À l'alarme sociale logique que provoque un crime d'une cruauté semblable on ajoute le fait aggravant que le présumé assassin est un pédophile. L'indignation a été encore plus grande quand on a découvert les énormes erreurs judiciaires successives qui ont permis au pédophile de perpétrer le crime. The murder of Mari Luz is not a case of one more child murder. To the logical social alarm which is provoked by crimes of similar cruelty, is added the fact the aggravating fact that the alleged murderer is a paedophile. The outrage is even greater when the enormous police errors are discovered which allowed a paedophile to commit the crime. "The Mari Luz case," has highlighted the shortcomings of a deficient and obsolete police system.

La défense de l'accusé a fait appel devant l'"Audience Provinciale" (la plus haute instance judiciaire) de Séville et celle-ci a mis trois années à confirmer la sentence. "

Police negligence

Santiago del Valle Garcia, the killer of Mari Luz, had avoided the weight of justice for six years, by escaping from a prison sentence. As we know, in 1998 he sexually abused his daughter on many occasions. Rafael Tirado, a Seville judge, took four slow years to deem that the abuse had been proved and to sentence the paedophile to two years and nine months in prison. The accused's defence made an appeal to the First Provincial Court (the highest judicial authority) in Seville and that court took three years to confirm the sentence.

L'impunité de ses abus lui permettait de continuer à agir."

When the Seville Tribunal of Criminal Cases tried to contact the accused, in order to notify the judgment - an obligatory procedure in Spain, he was no longer living in the capital of Andalouse and not being registered as resident elsewhere, he was declared as address unknown. Ils ont défoncé la fine porte en aluminium derrière laquelle se cachait Del Valle, sa femme et sa sœur, et ont fouillé toute la maison. Malgré la tension du moment, le pédophile a maintenu son sang froid et son calme. Il a nié les soupçons de la famille Cortés et a demandé la protection de la Police. Tous les voisins du Torrejón connaissaient déjà les antécédents affligeants du pédophile, mais les agents ne lui auraient pas donné toute l'importance voulue ce jour là."

The slowness of the police

The first hours after Mari Luz's disappearance were frenetic for the family of the little girl. Not for the police. One of the brothers of the child's father, accompanied by other mates, burst into the home of the murderer on the same afternoon of that fateful January 13th. They forced the thin aluminium door behind which Del Valle, his wife and his sister were hiding, and they searched the house. In spite of the stress of the moment, the paedophile kept his composure and his calm. He denied the suspicions of the Corés family and asked the police for protection. All of the Torrejon locals already knew the paedophile's appalling history, but the police officers did not give this the importance due that day.

La Police a révisé à nouveau les alibis des seuls suspects jusqu'à présents et, après les avoir localisés à Pajaroncillo (Cuenca), ils ont décidé de les interroger à nouveau. En se voyant traquée, la femme de Santiago a démonté l'alibi de son mari. 72 jours étaient passés depuis la disparition de l'enfant."

On the morning of January 14th, when the police decided to take account od the Cortés' suspicions, Santiago and his wife had already fled to Seville. On January 17th he was located and was arrested in Granada, but a few hours later he was again at liberty for lack of proof. even though the hypothesis of a paedophile crime remained valid, the police were looking at a kidnapping for vengeance. So, they continued with their searches. When, on March 7th, the body of Mari Luz was found, events moved really fast. The police looked again at the alibis of the only suspects up to then and, after locating them at Pajaroncillo (Cuenca) they decided to interrogate them again. Seeing herself tracked down, Santiago's wife took apart her husband's alibi. 72 days had passed since the child's disappearance.

Shame and indignation

The detention of the alleged murderer gave a name and a face to a paedophile with a long history and brought to the public's attention the accumulation of absurdities which had allowed a recidivist criminal not to set foot in prison, not for a single day. The General Council of Judicial Power (CGPJ) has opened an enquiry on the past procedure of judges. Maria Teresa Fernandez de la Vega (Vice-President of the government) has admitted that the murder of Mari Luz was due to, "a grave judicial error," and the PP accused the government of the disorganisation of the police.

