Enfants Kidnappés: an Irish witness saw Gerry carrying Maddie.


Martin Smith, from Ireland, was on holiday in Praia da Luz at the same time as the McCanns. This week it has been reported in the Portuguese press that Mr Smith saw a man carrying a child, whom he thought was Madeleine, and that only when he returned to Ireland and saw Gerry's image on TV, did he think that the man he had seen was Gerry.

An Irish witness saw Gerry carrying Maddie

Irishman Martin Smith told the PJ that he had seen a man carrying a child under his arm. To him, that child seemed to be Maddie. The events would have taken place round about dinner time on the evening of May 3rd. The hearing of the witness was recorded early on in the research. A few days after returning to his country of origin, Martin Smith went to the police. Following the media coverage of the case, he guaranteed that he had no doubts when he saw Gerry's face on television for the first time, as he was leaving a plane. The man who was carrying the child on the day that Maddie disappeared was her father!


The information was sent to the Portuguese authorities at a time when the PJ were still concentrating on the abduction theory. And, according to the final report, the lead would not have been followed because at the time when Martin stated having seen Gerry carrying Maddie under his arm, the latter was having dinner with friends of the couple at the Tapas Bar. It was only later that the PJ realised that no one amongst the T9 could say at exactly what time each member of the group was to be found at the restaurant. The PJ then requested additional investigation of this witness via the rogatory letters. The additional tasks concerning this witness were finally not carried out and without other details could not be examined more thoroughly.

The British police hand over certain details of the investigation to the McCanns.

On Monday, the British police agreed to hand over to Madeleine McCann's parents, certain details of their file on the little girl's disappearance in the south of Portugal in May 2007, to enable private investigators whom they had engaged to assess them. In return, Kate and Gerry McCann withdrew from a legal procedure designed to force the police of Leicestershire, the central England county where they live, to let them have that information. "Kate and Gerry are satisfied with this compromise reached with the police," Clarence Mitchell, their spokesman, stated. "If we had not gone to court, we would not have obtained these 81 pieces (of information) The whole file would contain nearly 11,000 documents. They are now going to our private investigators who will work with them as a priority."


It remains difficult to believe that these documents will be useful to Metodo 3 in the sole objective of finding Madeleine. It seems difficult that this company, with a doubtful reputation and dubious legal methods, could do better than the PJ who have placed more than 300 men on the case. It remains to know if these 81 documents and hearings also contain the witness statements of the two crucial witnesses of whom the hearings have still not been sent to the Portuguese authorities? If such is the case, this looks more like a manoeuvre for preparing a defence than searching for a missing little girl.

Metodo 3 called into question by the PJ.

The final report criticises the, "research," done by the private detective agency hired by the couple. It was because of them that the PJ lost enormous amounts of time, money and energy in following, checking, assessing, analysing every, "false," lead put forward by Metodo 3, all over the place. There was Gail Cooper's witness statement, heard for the first time by the British authorities. She spoke of a beggar, whom she had only seen once and who could have taken the child. Later at the agency of the private detectives hired by the couple, she stated that she had seen the same beggar three times. And that on one of these three times, he had surprised her by looking at the group of children that Madeleine was part of, in a, "strange," way.


Then it was the turn of Jane Tanner who had not succeeded, initially, in describing the face of the man whom she asserted she had seen carrying Maddie in his arms, to go back on her statements. She stated that the man seen by Gail Cooper resembled the one she saw. The photo-fit went round the world and forced the PJ to check hundreds of leads which turned out to be false. Without taking into account that the PJ have had to take themselves to the farthest flung places on the planet. On the same day, at the same time, Maddie happened to be seen at places more than 4,000 kilometers apart! The report leaves to be implied that if someone had wanted to slow down the investigation, to prevent its being successful, this was as good a way as any.

The British modified the results of the tests.

This was the strangest about-turn of the investigation. The first analyses of the biological samples, carried out in the UK, on residues collected under the spare wheel, in the boot of the car rented by the parents, were compatible with Madeleine's genetic profile. Later, after the parents were designated as, "arguidos," or suspected of having concealed Madeleine's body, the laboratory announced the correction of their initial analyses. Afterward, the biological traces found in the Renault Scenic rented by the parents were not conclusive. In addition, even the quality of the samples was suddenly placed in doubt. This scientific reversal, not yet completely clarified, risks taking the investigation to a dead end. In effect the doubt always benefits the accused.

