow.


L'ADN des autres membres de la famille a été vérifié afin d'extraire les marqueurs génétiques identiques pour qu'il n'y ait pas de confusion lors du résultat. Le rapport est de 22 pages et signé par un expert biochimiste et spécialiste en microbiologie. Il détermine que 15 marqueurs génétiques sur 19 coïncident parfaitement avec l'ADN de Madeleine McCann. Le second rapport, envoyé après que Kate et Gerry furent déclarés suspects, soulève des doutes théoriques quant aux conclusions du premier rapport. On parle, ici, de 15 marqueurs sur 19. Aux États-Unis pour condamner quelqu'un il ne faut que 12 marqueurs d'ADN concluant. Ainsi, aux États-Unis, sur base de ce rapport, les parents seraient accusés. Or au Portugal, La loi exigeant 19 marqueurs identiques, les parents pourraient bénéficier d'un non lieux voir même d'un classement du dossier.

The DNA of other members of the family was checked in order to extract the identical genetic markers so that there would be no confusion with the results. The report is 22 pages and is signed by an expert biochemist and specialist in microbiology. It determines that 15 genetic markers out of 19 coincide perfectly with Madeleine MCann's DNA. The second report, sent after Kate and Gerry were declared suspects, raised theoretical doubts about the conclusions of the first report. It speaks here of 15 markers out of 19. In the United States to convict someone only takes 12 conclusive DNA markers. Thus, in the United States, on the basis of this eport, the parents would be charged. But, in Portugal, the law demanding 19 identical markers, the parents could be discharged through lack of evidence or even see the archiving of the case.

Un ami pédophile ?

La presse portugaise par le truchement du Correio da Manha publie un article assez délicat. Selon ce dernier, un des amis du couple McCann qui se trouvait avec eux en vacances à Paria da Luz le 03 mai de l'année dernière a été suspecté de comportement à caractère pédophile. Ces accusations ont été lancées par un autre couple d'amis qui ont passés les vacances de 2005 avec les McCann. Le couple, amis d'enfance de Kate, connaît cette dernière depuis 20 ans et ils n'ont rencontré "l'ami suspect" qu'une seule fois, c'était en 2005. Le CM fait état d'une déposition enregistrée par les autorités le 16 mai mais versé au dossier qu'en janvier 2008 et qui ferait déjà partie du 13ième volume sur l'affaire. Nous sommes assez surpris que des policiers aient enregistrés ces dépositions. En effet, elles ne reposent sur rien.


A paedophile friend?

The Portuguese press via Correio da Manha, publishes a very delicate article. According to the latter, one of the friends of the mcCann couple who was with them on holiday in Praia da Luz on May 3rd last year was suspected of showing paedophile tendencies. These accusations were put forward by another couple of friends who had spent the 2005 holiday with the McCanns. The couple, childhood freinds of Kate's, had known her for 20 years and they had only met the, "suspicious friend," once, which was in 2005. The CM reports a statement recorded by the authorities on May 16th but only added to the file in January 2008 and which would already be part of the 13th volume on the case. We are very surprised that the police officers recorded these statements. In effect, they are not based on anything.


Il n'y avait pas matière à acter! Si l'on reprend la publication du CM, Katherina, amie d'enfance de Kate, aurait vu, durant la nuit, le fameux "ami suspect" en conversation avec Gerry avoir des gestes obscènes à caractères sexuelles en parlant de Madeleine. Décrivant le geste avec détails faisant clairement allusion à un doigté vaginale préalablement mouillé par la bouche. Son époux, Arul, quant à lui, se souvient bien du geste, qu'il qualifie d'un extrême mauvais goût, mais ne peut être sûr que "l'ami suspect" et Gerry parlaient de Madeleine! Bref, rien de bien concret finalement. En tous cas pas de quoi enregistrer une déposition. Les deux compères pouvaient parfaitement parler de n'importe qui ou faire allusion à n'importe quoi. En outre, le fait de révéler l'identité de l'ami en question et en le qualifiant de "suspect d'acte pédophile", met une famille en danger. Une famille mais aussi une situation professionnelle, une vie sociale etc. etc. Il nous semble très imprudent de rendre public ce genre d'accusation. Nous attirons l'attention de nos lecteurs sur le fait qu'il ne faut pas tirer de conclusions hâtives. Ne pas accuser trop vite quelqu'un, ne pas mettre une étiquette sur une personne qui n'a peut-être rien à se reprocher. Soyez subtil, il est plus facile de détruire une réputation que de rétablir l'image de quelqu'un. Rien ne prouve que "l'ami suspect" soit coupable de ce dont on l'accuse.

As for her husband, Arul, he remembers the gesture well, which he classes as being very bad taste, but cannot be sure that the, "suspicious friend," and Gerry were talking about Madeleine! In short, nothing tangible in the end. In any case, it's not about recording a statement. The two fathers could perfectly well have been talking about anything or making allusion to anything. In addition, the fact of revealing the identity of the friend in question and in classifying it as a, "suspicious paedophile act," places a family in danger. A family but also a professional standing, a social life etc. It seems to us very unwise to make this kind of accusation public. We draw our readers' attention to the fact that we must not jump to hasty conclusions. Do not accuse someone too quickly, do not apply a label to someone who perhaps has nothing to reproach himself with. Be discerning, it is easier to destroy a reputation than to rebuild someone's image. There is nothing to prove that the, "suspicious friend," is guilty of what he is being accused of.