All eyes are on the judge who sentenced Santiago in 2002 and who never executed the sentence. Political responsibilities

After having buried the little Mari Luz, knowing the alleged murderer and seeing him arrive in Huelva, the Cortés family has had to face the worst of the ordeals: the death of Mari Luz could have been avoided. Mari Luz's family has demanded a whole life sentence for the child's killer and, even though the government has shown itself to be against a measure which, "clashes with the constitution," has not rejected adopting other measures such as the creation of a register of paedophiles which would allow their control.

Gerry and Kate always stated that they were ready to stay in Portugal while Madeleine was not found, but the fact that they were constituted arguidos in September provoked their departure to the UK, a country where they had shelter from possible PJ proceedings.

According to the McCanns' spokesperson, the attitude of the Portuguese inspectors during the interrogation of friends of the couple is going to help them to take the decision to return to the country of Portugal.

Fourniret: the ordeal of the first victim

According to the statements contained in the indictment, on December 11th 1987, Monique Olivier persuaded the 17 year-old school girl to get into the couple's van. Further along, Fourniret was waiting at the edge of the road, pretending lack of fuel. He got in too. The young girl was raped and then strangled by Fourniret, according to the statements which he made during his questioning. The young girl's body was not found until 2006, at the bottom of a well, on the instructions of the accused.

Pour l'avocat de la famille Laville, ce premier crime est clairement "l'acte rituel du pacte satanique" conclu entre les époux, au terme duquel Monique Olivier aurait accepté de l'aider à "chasser" des filles vierges en échange de son engagement à tuer un ex-mari. Isabelle Laville aurait été soigneusement choisie "pour sa ressemblance, pour reconstituer la défloration de Monique Olivier", avait expliqué hier la policière belge Catherine Beauret.

A l'audience, le père de la victime s'en est pris aux magistrats du parquet d'Auxerre qui avaient classé le dossier au bout d'une semaine d'enquête. "Ma fille, ce n'était pas un chien égaré sur la route. Peut-être que si ce chien avait appartenu à la bourgeoisie d'Auxerre, on aurait fait des recherches. Mais pour ma fille, on a classé sans suite (...) Depuis ce jour-là, j'ai un sentiment de haine envers cette justice-là," a martelé Jean-Pierre Laville."

The, "hunt," for young virgins.

The purpose of the interrogations on British soil of several witnesses, known in the McCann case as the, "tapas 7," would be seriously compromised by the divulging of the contents of the rogatory letters and part of the English version of the file.

The information is put forward by a source at the Leicestershire Constabulary and confirmed by a copy of the document to which SOS Madeleine has been able to have access. According to the same source, the contents of the rogatory letters and part of the file were copied and sent to a former police officer, presently in the private sector, close to one of the witnesses and interested in the progress of the investigations.

After a few months of waiting, put to good use by the witnesses to prepare for the next interrogations, the PJ is supposed to travel to the UK during the month of April to continue their enquiry into Madeleine McCann's disappearance.

Association Estelle

On January 9th 2003, at around 18.00, Estelle Mouzin, a little girl aged 9, disappeared in Guermantes, in Seine-et-Marne, on her way home from school. Since that date there has been no news of her. The, "Association Estelle," was created to provide support to her parents and to enable her to find her family and her freedom.

So many missing children. Little Estelle was just walking home from school, something that nine year-old children do every day during school terms, all over the world. Nine years of age is too grown-up to have mummy or daddy hold a hand on the way home; a nine year-old wants to walk home by herself. Those of us who have had children will know this.

I am trying to imagine what it must be like to wave goodbye in the morning as your child goes off to school, then to wait for her to come home when she should....and to wait...and wait....and wait...and the child does not come. I know that sense of relief when a child comes home, 20 minutes later than usual, saying she stopped at the shop, or she played a game with a friend. What must it be like when that relief does not come? When the child does not come home? I can only begin to imagine the fear and the terrible anxiety and my heart goes out to the family of Estelle Mouzin and all other families, who do not know what has happened to a child who has gone missing.

Belgium re-opens the case

The Belgian police has re-opened an enquiry to re-examine the incriminating trail of the alleged serial killer, Michel Fourniret, in the case of the disappearance of Estelle Mouzin in Guermantes (Seine-et-Marne) on January 9th 2003.