If one of the most important testing laboratories suddenly places samples themselves in doubt, that will be wholly beneficial for the defence. Note, however, that the use of dogs for detecting cadaver odours and traces of blood, is quite valid in the Portuguese legal system and the laboratory would have to scientifically corroberate the indications of the dogs. The PJ's decision to send the analyses to the UK, when they could have been done in Portugal, was initially a question of credibility.The inspectors did not want the results to be called into question in the UK.

At a sitting of the Family Division of the High Court in London yesterday, Judge Hogg ratified the agreement reached between the McCanns and Leicestershire police for the handing over of 81 pieces of information, gathered within the context of the investigation into Madeleine McCann's disappearance in May 2007, in Praia da Luz. Britanniques délivrent documents confidentiels aux McCann sans l’accord des enquêteurs

L’information a d’ailleurs été confirmée par la Direction nationale de la PJ que garant n’avoir jamais eu le moindre contact à ce sujet avec la police britannique et que, par cette même raison, ne connait pas quels sont les 81 documents que seront remis à la famille McCann.

According to an official in Portugal, the PJ did not have prior contact with the English authorities giving their agreement for the McCann couple to have access to documents relating to the investigation into their daughter Madeleine's disappearance. Meantime, the information was confirmed by the National Directorate of the PJ who guarantee never having had the least contact on this matter with the British police and who, for that same reason, do not know what the 81 documents are which will be handed over to the McCann family.

Tim Scott, the lawyer representing Kate and Gerry McCann, appeared this morning before the Family Division of High Court in London, where Judeg Hogg would have had to rule on the request from the McCanns, who wanted to have access to documents concerning the PJ case file on Madeleine's disappearance. Documents in the possession of the Leicestershire police, covered by secrecy of justice and by the rules of international co-operation between the two countries.

L’objectif initial de la démarche des McCann auprès de la Cour Suprême était, du moins officiellement, de forcer la police de Leicestershire à révéler 11.000 informations et documents appartenant à l’enquête concernant la disparition de Madeleine, en partie transmis par les autorités portugaises ou en provenance du public.

The initial objective of the McCanns' taking action in the High Court was, at aleast officially, to force the Leicestershire police to disclose 11,000 pieces of information and documents, appertaining to the investigation concerning Madeleine's disappearance, sent by the Portuguese authorities or coming from the public.

Selon Clarence Mitchell, porte-parole et responsable en communication du couple, les documents en question concernent des témoignages apparus les jours qui ont suivi la disparition de Madeleine et seront maintenant exploités par les différents détectives privés au service de Kate et Gerry McCann.

Pendant que le Ministère public “apprécie” le rapport de la Police judiciaire, visant à déterminer si d’autres diligences sont nécessaires ou possibles, le Procureur général de la République (PGR) doit encore se prononcer à propos de l’accord retrouvé entre la police du Leicestershire et les McCann.

While the Public Minister, "assesses," the PJ's report, looking to determine if other work is necessary or possible, the Attorney General of the Republic (PGR) has yet to give his opinion on the agreement made between the Leicestershire police and the McCanns.

Loin de l’habituelle froideur et impartialité typique des magistrats britanniques, la Juge Hogg a confirmé avoir excusé les McCann d'assister à l'audition, car, selon elle, “ils ont souffert assez et j'ai souhaité soulager leur fardeau”.

La Juge, assez proche des milieux politiques, a également envoyé un message au responsable pour la disparition de Madeleine : “Je supplie cette personne, qui quelle est, pour qu’elle montre miséricorde et compassion et qui apparaisse maintenant et nous dise où ont peut retrouver Madeleine. J'attends qu'elle soit trouvée brièvement, vivent et sain ”, a déclaré.

Far from the usual coldness and impartiality typical of British magistrates, Judge Hogg confirmed having excused the mcCanns from attending the hearing, because, according to her, "they have suffered enoug and I wanted to relieve their burden."

The Judge, who is close to political circles, also sent a message to those responsible for Madeleine's disappearance: "I entreat that person, whoever they may be, to show mercy and compassion and come forward now and tell us where we can find Madeleine. I hope that she will soon be found, safe and well," she stated. (Addendum part 2)

Several British police officers, contacted on the spot by SMM, admitted to being surprised by the agreement reached and still more by the behaviour, "unusually different," of Judge Hogg: "She should not ignore that, even today, the parents are officially suspects in Portugal and that they have not made the slightest effort to help the progress of the investigation," an official from the Enderby police stated.

Addendum part 1

Judgment of Justice Hogg:Madeleine went missing on 3/5/07 a few days before her 4th birthday while on holiday in the Algarve. On 17/5, Madeleine parents invoked the jurisdiction of this Court under the Children and Custody Act and the Hague Convention.

