Michel Fourniret a été fermement rappelé à la raison vendredi au deuxième jour de son procès devant la cour d'assises des Ardennes, les magistrats le sommant d'arrêter ses "pitreries grotesques" et de "revenir à la réalité" en acceptant de s'exprimer. En début d'audience, l'avocat général Francis Nachbar a réagi vigoureusement au refus de l'accusé de comparaître spontanément, qui a obligé le président de la cour Gilles Latapie à faire "amener de force" l'accusé, comme la loi l'y autorise. "Vous ne manipulerez plus personne! (...) Tous les jours M. Fourniret vous serez au procès, on vous amènera de force", a mis en garde M. Nachbar en fixant l'accusé, jugé pour sept meurtres aggravés de jeunes femmes ou adolescentes. Ce dernier est resté sans réaction, les bras croisés sur son siège."

On Friday Michel Fourniret was firmly brought back to reason on the second day of his trial before the Ardennes court of Assizes, the magistrates ordering him to stop his, "ridiculous clowning," and to, "come back to reality," and agree to speak for himself. At the start of the hearing, the Attorney General, Francis Nachbar, reacted vigorously to the refusal of the accused to appear voluntarily, which had obliged the president of the court, Gilles Latapie to, "bring by force," the accused, as the law authorises him to do. "You will no longer manipulate people!(....) Every day M. Fourniret you will be at the trial, you will be brought by force," cautioned M. Nachbar, glaring at the accused, on trial for seven aggravated murders of young women or adolescents. There was no reaction from the latter, who stayed on his seat, arms crossed.

Arrêtez cette indécence insupportable, ces grossièretés, arrêtez une fois pour toutes ces pitreries grotesques!", a ajouté l'avocat général d'une voix forte. Dans l'après-midi, après la longue lecture de l'acte d'accusation d'une centaine de pages, le président a plus calmement demandé à l'accusé - qui répétait son souhait de huis clos - de "revenir au principe de réalité", et de s'exprimer sur les crimes que la justice lui reproche. "Nous sommes là pour un certain nombre de semaines avec des faits à examiner, examinons-les et permettez à vos avocats de faire leur travail (...) On n'est pas à la Star Academy ou dans n'importe quelle émission de télévision", a affirmé Gilles Latapie.

In the afternoon, after the lengthy reading of the hundred page indictment, the president, more calmly ,asked the accused - who repeated his wish to have the proceedings heard in camera - to, "come back to the principle of reality," and to speak for himself on the crimes for which he is accused by the police. "We are here for a certain number of weeks with the facts to examine, let us examine them and let your lawyers do their work(.....) We are not at the Star Academy or in whatever television show," stated Gilles Latapie.

Monique Olivier: Monique Olivier ne semble pas mécontente que son mari se soit pris un savon, lui qui la qualifie de « paumée romanesque » dans les sept pages manuscrites à l'attention des familles. Un insupportable verbiage pseudo-littéraire dans lequel il se décrit dépourvu d'humanité. Effectivement, la greffière qui poursuit l'interminable lecture de l'ordonnance de renvoi fournit des éléments de personnalité attestant de sa dangerosité : « incurable, irrécupérable, cynique, sans empathie », il est un « pervers sadique à l'ego surdimensionné ». Fourniret semble s'ennuyer. Son épouse fait le gros dos et cherche vainement un ancrage visuel."

Monique Olivier: Monique Olivier does not seem unhappy that her husband should take himself as a soap opera, which he describes as, "romantic buffet," in the seven page manuscript for the attention of the families. An insufferable pseudo-literary verbiage in which he describes himself as devoid of humanity. Indeed the clerk of the court, who continues the endless reading of the indictment, provides personality details, attesting to his dangerousness: "incurable, irrecoverable, cynical, without empathy," he is, "a perverted sadist with a super-sized ego." Fourniret seems worried. His wife turns her back on him and looks in vain for a visual anchor.

Jeudi, un de ses avocats avait affirmé qu'elle profiterait du procès -prévu jusqu'à fin mai- pour "demander pardon" aux familles de victimes."

Addressing Monique Olivier, on trial for complicity, M. Latapie received a frank promise of cooperation . "I will be there every day and will do my best to answer questions," she assured. Relatively inexpressive since the start of the debates, the former nurse, Fourniret's third wife, several times raised her eyes heavenwards or shakes her head while being described in the indictment as, "perverted," who would, "feel a sort of pride in being the accomplice." On Thursday, one of her lawyers stated that she would benefit from the trial - scheduled until the end of May - to, "ask forgiveness," from the victims' families.