According to the daily newspaper, Le Soir, Dinant's public prosecutor is going to review the circumstances of the telephone call made at the time of that disappearance from Fourniret's Belgian home, which exonerates him in the eyes of the French police. He had been under suspicion after his arrest in 2003 because he owns a white van like the one which was reported near the scene of Estelle Mouzin's disappearance. A press photo of the little girl was found on his computer,

"Michel Fourniret nie toute implication dans ces faits et la police française l'a mis hors de cause, car un appel au fils de Fourniret, Christian, qui fêtait le 9 janvier 2003 son anniversaire, a été passé peu après 20h00 le jour de la disparition d'Estelle Mouzin, du domicile que les Fourniret avaient alors en Belgique, à Sart-Custinne. La fillette ayant disparu vers 18h00, la police française juge que Fourniret ne pouvait être présent à ce moment à Guermantes, éloignée de 276 km de Sart-Custinne. Pourtant, le fils de Michel Fourniret ne se souvient pas de l'appel et ne peut donc dire qui l'a passé. Les enquêteurs belges souhaitent donc s'assurer que le tueur en série présumé n'a pas utilisé un stratagème pour se construire un alibi."

Michel Fourniret denies all involvement in these events and the French police has ruled him out of the picture, because a call to Fourniret's son, Christian, celebrating his birthday on 9th January, was made a little after 20.00 on the day of Estelle Mouzin's disappearance, from the home which the Fournirets had at that time in Belgium, in Sart-Custinne. The little girl having disappeared around 18.00, the French police considers that Fourniret could not have been in Guernantes, 276km distant from Sart-Custinne, at that time. However, Michel Fourniret's son has no recollection of the call and therefore cannot say that it happened. The Belgian investigators wish to ensure that the alleged serial killer has not used a ploy to construct an alibi for himself.

Such a hypothesis is rejected by the public prosecutor of Meaux (Seine-et-Marne)

The investigating judge in charge of information relating to Estelle Mouzin's abduction has led, with the Belgian authorities, "various investigations to do with the possibility of the telephone call being diverted," recorded as having been made from Michel Fourniret's home, René Pech the public prosecutor of the city, wrote in a press release. "In the current state of the investigations into how it was carried out, these have not led the police to be able to substantiate the existence of such call-forwarding," he said. The Estelle Mouzin case has gone to the top of the state, the president Nicolas Sarkozy, having promised the parents that every effort would be made to shed light. Hundreds of interrogations and full-scale investigations have not allowed the police to find the smallest lead in this case. Last February, in this operation, they partially destroyed a Chinese restaurant on the outskirts of Guermantes in the search for the body of a young girl, which an unfounded rumour said was buried on the premises. Kate and Gerry McCann deserve better than this!

Comments on this blog are monitored because there have been a few really sick and abusive ones posted. The one I am copying below was posted yesterday, Monday March 31st at 1.53pm GMT. It appears to be a comment in support of Kate and Gerry McCann, though I'm not sure if it is even that.

This comment was contributed to a post about the married couple having been arrested in connection with the death of Mari Luz and has absolutely no relevance to that subject. So, for a start, it is so disrespectful to the tragedy of that little girl's fate and to that child's family.

Anonymous appears to be angry about what is said on the 3Arguidos forum about the Madeleine McCann case and I assume the comment is meant as a supportive one for Madeleine's parents. Well, I am not in a position to say what the McCanns are guilty of. I am of the opinion that they should not have left their children alone. Apart from the established fact that the children were on their own, I have no way of knowing what other evidence there is in the hands of the Portuguese police and therefore I have no right to make any kind of accusation.

What I do know is that Kate and Gerry McCann are intelligent and well-educated people. If this is the kind of person they have as supporters, then I feel very sorry for them. As educated and intelligent people, they deserve a much better class of people on their side.

Whole life sentence.