They sought various Orders and Directions to assist in ascertaining her whereabouts. Madeleine became a ward of court. It is not known if she is alive, but there is no evidence to the contrary. She is a British citizen and habitually resident in the UK. The Court made an order on 2/4 against the Chief Constable to assist in providing information. Such is the complexity of the issues in relation to other investigations, that other parties were invited and joined. The parents reached an accommodation.

The Chief Constable will provide contact details for people who contacted the parents’ solicitors. The parents do not wish to pursue other applications and withdraw their application. I have no criticism of the parents who have behaved responsibly and reasonably.

The parents should be allowed to withdraw their application. An Order is made by Consent. The terms of Orders made on 2/5/07** shall not apply to the Chief Constable nor any other agency. All evidence submitted to the court shall remain confidential, save the Chief Constable may at his discretion release the Case Summary and Skeleton Argument. Any other document is not to be disclosed or published save in accordance with other Orders.

It may be noted neither parent is present. I agreed last week with this provided their legal teams were fully instructed. My belief is that they have suffered enough and I wish to ease their burden. I know that agencies here in Portugal will continue to strive to find Madeleine. I urge anyone with any information to come forward. There is at least one person who knows what happened. I ponder whether that person has a heart and to consider what it is like for Madeline to be secreted from her siblings. Whether than person has a conscience, remorse or cares about hurt caused to an innocent child; whether he has faith and what justification he will give to his God. I entreat that person to show mercy and compassion and to tell us where Madeleine is. I hope she will be found very soon alive and well. I confirm the wardship will continue. Madeleine McCann: the theory of abduction is impossible. (Enfants Kidnappés 6/07/08)


Suddenly, after a quiet period for news, there is a burst of activity in the mainstream media and on blogs, about the McCann case. This past week has seen the retirement of Gonçalo Amaral, former lead investigator in the McCann case, his interview, and now the awaited hearing before the High Court in London, where the McCanns will ask Judge Hogg to order the Leicestershire police to grant them access to information about the case, held by that police force. There is, of course, also the conclusion of the enquiry into Madeleine's disappearance and the handing over of the case files to the Public Prosecutor, who must now make a decision about any further steps to be taken or the archiving of the case.

Les parents risquent jusqu'à 5 ans de prison. Le principe de négligence envers enfants auquel les McCann, dans la nuit du 03 mai 2007, dans un appartement de Praia Da Luz, est, selon la loi portugaise, un fait incontournable qui ressort dans plus de 50 pages du rapport final de la PJ. Les recherches se sont axées autour de la thèse d'un homicide et le Ministère Public qui doit se focaliser sur cette thèse, ne peut ignorer, aux yeux de la loi portugaise, la négligence des parents McCann lors de cette nuit. La PJ s'abstient dans ce rapport de faire au procureur en charge du dossier la moindre proposition de classer l'affaire ou de poursuivre les parents. De même, la PJ ne fait aucune considération sur l'évidente négligence ou imprudence des parents et ils ne se perdent pas non plus dans l'aspect juridique face à cette situation.

The parents risk up to 5 years in prison. The principle of the McCanns' negligence towards children, on the night of May 3rd 2007, in an apartment in Praia da Luz, is, according to Portuguese law, a fact that cannot be ignored, which emerges in more than 50 pages of the PJ's final report. The research is focused around the theory of murder and the Public Minister who must who must focus on this theory, cannot ignore, in the eyes of Portuguese law, the parents' negligence on that night. In this report to the prosecutor in charge of the case, the PJ do not make the least suggestion for the closing of the case or for prosecuting the parents. Similarly, the PJ do not scrutinise the obvious neglect or carelessness of the parents and they do not get bogged down in the legal aspect in dealing with this situation.

L'objectif poursuivi par la police était de prouver un homicide et l'occultation de cadavre. Donc le classement sans suite du dossier ne peut pas se faire. La loi portugaise ne permet pas qu'on oublie l'imprudence des parents: l'abandon d'enfants dans un appartement fenêtres ouvertes, porte fermée seulement avec un verrou; un contact visuel sur le logement que les parents ont prétendu avoir et qu'ils n'avaient, en réalité, pas; ou encore les contradictions au sein des amis du couple quant aux visites faites aux enfants ! Il s'agit de faits d'abandon d'enfants ou plutôt de négligence envers enfants, puni jusqu'à 5 ans de prison !!