Fourniret, pensif, lève une seconde les yeux au plafond : « Nous sommes vendredi ?… » Magnanime et terriblement malin, Gilles Latapie opine : « Voilà, vous réfléchissez… Bon week-end, Monsieur Fourniret ! »"

Keeping the spotlight.

At 16.50. when the families seem to be exhausted, the hearing recommences and the president calls on Michel Fourniret. A clever trap into which the other falls, as he wants to keep the spotlight

Latapie a proposé le micro aux familles, très solidaires, en pleine audience vendredi, juste avant de mettre fin aux débats qui reprendront lundi. "Les versions de Michel Fourniret et Monique Olivier sont souvent différentes, les familles attendent que les deux accusés participent au débat sans huis clos", a souligné leur porte-parole pour l'occasion, Valérie Leroy, soeur d'une jeune femme de 20 ans tuée en août 1988 dans la Marne. Devant des journalistes, les proches des victimes ont ensuite indiqué avoir passé entre eux un pacte symbolique "de solidarité", en réponse au pacte criminel qui selon l'accusation aurait lié les époux Fourniret. D'après ce pacte, révélé par des lettres saisies à un domicile du couple, Michel Fourniret s'était engagé à sa sortie de prison en 1987 à tuer le premier mari de Monique Olivier, à condition qu'elle l'aide à assouvir son fantasme de relations sexuelles avec des jeunes vierges."

In a rare gesture, M Latapie offered the microphone to the families, who are very supportive of each other, in the open hearing on Friday, just before bringing to an end the debates, which will resume on Monday. "The versions of Michel Fourniret and Monique Olivier are often different, the families are waiting for the two accused to participate in the debate in open court," stressed their spokesperson for the occasion, Valérie Leroy, sister of a young 20 year-old woman, killed in August 1988 in La Marne. In front of the journalists, the relatives of the victims then indicated that they had agreed amongst themselves a symbolic pact, "of solidarity," in response to the criminal pact which, according to the charge, had linked the Fourniret spouses. With this pact, revealed in letters seized at the couple's residence, Michell Fourniret committed, on leaving prison in 1987, to kill Monique Olivier's first husband, on condition that she helped him to satisfy his fantasy for sexual relations with young virgins.

Outre le huis clos, il a posé comme préalable à sa "participation positive" aux débats la correction d'un acte d'accusation "imparfait", où "des erreurs se sont glissées". Des exigences évidemment impossibles à satisfaire. Le président de la cour Gilles Latapie a insisté sur "le principe fondamental de la publicité des débats" aux assises. Finalement, après avoir pris encore une demi-heure vendredi après-midi pour dire qu'il voulait se taire, Michel Fourniret s'est engagé à réfléchir à la question pendant le week-end."

On Monday, the case by case examination of the crimes for which Fourniret is charged, begins.

Les familles ont accepté de livrer leur sentiment aux médias à l'issue de deux journées où elles ont été très ébranlées par la lecture d'un acte d'accusation détaillant les viols et les meurtres commis entre 1987 et 2003. Entre son refus d'être extrait de prison pour comparaître - ce qui lui a valu de se faire tancer tel un gamin immature par l'avocat général Francis Nachbar -, et la diffusion d'un manuscrit où il se décrit comme "dénué de tout sentiment humain", Michel Fourniret n'a pas été avare en coups d'éclat. Dans ce texte, remis au président qui l'a ensuite transmis aux avocats des différentes parties, il mentionne en vrac, de manière confuse, son désir d'un tête-à-tête avec les familles des victimes ou son souhait de se passer de ses avocats. "C'est un document par lequel cet homme qui n'aime que lui se plaint et pleure sur lui-même une fois encore, c'est pitoyable", a réagi Me Thierry Moser, qui défend notamment la famille de Fabienne Leroy, tuée dans la Marne en août 1988."

On their part, the victims' families have clearly expressed their refusal for the proceedings to be held in camera.