The only comfort for Juan José Cortès at this moment, is to ensure that his daughter's murderers pay for what they have done. "That justice is done." When he is asked what would be a fair sentence, he responds quickly: "That my daughter is given back to me, that would be justice! But as that is not possible, then that they never come out of prison!"Mari Luz's father is very clear, he wants the debate on whole life sentence to be re-opened in Spain. He does not understand those who oppose it and states that: "If a man takes away the life of my daughter and he takes mine away for ever, he should pay for ever. This is a preventative solution and not a punishment. There are people who cannot live in society because they could commit the same crime again. Who is to say that if this man comes out of prison in 20 years, he is not going to commit the same crime again?

Remember that Santiago del Valle has committed a whole series of abuse against children, from Seville to Huelva, through Gijon, all while each time fooling the police.

Sa sœur Rosa del Valle a raconté au juge que l'après-midi des faits Santiago lui a demandé de l'amener à Carrefour pour faire des courses et c'est ce qu'elle a fait. Elle l'y a amené, son frère n'ayant pas de permis de conduire. Le centre commercial était fermé, selon sa version, et elle l'a amené un peu plus loin dans une autre zone commerciale qui était ouverte et l'y avait laissé. La Police a des informations qui contredisent ce témoignage et le juge les a considéré comme étant valables. La dernière personne qui a vu Mari Luz en vie, l'a vu autour des 16h40 arrêté devant la maison de Del Valle."

The police accused of having tortured the defendant.

Santiago del Valle testified that the police had tortured him to obtain his confessions. It was for these reasons that he later retracted even to the point of denying that he had been in the company of Mari Luz on the afternoon of January 13th. His sister, Rosa del Valle told the judge that on the afternoon in question Santiago had asked her to take him to Carrefour to run some errands and that is what she did. She took him there, her brother not having a driving licence. The retail centre was closed according to her version, and she took him a bit further to another retail zone which was open and left him there. The police has information which contradicts this witness statement and the judge has deemed it as being valid. The last person to see Mari Luz alive, saw her around 16.40, stopped in front of Del Valle's house.

"La reconstitution des faits indique que Rosa a conduit son frère, avec le cadavre de Mari Luz dans le coffre de sa voiture, jusqu'à la ria et là elle a attendu tandis qu'il jetait le corps à l'eau. Ils sont ensuite retournés ensemble dans la maison de Torrejón. Santiago avait juste eu le temps pour récupérer sa femme, Isabel García et quitter tous les deux précipitamment la ville. Rappelons que les trois étaient présent dans la maison quand Santiago a attiré l'enfant en lui promettant un jouet dans le but de l'agresser sexuellement!"

The reconstruction of events indicates that Rosa drove her brother with the body of Mari Luz in the boot of her car, as far as the estuary and she waited there while he threw the body into the water. They then returned together to the house in Torrejon. Santiago had just had the time to pick up his wife, Isabel Garcia and for the two of them to hastily leave the town. Remember that the three of them were in the house when Santiago brought the child in, promising a game, for the purpose of sexual abuse.

Bien que son degré de participation n'ait pas filtré, elle pourrait être considérée comme co-auteur du meurtre si elle a participé de façon active à la séquestration et/ou à l'enlèvement; ou comme complice de meurtre par son silence."

In fact, towards 18.30, before the police arrived on the scene, a group of relatives of the Cortés family had already burst into the house by force and had taken away documents and other property. At that time, the couple had already fled. After Rosa del Valle's statement, the judge signed an arrest warrent for murder, as stipulated in the detention order at the prison. Even though her degree of participation has not been leaked, she could be considered as co-perpetrator of the murder if she participated in an active way in the illegal confinement and/or the abduction; or as complicit in the murder by her silence.

"Santiago del Valle, après avoir tout nié et accusé la police de sévices, a demandé à être de nouveau entendu, peut-être sachant déjà quelle était la décision du juge en ce qui concerne sa soeur. Dans cette seconde déclaration il a baissé les bras et a admis à nouveau, devant les preuves dévoilées, les faits qu'il avait déjà reconnus et signés à Cuenca. Il a appelé l'enfant quand il l'a vue seule parce qu'elle lui plaisait, mais elle est tombé dans les escaliers et est morte de manière accidentelle : il est ensuite allé se débarrasser du cadavre en le jetant à la ria."