The objective followed by the police was to prove murder and concealment of a corpse. So, the dropping of the case cannot be done. Portuguese law does not allow the carelessness of the parents to be forgotten: the abandoning of children in an apartment with open windows, door closed only with a bolt; visual contact with the accommodation, which the parents claimed to have and which, in reality, they did not; or the contradictions on the part of the couple's friends about visits made to the children. It is a question of the abandonment of children or rather negligence towards children, punishable by up to 5 years in prison!!

La thèse de l'enlèvement est impossible. Le rapport de la PJ exclut l'hypothèse de l'enlèvement, contrariant ainsi la version des parents, Kate et Gerry. En effet, la fenêtre de l'appartement loué par l couple McCann était trop petite pour y faire transporter un enfant. En outre, malgré que des chiens spécialisés aient détectés des vestiges de sang dans la maison ainsi que dans la voiture, louée par les parents de Madeleine et que les vêtements de Kate ainsi que certains vêtements de Madeleine portaient l'odeur de cadavre, la fenêtre, elle, ne contenait aucun vestige d'ADN de Madeleine mais uniquement de Kate. En outre, la loi portugaise punit "toute personne qui ouvre les conditions d'un enlèvement".

The theory of abduction is impossible. The PJ's report excludes the idea of abduction, thus clashing with the version of the parents, Kate and Gerry. In fact, the window of the apartment rented by the McCann couple was too small to carry a child through there. In addition, in spite of the specialised dogs having detected traces of blood in the house as well as in the car rented by Madeleine's parents and that Kate's clothes as well as certain of Madeleine's clothes carried the cadaver odour, the window did not show any trace of Madeleine's DNA but only Kate's. Furthermore, Portuguese law punishes, "all people who leave open the conditions for an abduction."

Ce qui signifie que la création du danger est punie, indépendamment d'en connaître le résultat. Or dans le cas qui nous occupent, le résultat serait l'éventuel enlèvement de Madeleine comme le prétendent les parents et, se sont eux-mêmes qui créent les conditions objectives à l'enlèvement! Laisser trois enfants seuls, dans un appartement dans un pays étranger, s'en aller dîner sans avoir de contact direct sur les enfants est, selon la loi portugaise, les conditions qui ouvrent les conditions à un enlèvement. Et nous ne parlons même pas des nombreuses contradictions quant aux nombres de visites faites aux enfants ni par qui, sans compter que ce n'était pas la première nuit que les enfants étaient seuls.

This means that creating danger is punished, independently of knowing the result. Or in the case which we are concerned with, the result was to be Madeleine's abduction as the parents claim and, it was they themselves who created the conditions for the abduction! Leaving three children alone, in an apartment in a foreign country, going out to dinner without having direct contact with the children is, according to Portuguese law, conditions which open the way for an abduction. And we are not even talking about the numerous contradictions about the number of visits made to the children nor by whom, not to mention that this was not the first night that the children were alone.

MISE A JOUR:

Les affirmations des différents "amis" des McCann ne sont pas cohérentes. Selon les déclarations du célèbre "Tapas9", Madeleine aurait été enlevée environ une heure avant que l'alerte de sa disparition ne soit donnée. C'est Jane Tanner qui garantit avoir surpris un inconnu dans une rue où, pour info, se trouvait le papa de Maddie, Gerry mais aussi d'autres témoins. Ces deux autres témoins ont affirmés n'avoir rien vu tout en étant dans le même angle de vision que Jane Tanner. Tanner qui plus tard fit un portrait-robot du présumé ravisseur en précisant que l'homme portait un enfant en position horizontale (sous le bras). Nous avons expliqué, plus haut, que Madeleine n'aurait pas pu passer par la fenêtre en position horizontale. La seule possibilité aurait été de la faire passer en position verticale... c'est-à-dire en la faisant passer la tête ou les pieds d'abord puis en la laissant glisser le long de la fenêtre mais aussi le long du mur de l'appartement. Dans cette hypothèse, il aurait fallut un complice qui "rattrape" l'enfant en bas du mur. Puis le ravisseur se trouvant dans l'appartement aurait du sortir, rejoindre son complice, récupérer Maddie puis s'enfuir en se séparant puisque Tanner n'a vu qu'un seul suspect.

