Kate and Gerry McCann playing the waiting game

Video by HiDeHo4 June 16th 2014

When there was a dig on a Greek island in the search for Ben Needham, who went missing as a toddler, his mother, Kerry, was there while the work was being carried out. Kate and Gerry McCann, on the other hand, decided not to go to Portugal while digging was going on in the search for their daughter. Their official Facebook page carried a message that they had been asked not to go, but I'm sure they could have gone anyway. No one forced them to stay away. However, last weekend, Kate and Gerry found time to fly to Portugal for their libel case against Dr Gonçalo Amaral, which was scheduled to start today at 9am. Kate and Gerry had been hoping to give statements to the court on how Dr Amaral's book had affected their lives, but this was not to be because the case has been postponed, following a letter delivered to the court this morning by Gonçalo Amaral.

Oh dear!

Thanks to HiDeHo4, we have the video of Kate and Gerry outside the court this morning. I'm not going to transcribe the whole of that video or comment on all of it: it's the Kate and Gerry pity party and I haven't had my supper!

Just a few extracts then.

Gerry McCann: "..it's a blatant and cynical attempt to wear us down and it's Madeleine who's suffering."

Well, Gerry, you didn't wear yourselves down searching for your daughter the night she disappeared. Neither of you went out looking for her, preferring to spend your time phoning all the friends and relations and telling them about the "jemmied shutters," which weren't actually damaged at all. You have also put a great deal of energy into having Dr Amaral's book banned (subsequently overturned) and pursuing this libel action.

So, it's "Madeleine who's suffering."? In what way might Madeleine be suffering, if she were alive, because this libel case has been postponed? I'm not with you there, but hey, let's just throw that line in to get some sympathy! None from this quarter! I believe that Madeleine's suffering was over a long time ago.

Kate McCann talks about "the pain and stress that Mr Amaral has brought to us and our children." Dr Amaral's book was published soon after the case was archived in July 2008. Let's talk about the waiting game here. It wasn't until May 16th 2009 that the media carried the story that you and Gerry had found that the book had caused you great distress and suffering and that you had decided that you would take legal action. Why wait so long? It didn't cause great distress and suffering immediately? Or maybe you hadn't expected it to be so successful. Or maybe, once you had counted up what you thought Dr Amaral had earned from the book, you began to feel upset and distressed. All that money! Waaaaaaah! Let's sue him for the lot!

Moving on, Kate McCann tells the eager reporters that every time she and her hubby have to go to Portugal, "we have to make arrangements for our children to be looked after." Good God! They're now using babysitters! If they had paid out a few quid for a babysitter in May 2007, they wouldn't be in this position. Enough with the "poor me."!!

They have to book flights and hotels? What a hard job that must be! And I don't believe for one minute that even a penny of their own money was used in the process, not with a fund produced from public donations to dip into, that fund that was supposedly set up to look for Madeleine. Madeleine was not at the Vatican and she's not in the court in Lisbon.

The next part of Kate McCann's spiel is rather worrying. She states that Gonçalo Amaral, with reference to the search for Madeleine, is trying to, "stop her that human right of being looked for and found." Really? With all the suspects that have been lined up since the book was published? Kate and Gerry, instead of hiring dodgy detectives, you could always have looked for her yourselves, especially on the night she disappeared. But it's the next part that's really worrying. Kate McCann goes on to say, "It has happened to other children. It can happen to Madeleine." Is there a direct link there? Is she implying that Snr Amaral has stopped other children being looked for and found? It certainly seems like that to me. Sounds rather libelous if that is what she's implying.

So, here we have Kate and Gerry playing the waiting game. They've played that game rather a lot since their daughter disappeared into thin air. I believe they waited from 10pm, when Madeleine was said to have been found to be missing, until around 10.40pm before one of their holiday companions called the police. They waited nearly a year to decide to sue Gonçalo Amaral because of hurt and distress caused by his book. Their lawyer, Isabel Duarte, waited some considerable time after the ban on Amaral's book was overturned to actually comply with a court order to return those books. Well, now it's their turn to wait a little longer. They could always spend some time investigating those "hellish lairs," in the "lawless villages," around Praia da Luz that two of their detectives spoke of.