Santiago del Valle, after having denied everything and accused the police of abuse, asked to be heard again, perhaps knowing already what the judge's decision was concerning his sister. In this second statement, he gave up and again admitted, in view of the evidence revealed, the the facts that he had already accepted and signed in Cuenca. He called the child when he saw her alone because he liked her, but she fell down the stairs and died accidentally: he then went to get rid of the body by throwing it into the estuary.

"Malgré que les rapports légistes ne soient pas concluants sur la façon dont est mort l'enfant étant donné le mauvais état du cadavre de Mari Luz,la juge n'a pas eu de doutes et a considéré le détenu comme auteur d'un meurtre et d'agression sexuelle. Elle a décernée un mandant, comme dans le cas de sa soeur. Tous les deux ont été admis à la prison de Huelva. Dans la série des absurdités de cette affaire, la prison a reçu maintenant l'ordre d'admission de Santiago del Valle pour abus sur sa fille de cinq ans - soit deux ans et neuf mois de détention - qui aurait dû être accompli depuis mars 2006!!! Sa femme, Isabel García a été admise dans la section psychiatrique de la prison de Séville pour y accomplir 15 mois pour complicité dans le cadre des abus commis par son mari sur leur enfant. Elle devait aussi être internée il y a deux ans!!!"

Although the forensic reports are not conclusive about how the child died, given the bad state of the body of Mari Luz, the judge had no doubts and considered the person detained as perpetrator of a murder and sexual assault. She issued a warrant , as in the case of his sister. Both were remanded to the prison in Huelva. In the string of absurdities in this case, the prison has now received Santiago del Valle's admission order for the abuse of his five year-old daughter - two years and nine months detention - which should have been served from March 2006!!! His wife, Isabel Garcia has been admitted to the psychiatric section of Seville prison to serve 15 months for complicity in the context of the abuse committed by her husband on their child. She should also have been imprisoned two years ago.

On Monday morning, Michel Fourniret went, without coercion, to the hearing at the Ardennes Court of Assizes in Charleville-Mézières, where, since Thursday, he is being tried for seven murders, after having been brought by force on Friday when he wanted to boycott his trial. On Monday, the third day of the trial, Michel Fourniret stated that he, "confirmed (his) position," only to speak on the allegations on condition that the proceedings were held in camera. "This weekend, the careful thinking which I went through, has led me to confirm my position," stated Michel Fourniret, who had been invited to speak on the first of ten cases for which he is being tried, that of the sexual assault of a 13 year-old Belgian teenager in June 2003 near Namur. "A un carrefour, j'ai vu une jeune fille au milieu de la route qui faisait de grands signes", a dit Mme Janton qui, pensant à un accident, s'est arrêtée. "Elle m'a dit: 'Je viens d'être kidnappée à Ciney'", a-t-elle poursuivi, précisant que Marie était "apeurée, un peu perdue" et présentait des écorchures au poignet. L'automobiliste et Marie croiseront le véhicule de Fourniret qui avait fait demi-tour après la fuite de Marie. Le relevé du numéro de plaque permettra son interpellation."

Stéphanie Janton, the motorist who took charge of Marie, who was abducted in Ciney on June 26th 2003 by Michel Fourniret, retraced the journey, which led to Fourniret's arrest before the Ardennes Court of Assizes on Monday.
13 year-old Marie had managed to flee from Michel Fourniret's van where she had been tied up and placed herself in the middle of the road. "At a crossroads, I saw a young girl in the middle of the road, making huge signals," said Mme Janton who stopped, thinking there had been an accident. "She told me:'I have just been kidnapped in Ciney," she continued, noting that Marie was, "frightened, a little lost," and showed abrasions to the wrist. The motorist and Marie cross Fourniret's vehicle, which had done a U-turn after Marie's escape. Recording the registration number will allow his questioning.