"Everybody should know what our children suffered," reckons Jean-Pierre Laville, father of Isabelle, who disappeared in Yonne in 1987 and whose body had been found at the bottom of a well in 2006. The families have agreed to reveal their feelings to the media on the subject of two days when they were badly shaken by the reading of the indictment detailing the rapes and murders committed between 1987 and 2003. Il s'agit de l'agression sexuelle, en juin 2003 près de Namur (Belgique), de Marie, 13 ans, qui avait réussi à s'échapper de la Citroën C25 où elle était séquestrée, permettant l'arrestation de Michel Fourniret par la police belge.
Afin d'examiner le véhicule, et les conditions dans lesquelles Marie avait été retenue à l'intérieur avant de fuir à un stop, la cour d'assises a décidé "ce transport mardi matin (...) sur le parking du palais de justice", a-t-il été simplement dit en fin d'audience vendredi."

On Monday April 1st, the Ardennes Court of Assizes will relocate to a parking area in Charleville-Mézières to examine the van in which a 13 year-old Belgian teenager was locked and raped in 2003. It is about the sexual assault in June 2003, near Namur (Belgium) of Marie, aged 13, who succeeded in escaping from the Citroën C25, in which she had been locked, allowing Michel Fourniret's arrest by the Belgian police. Sur le plan juridique, l'opération de transport n'est qu'une simple poursuite des débats de l'audience à l'extérieur des murs du tribunal. L'interdiction d'enregistrement de son ou d'image s'applique ainsi de la même manière.
Ce transport est "une décision prise par la cour, pas une demande expresse de la famille" de Marie, a souligné un de ses avocats à l'AFP, Réginald de Béco.
A ce procès ouvert jeudi et prévu pour deux mois, Michel Fourniret est accusé de sept homicides de jeunes filles précédés de viols ou tentatives, et son épouse Monique Olivier d'être coauteur d'un des meurtres et de complicité dans plusieurs autres."

A Decision of the court.

Questioned by AFP on Saturday, the magistrate responsible for press relations at the trial, Christophe Aubertin, was not in a position to say if this move would take place in camera or publicly. Monique Olivier is not charged with any complicity in this case.
On the legal front, the relocating is only a simple continuation of the debates of the hearing outside the walls of the court room. Restrictions on sound recording or photography thus apply in the same way.
This move is, "a decision taken by the court, not a request expressed by Marie's family," Reginald de Béco, one of their lawyers, stressed.
At this trial, which opened on Thursday and is scheduled for two months, Michel Fourniret is accused of seven murders of young girls, preceded by rape or attempted rape, and his wife Monique Olivier of being the perpetrator of one of the murders and of complicity in several others.

Témoin "réquisitionné"

Le différend concerne une exclusivité temporaire des déclarations en direct dont RTL-TVI s'est temporairement assuré auprès d'un témoin dans le procès Fourniret. La chaîne RTL TVi n'aurait en effet pas respecté la Charte de Munich qui revendique le libre accès à toutes les sources d'information et l'utilisation de méthodes loyales pour obtenir des informations. La chaîne publique reproche à la chaîne commerciale d'avoir "réquisitionné", moyennant rétribution sous forme du paiement du déplacement et de l'hébergement, la première victime de Michel Fourniret, Dahina Le Guennan. L'arrangement passé entre celle-ci et la chaîne privée interdit à ce témoin de s'exprimer, entre le 25 et le 27 mars, sur une autre chaîne de télévision de la Communauté française.

L'AJP assure donner suite aux sollicitations dans les meilleurs délais, tout en rappelant "l'urgence qu'il y a à constituer en Communauté française de Belgique le Conseil de Déontologie Journalistique en cours d'élaboration depuis plusieurs années avec l'ensemble des acteurs concernés". (belga)

Witness, "requisitioned."

The dispute concerns a temporary exclusivity for live statements which RTL-TVI has tentatively agreed with a witness in the Fourniret trial. The RTL-TVi has not, in effect, respected th Munich Charter, which demands freedom of access to all information and the use of fair methods of obtaining information. The public channel accusesthe commercial channel of having, "requisitioned," in return for remuneration in the form of payment for travel and accommodation, Michel Fourniret's first victim, Dahina Le Guennan.
The arrangement agreed between her and the private channel, prohibits this witness from speaking to another French community television channel between the 25th and the 27th of March.

The AJP (
Association of Professional Journalists, which has received the complaint) provides responses to questions with the least delay, while reiterating, "the importance that is constituted in the Belgian French Community of the Council of Journalistic Ethics under development for several years with all the players involved.