Udate:

The assertions of various, "friends," of the McCanns are not consistent. According to the statements of the famous, "Tapas 9", Madeleine would have been abducted around an hour before the alert of her disappearance was given. It was Jane Tanner who guaranteed that she surprised a stranger in the road where, we know, was not only Maddie's father, Gerry, but also other witnesses. These two other witnesses have asserted having seen nothing while having the same angle of vision as Jane Tanner. Tanner, who later made a photo-fit picture of the alleged abductor, being clear that the man was carrying a child in a horizontal position (under one arm) We have explained above that Madeleine could not have been taken through the window in a horizontal position. The only possibility would have been to take her through in a vertical position. ..that is to say in passing her head first or feet first then letting her slide along the window but also along the wall of the apartment. In this hypothesis, there would have to have been an accomplice who, "caught," the child at the foot of the wall. Then the abductor finding himself in the apartment would have to get out, rejoin his accomplice, take Madeleine back, then flee separately since Tanner only saw one suspect.


Ou alors, le ravisseur était seul et il laissa glisser Maddie le long du mur jusqu'au moment où elle tomba sur le sol pour la laisser seule le temps de sortir à son tour pour la récupérer. Seulement ces scénarii ne tiennent pas la route au vu des déclarations de chacun. En effet, se référant au "timing" des uns et des autres, selon les déclarations des membres de l'hôtel, ainsi que celles des clients présents ce soir là en y ajoutant les déclarations des amis du couple quant aux heures auxquelles ils ont été voir les enfants et où ils étaient minute par minute, le ravisseur n'aurait eu que quelques très courtes minutes pour enlever Madeleine comme décrit plus haut. Selon les essais de la PJ, c'est irréalisable sans être découvert par l'une ou l'autre personne présente, pour autant que les amis n'aient pas mentit dans leurs déclarations. La PJ devant se baser sur des faits, en analysant les déclarations concernant le timing des amis du couple ainsi que celui du couple lui même, si personne ne ment, l'enlèvement n'est pas crédible ! En outre, le ravisseur a du s'enfuir sans être aperçu par les caméras de surveillance du club. D'autre part, si le ravisseur avait fait passer Maddie par la fenêtre, des traces d'ADN auraient été trouvés sur la fenêtre, le long du mur ou au sol en bas de la fenêtre. Or ce n'est pas le cas, les seules traces d'ADN retrouvées à cet endroit sont celle de Kate.

Or else, the abductor was alone and he let Maddie slide along the wall until she fell on the ground leaving her only for the time to get out in his turn to recover her. Only these scenarios do not stand up to scrutiny in view of all the statements. In fact, referring to the, "timings," from one to another, according to the statements of members of the staff, as well as those of customers who were present that evening, adding the statements of friends of the couple as to the times at which they had been to see the children and where they were minute by minute, the abductor would only have had a few short minutes to abduct Madeleine as described above. According to the PJ's attempts, it is not possible without being discovered by one or other person present, provided that the friends have not lied in their statements. The PJ, having to base themselves on these facts, in analysing the statements concerning the timings of the couple's friends, as well as the couple themselves, if no one is lying, abduction is not believable! In addition, the abductor had to flee without being seen by the club's surveillance cameras. On the other hand, if the abductor had passed Maddie through the window, traces of DNA would have been found on the window, along the wall or on the ground below the window. But this is not the case, the only traces of DNA found at that place were those of Kate.

Malgré l'impossibilité de plus en plus évidente de la thèse de l'enlèvement, la PJ a mis tout en oeuvre pour trouver un ravisseur potentiel. Il y a eu des dizaines et des dizaines d'enquêtes et vérifications faites sur des suspects d'abus sexuels. La PJ a vérifié et entendu toutes les personnes qui pourraient avoir été en vacances en Algarve pendant cette période afin de vérifier s'ils n'auraient pas la moindre relation avec Maddie. Tous les membres du village ont été interrogés et leurs déclarations vérifiées. La PJ a fouillé plus de 400 maisons aux alentours de l'Ocean Club sans rien trouver. Par la fenêtre par où Kate affirme que Maddie a été enlevée, aucunes traces d'ADN ou de vestiges de quelques sortes appartenant à Madeleine n'ont été trouvés.

All means have been tried.

In spite of the more and more obvious impossibility of the theory of abduction, the PJ have put everything into the work of finding a potential abductor. There have been dozens and dozens of investigations and checks made on suspects of sexual abuse. The PJ have checked and heard everybody who could have been on holiday in the Algarve during that time in order to make sure that they would not have had the least contact with Maddie. All of the people of the village were interrogated and their statements checked. The PJ searched more than 400 houses around the Ocean Club, finding nothing. On the window through which Kate asserts that Maddie was abducted, no traces of DNA or traces of any sort belonging to Madeleine were found.