La PJ va maintenant discuter avec le Ministère Public pour savoir si celui-ci avance avec l'accusation ou si la reconstitution reste indispensable.

Quatre des amis qui avaient accompagné Gerry et Kate McCann pendant leurs vacances au Portugal ont refusé de retourner à Praia da Luz pour y participer à la reconstitution des événements liés à la disparition de Madeleine, une diligence prévue pour jeudi et vendredi prochains et que la Police Judiciaire (PJ) considérait "extrêmement importante" pour consolider l’enquête.

The PJ are now going to discuss with the Public Ministry to find out if they will proceed with the prosecution or if the reconstruction is still necessary. Four friends who had accompanied Gerry and Kate McCann during thier holiday in Portugal have refused to return to Praia da Luz to participate in the reconstruction of the events linked to Madeleine's disappearance, an action planned for next Thursday or Friday and which the PJ would consdier, "extremely important," to consolidate the enquiry.

L’annonce du refus de coopération des quatre britanniques, et la conséquente annulation de la reconstitution, n’a pas surpris les enquêteurs car ils avaient déjà reçu, il y a plus d’une semaine, l’information de leurs collègues au Royaume-Uni de qu’au moins deux des "Tapas sept", le couple Jane Tanner et Russell O’Brien, n’allaient pas revenir.

The information, confirmed today by a note from the office of the Attorney General of the Republic (PGR) further states that, without their presence, the action would purely and simply be cancelled. The announcement of the refusal to cooperate by the four British people, and the consequent cancellation of the reconstruction, has not surprised the investigators because they had already received, over a week ago, the information from their colleagues in the United Kingdom that at least two of the, "Tapas seven," the couple Jane Tanner and Russell O'Brien would not be going to return.

The seven friends - Jane Tanner and Russell O'Brien, Matthew and Rachael Oldfield, David and Fiona Payne, and her mother Diane Webster - were questioned as witnesses in Portugal and in the United Kingdom, stating being willing to help the enquiry into Madeleine's disappearance, a position which the PJ had already questioned in the past and which their refusal announced today seems to confirm.

On Friday May 2nd, Enfants Kidnappés reported that a reconstruction had already taken place last year in October, without the principal, "players," in the case.

Permettant d'avoir une vue complète sur les évènements. Ce qui n'est pas possible sur papier ou bien des éléments peuvent ne pas paraître aussi évident. Ainsi, une reconstitution permet de révéler bien des éléments. Or une première reconstitution a déjà été faite en octobre dernier avec tous les éléments et figurants présent à Praia de Luz le 03 mai entre 18h30 et 22h40. Seuls, les intervenants principaux n'étaient pas présents. C'était voulu! En effet, maintenant la PJ dispose d'une vue précise de ce qui s'est passé ou plutôt de "qui faisait quoi" et surtout "où et à quel moment" précis

A reconstruction, in criminal language, means bringing back together all the elements and players in the case and putting them back into the circumstances of the crime or offence, allowing a complete view of the events. This is not possible on paper, where many of the details would not be clear enough. Thus a reconstruction allows the details to be revealed more clearly. Now, a first reconstruction has already been done last October with all the elements and the people present in Praia da Luz on May 3rd between 18.30 and 22.40. Only the principal players were not present. It was valuable. In fact, now the PJ has a clear view of what happened or rather of, "who did what," and above all, "where and at what time," precisely."

Perhaps the Public Prosecutor will be willing to allow the PJ to proceed with the case based on what was discovered during this previous reconstruction in October 2007. When the PJ state that the planned reconstruction with the principal, "players," Kate and Gerry and friends, would allow them to compare the points of view of witnesses and suspect, perhaps this is where the comparison would be made, between details gleaned from witnesses in the previous re-enactment, and that including the Tapas Nine.

So, what now? The McCanns are still official suspects in the enquiry and the PJ consider the reconstruction to be necessary. Four of those who were present on the evening of Madeleine's disappearance are unable to attend and participate in a reconstruction. You'd think the McCanns, who vowed to, "leave no stone unturned," in the search for their child, would be begging their friends to participate in anything which might have the remotest chance of helping to discover what had happened to that child. I don't think I'd be ready to accept, "Sorry, I can't make it," if this had been my child.

The McCanns were made arguidos and departed pretty sharpish on the next available plane, promising to returns when requested to do so by the PJ, the Tapas seven have stated that they would be willing to help in any way, yet none of them look as though they making any great shakes to get their asses over there to the Algarve. Public opinion turning against the McCanns? That seems to have happened quite some time ago and, in my opinion, the only way to restore some of that would be to book a flight to Portugal and to do their best to persuade their friends to accompany them. What could possibly be more important than participating in something which may help to resolve the disappearance of a very young child, however useless they might think it is?