"Nouvelle victime: Une infirmière* !" Dans son document remis jeudi au président de la cour d'assises des Ardennes, Michel Fourniret avouait "une tentative d'homicide sur la personne d'un professionnel de la santé", évoquant ainsi l'enlèvement avorté d'une infirmière en 1994, sur le parking de l'hôpital de l'AZ-VUB à Jette, rapporte lundi le quotidien Le Soir. Michel Fourniret précise ne jamais avoir été entendu sur cette tentative d'homicide. Cette affaire mise à l'instruction à Dinant du chef de "tentative d'enlèvement", n'avait à ce jour, jamais débouché sur une inculpation, malgré des aveux de Monique Olivier. L'aveu écrit de Fourniret ravive ce dossier, commente Le Soir. "Le juge d'instruction Hanin sera avisé dès ce lundi des propos de M. Fourniret, dont nous n'avons pas encore reçu la signification officielle de la part des autorités judiciaires françaises", a précisé le premier substitut Philippe Morandini, en charge du dossier. "Il est évident que si M. Fourniret apporte des éléments nouveaux à un dossier jusqu'ici qualifié de tentative d'enlèvement, et non d'assassinat, il devra être interrogé sur ses affirmations et encourir, s'il échet, une inculpation dont il devra répondre devant les institutions belges", poursuit Philippe Morandini."

New victim: A nurse!

On Monday the daily newspaper, Le Soir, reports that in his document, handed to the president of the Ardennes Court of Assizes on Thursday, Michel Fourniret confessed to, "an attempted murder of a health professional," confessing also to the aborted abduction of a nurse in 1994, in the parking area of the AZ-VUB hospital in Jette.

Michel Fourniret notes never having heard of this attempted murder. This case, as told to the head of ,"attempted abduction," in Dinant, has not, to this day, resulted in an indictment, in spite of Monique Olivier's confession. Fourniret's written confession revives this case, comments Le Soir. "The investigating judge, Hanin, will be advised on Monday of M. Fourniret's words, of which we have not yet received official notification from the French legal authorities." said Philippe Morandini, acting head in charge of the case. "Obviously, if M. Fourniret brings new information to a case, so far qualified as an attempted abduction, and not murder, he would be questioned about his claims, and if relevant, would incur a charge which he would answer to before the Belgian authorities." continued Philippe Morandini.

• Isabelle Laville, 17 ans, disparue le 11 décembre 1987 à son retour de l'école à Auxerre. A l'époque Fourniret vient de s'installer avec Monique Olivier à Saint-Cyr-les-Colons (Yonne). Des restes du corps et des effets personnels sont retrouvés au fond d'un puits à Bussy-en-Othe (Yonne) en juillet 2006.

Isabelle Laville, aged 17, disappeared on December 11th 1987 on her way home from school. At that time, Fourniret had just moved in with Monique Olivier in Saint-Cyr-les-Colons (Yonne). The remains of her body and her personal effects were found at the bottom of a well in Bussy-en-Othe (Yonne) in July 2006.

• Fabienne Leroy, 20 ans, disparue le 3 août 1988 dans la Marne. Son corps ensanglanté est découvert le lendemain à proximité du camp militaire de Mourmelon-le-Grand. Après le viol, elle a été tuée d'une balle tirée à bout portant en pleine poitrine.

• Jeanne-Marie Desramault, 21 ans, disparue le 18 mars 1989 à la gare de Charleville-Mézières. Son corps est retrouvé le 3 juillet 2004 au château du Sautou à Donchéry (Ardennes), ex-propriété des époux Fourniret. Monique Olivier est poursuivie comme coauteur du meurtre qui a été précédé d'une tentative de viol.

Jeanne-Marie Desramault, aged 21, disappeared on March 18th 1989 at the station in Charleville-Mézières. Her body was found on July 3rd 2004 at the Chateau du Satou in Donchéry (Ardennes), a former property of the Fourniret couple. Monique Olivier is charged with being co-perpetrator of the murder which was preceded by attempted rape.

• Elisabeth Brichet, adolescente belge de 12 ans, enlevée le 20 décembre 1989 près de Namur. Son corps est retrouvé au château du Sautou le 3 juillet 2004, là encore sur les indications de Michel Fourniret après les dénonciations de son épouse.

• Mananya Thumpong, 13 ans, enlevée le 5 mai 2001 à sa sortie de la médiathèque de Sedan (Ardennes). Le corps est retrouvé le 1er mars 2002 à Nollevaux (Belgique). Comme pour l'assassinat de Céline Saison, aucune complicité n'est reprochée à Monique Olivier.