Le rapport final montre les détails d'une enquête qui a atteint des sommets jamais vu !! Les enquêteurs ont été amenés à vérifier un couple qui aurait été soupçonné d'enlèvement d'enfant! Ils ont passé au peigne fin les lieux où Maddie aurait été aperçue. Ils ont fouillé minutieusement un crématorium. Ils ont même comparé le profil génétique provenant du corps d'une enfant trouvé sur la côte des États-Unis. Ils ont enquêté sur des présomptions concernant un mendiant et ils ont suivis et analysés des milliers de pistes dans les lieux les plus éloignés du Monde envoyant des inspecteurs jusqu'en Australie. En vain ! Rien ne permet d'accréditer la thèse du kidnapping. Nous savons par expérience professionnelle que le crime parfait n'existe pas. Au vu des éléments ci-dessus, on a du mal à imaginer un éventuel ravisseur passer entre les mails du filet policier mais admettons qu'il s'agirait d'un surdoué issu des meilleurs scénarii d'Hollywood bourré d'effet spéciaux à la "Matrix" permettant au suspect d'échapper à la police... Dans tous les cas de figure, si la police n'arrive pas à l'arrêter, il aurait laissé derrière lui des indices de l'enlèvement, des détails, des éléments qui permettraient à la PJ de rendre la thèse de l'enlèvement, si pas crédible, du moins possible... Or, selon le rapport final, ce n'est pas le cas !

The final report shows details of an investigation which has reached heights never seen!! The investigators were led to verify a couple who would have been suspected of child abduction! They went over the places where Maddie would have been noticed with a fine-tooth comb. They thoroughly searched a crematorium. They even compared the genetic profile from the body of a child found on the coast of the United States. They investigated suspicions about a beggar and they followed and analysed thousands of trails in the farthest flung places of the world, sending inspectors as far as Australia. In vain! Nothing substantiates the kidnapping theory. We know from professional experience that the perfect crime does not exist. In view of the above details, it is hard to imagine a possible abductor slipping through the police net but agreeing that it would be something special from the best Hollywood scenarios, packed with special effects like the, "Matrix," that would allow the suspect to escape from the police....In any case, if the police had not managed to arrest him, he would have left behind clues about the abduction, details, evidence which would allow the police to make the idea of abduction, if not credible, at least possible...But, according to the final report, that is not the case!

Ce que contient le rapport final

Treize mois de recherches et le rapport n'accuse personne mais il met au jour de nouveaux et très fort doutes dans la thèse de l'enlèvement avancée par les parents de Madeleine. Le rapport décrit en détails les divers éléments et indices recueillis par les investigateurs ainsi que tous les contrôles et vérifications effectués. La PJ a essayé de confirmer l'hypothèse de l'enlèvement. Ils ont voulu y croire de toutes leurs forces mais les éléments recueillis ont montré l'impossibilité de cette théorie. L'une des investigations la plus lente de cette recherche fut de rassembler et d'analyser toutes les informations concernant les moyens de fuite par voie terrestre, maritime et aérienne. Tout à été analysé, rien n'a été laissé au hasard. Les images prisent par les touristes lors de leur vacances à Algarve ont été analysées mais rien de déterminant n'y fut trouvés. Ces informations ont toutes été compilées en annexe de la procédure et une autre annexe uniquement pour les suspects de crimes sexuels. La PJ a également établie un dossier concernant toutes les personnes connus pour crime violent et ils ont vérifié leur vie en détail. Il était important de déterminer s'il pouvait y avoir le moindre rapport avec Madeleine. Le rapport final lance la conviction inévitable du décès de Madeleine le 03 mai à Praia.

What is in the final report.

Thirteen months of research and the report accuses no one but it brings to light new and very strong doubts about the abduction theory put forward by Madeleine's parents. The report describes in detail the various evidence and clues gathered by the investigators as well as all the inspections and checks carried out. The PJ tried to confirm the abduction hypothesis. They strongly wanted to believe it, but the evidence gathered showed the impossibility of that theory. One of the slowest investigations of this research was to collect and analyse all the information about means of escape by land, sea and air. Everything was analysed, nothing was left to chance. Photos taken by tourists during their holidays in the Algarve were analysed, but nothing decisive was found there. All this information has been compiled as an appendix to the case and another appendix only for suspects of sexual crimes. The PJ have also set up a file on all the people known for violent crime and they have checked their lives in detail. It was important to determine if there could have been the least contact with Madeleine. The final report puts forward the inevitable conviction of Madeleine's death on May 3rd in Praia.


Plus d'une heure à pleurer.

Les parents de Madeleine n'ont jamais démenti le fait qu'ils laissaient leurs trois enfants seuls dans l'appartement pendant qu'ils allaient dîner le soir. Fait qui a également été confirmés par les membres du personnel de l'Ocean Club. Les parents ont toujours assuré qu'ils allaient voir les enfants tous les soirs de demi-heure en demi-heure. Rappelons qu'à 19h00 du soir, en mai, au Portugal, il fait aussi clair qu'à midi. Les déclarations d la voisine, Pamela Fenn remet en cause la version des parents. Elle garantit avoir entendu Maddie pleurer pendant une heure et 15 minutes deux nuits avant sa disparition. La britannique a déclaré aux inspecteurs que dans la nuit du 1er mai à 22h30, elle a entendu Madeleine pleurer. Elle a confirmé à la PJ que l'enfant est restée inconsolable durant 1h15 jusqu'au moment où les parents sont rentrés. La voisine a entendu le bruit de la porte des de l'appartement des McCann à 23h45, heure à laquelle les parents rentraient habituellement de leur soirée. Yvonne Martin, employée de la sécurité pour l'Ocean Club avait attiré l'attention des parents sur leur imprudence concernant leurs enfants.


Over an hour to cry.

Madeleine's parents have never denied the fact that they left their three children alone in the apartment while they went out to dinner in the evening. A fact which is also confirmed by members of the Ocean Club staff. The parents have always stated that they went to see the children every half hour on every evening. Remember that at 19.00 in the evening, in Portugal, in May, it is as light as mid-day. The statements from the neighbour, Pamela Fenn call into question the parents' version. She guarantees that she heard Maddie crying for an hour and fifteen minutes two nights before her disappearance. The British woman told the inspectors that on the night of May 1st at 22.30, she heard Madeleine crying. She confirmed to the PJ that the child was inconsolable for 1h15 until the time the parents returned. The neighbour heard the sound of the door of the McCanns' apartment at 23.45, the time the parents usually returned in the evening. Yvonne Martin, security employee for the Ocean Club had drawn the attention of the parents to their carelessness concerning their children.


Les chiens ont été décisifs. L'action des chiens britanniques spécialement entraînés pour détecter l'odeur de cadavre et de sang humain a été décisive pour que Gerry et Kate soient suspectés. Devant les coïncidences face à l'action des deux chiens, qui ont signalés les mêmes endroits ainsi que les mêmes objets, les autorités ont été obligées d'admettre une éventuelle implication des parents dans la disparition de leur fille et de les désigner "arguidos" afin de les confronter aux éléments qui pourraient les conduire à une inculpation. Les inspecteurs expliquent que les chiens ont donné des signes de détection d'odeur de cadavre et de sang humain dans les endroits et sur les objets suivant:

  • Dans l'appartement d'où Madeleine a disparu (Dans la chambre du couple et dans la salle de séjour)
  • Dans le potager
  • Dans le véhicule loué par les parents 24 jours après la disparition de Maddie.
  • Sur deux vêtements de Kate
  • Sur la peluche de Maddie que Kate n'a pas lâché les jours suivants la disparition.
The dogs were decisive. The actions of the British dogs, specially trained to detect the odours of human cadaver and blood were decisive for Gerry and Kate being suspected. With the coincidences faced with the actions of the two dogs, who indicated the same places as well as the same objects, the authorities were obliged to admit a possible involvement of the parents in the disappearance of their daughter and to designate them as, "arguidos," in order to confront them with the evidence which could have led to an indictment. The inspectors explained that the dogs gave the signs of having detected the odours of human cadaver and blood in the places and on the objects following:

  • In the apartment where Madeleine had disappeared. (In the couple's bedroom and in the lounge)
  • In the garden
  • In the vehicle rented by the parents 24 days after Maddie's disappearance.
  • On Kate's clothes.
  • On Maddie's soft toy which Kate had not put down in the days following the disappearance.

In the apartment of the McCanns' friends, in the village of Praia and in the vehicles used by Robert Murat - first to be named as a suspect - nothing was detected by the dogs. Faced with these indications, reinforced by other tests carried out in Portugal and in England, the PJ interrogated Kate and Gerry before naming them, "arguidos."

Des témoins à entendre Dans ces déclarations, Gonçalo Amaral, qui fut l'inspecteur coordinateur du dossier, aujourd'hui à la retraite depuis 6 jours, affirme que le 2 octobre, jours de son éloignement, "nous étions en train de finir certains travaux pour qu'un témoin très important vienne au Portugal". Gonçalo Amaral a précisé que ses collègues n'ont pas su concrétiser la venue de ce témoin. Ajoutons que SOS Maddie révèle l'existence de deux témoignages décisifs qui n'ont pas encore été communiqués aux autorités portugaises. Ces témoins mettraient directement en cause la responsabilité d'un des amis du couple McCann. Ces témoignages n'auraient pas suivis le circuit normal de la coopération internationale. Certaines forces de police ayant collaboré à l'enquête sur le sol du R-U auraient été dépassé par les agissements de leur hiérarchie précise SOS Maddie.

Witnesses to be heard.

In his statements, Gonçalo Amaral, who was the coordinating inspector of the case, now 6 days into retirement, states that on October 6th, the day of his dismissal, "we were in the process of finishing certain work for a very important witness to come to Portugal." Gonçalo Amaral clarified that his colleagues did not know how to organise the arrival of this witness. Additionally, SOS Maddie reveals the existence of two crucial witness statements which have not yet been sent to the Portuguese authorities. These witnesses directly call into question the responsibility of one of the friends of the McCann couple. These witness statements would not have followed the normal system for international co-operation. SOS Maddie makes clear that certain police forces, having collaborated in the investigation on UK soil, were overtaken by the actions of their superiors.

SOS Madeleine McCann 5/07/08: Kate and Gerry McCann before the High Court in London.

Monday 7th July is the day on which Kate and Gerry McCann's petition is presented before the High Court in London. They are seeking to obtain access to the information held by Leicestershire police, which they say may help their private investigators in the search for their daughter Madeleine.

Lundi, sept juillet, Kate et Gerry McCann, les parents de Madeleine, la petite Britannique donnée comme disparue au Portugal, vont comparaitre devant la section famille de la Cour Suprême de Londres où, selon leur porte-parole, ils veulent demander qu’il soit ordonné à la Police du Leicestershire de leur donner accès aux documents concernant l’enquête à la disparition de leur fille.

On Monday July 7th, Kate and Gerry McCann, parents of Madeleine, the little British girl understood to have disappeared in Portugal, will appear before the family division of the High Court in London where, according to their spokesperson, they wish to request that the Leicestershire police be ordered to give them access to documents concerning the investigation into their daughter's disappearance.


Le procès, ouvert au public et identifié comme “FD07P01121 McCann”, commence à 10 h 30 devant la Juge Hogg, fille de l'ancien "Lord Chancellor" Lord Hailsham et soeur de l'ancien ministre de l’Agriculture Douglas Hogg.

Selon Clarence Mitchell, l’ancien responsable de l’Unité de Surveillance des Médias auprès du gouvernement britannique, devenu le porte-parole des McCann, le couple prétend avoir accès aux dossiers tenus par la police de Leicestershire afin de poursuivre les recherches de Madeleine. La police britannique arguera du fait que le contenu du dossier concerne les bases d’un cas criminel et que comme tell il devrait être maintenu confidentiel.

The proceedings, which are open to the public and identified as "FD07P01121McCann", start at 10.30am before Judge Hogg, daughter of the former, "Lord Chancellor," Lord Hailsham and sister of the former Minister for Agriculture, Douglas Hogg.

According to Clarence Mitchell, former head of the British government's Media Monitoring Unit, now the McCann's spokesman, the couple are claiming access to the files held by the Leicestershire police in order to continue their search for Madeleine. The British police will argue that the contents of the file constitute the basis of a criminal case and as such must be kept confidential.

Selon un officier de liaison de la police britannique, la révélation anticipée de la présence des McCann devant la Cour Suprême, faite par initiative de Clarence Mitchell, est une manœuvre adoptée par le couple pour atténuer l’impacte auprès de l’opinion publique de l’annonce de la mise sous tutelle de Madeleine, une information que serait de toute manière abordée au cours du procès de lundi.

Le même officier accuse le couple McCann de rechercher à prendre connaissance de l’avancement de l’investigation et des détails connus de la police dans un souci de préparer leur défense et non de relancer les recherches de Madeleine.

According to a British police liaison officer, the early disclosure of the McCanns' appearance before the High Court, on the initiative of Clarence Mitchell, is an action adopted by the couple to lessen the impact on public opinion of the announcement of Madeleine's being made a ward of court, information which, anyway, would be addressed in the course of the proceedings on Monday.

The same officer accuses the McCann couple of seeking to find out the progress of the investigation and the details known to the police only for preparing their defence and not for relaunching the search for Madeleine.