Gonçalo Amaral has also been waiting. As a result of this court action, his assets were frozen and he has had to rely on his father for a roof over his head. He hasn't had access to a few million quid in publicly donated money to pay his bills and fund a few jaunts around Europe. He has waited five years and I guess he can wait a little while longer.

Good luck Dr Amaral. You have many friends around the world who are on your side, the side of justice for Madeleine.

Madeleine McCann: The Documentary Based on Amaral's Book

At present the McCanns are suing Gonçalo Amaral for defamation over what was written in his book about the disappearance of Madeleine. This is the documentary based on the book, which the McCanns tried to have banned.

Gonçalo Amaral interview April 4th on W9 with Sidonie Bonnec and Paul Lefèvre.

Sidonie Bonnec

The preview: (This programme was due to have been aired about 2 years ago, but was cancelled)

On Monday April 4th at 8.40pm on W9, through two unpublished documentaries, 'Enquêtes Criminelles' proposes to focus on the strange disappearance, on May 3rd 2007, of little Maddie McCann.

Maddie: the banned investigation.

Gonçalo Amaral, the Portuguese police office who directed the investigation before being thrown off it, is convinced of the parents involvement in the death of their daughter. According to the police officer, the little girl died accidentally in the apartment where the family were spending their holiday. Then the parents made it look like an abduction. For Gonçalo Amaral, the McCann couple lied to the investigators "because they were negligent with their children. They went to dinner leaving them alone. Such behaviour is reprehensible. They then set up the kidnapping story." Gonçalo Amaral returned to the scene of the drama. Before our cameras, he reconstructed, minute by minute, everything that happened on the day of the disappearance and put forward the contradictions from the various witnesses. You will see exclusive images recorded by the Portuguese police, which notably show the reaction of the police dogs as they went through Maddie's parents' apartment.

The parents' argument

In spite of Gonçalo Amaral's statements and the archiving of the investigation, Gerry and Kate McCann still believe that their daughter is alive. A few weeks ago, they published an age-advanced image of their daughter in the hope of finding her. Moreover, they have engaged two detectives who continue the investigation. The two men went back to the scene in Praia da Luz to produce a filmed reconstruction of the day of the drama. They found new witnesses who stated that they had seen a man hanging about near the McCanns' holiday apartment, several days before Maddie's disappearance. For them, that leaves no doubt: the man is the abductor. Following the detectives' investigation, you will see how, two years after the events, the McCanns are trying to live in their home near Leicester, in the English midlands, with their twin children.

What follows is a translation of a transcription of the programme which aired on the evening of Monday April 4th. Bonnec and Lefèvre present, 'Enquetes Criminelles' on French TV Channel W9.

The documentary produced with Gonçalo Amaral, based on his book, 'A verdade da Mentira,' (The Truth of the Lie) was shown first, followed by the interview with Gonçalo Amaral. Then came a video entitled, 'The parents' argument,' which is no longer available on the W9 web site, but from the transcript it seems to be part of the programme made for Channel 4, otherwise known as 'the mockumentary.'

This is Part 1 of the Amaral documentary, the rest of which I shall post at the end of this transcript.

Start of the broadcast. Sylvie Bonnec recalls the circumstances of May 3rd and how G Amaral was thrown off the investigation but remains convinced that sooner or later the truth will see the light of day (images from the documentary) She introduces Paul Lefèvre, a legal journalist. She recalls that 4 years later, the parents were exonerated after having been suspected. She presents surprising images recorded by the police. Kate’s appeal to the abductors is shown from start to finish and then a voiceover says that the official conclusion of the investigation states that the little girl had been abducted while she slept. SB then says that according to Amaral, the little girl died on May 3rd (and that the parents were involved in her disappearance), a version that many would like to see quashed.

She leads into the two documentaries, stating that they are unpublished in France: Amaral’s and the McCanns’ (with no further clarification as to their provenance) If I heard the phrase “4 years after,” correctly, it may be that the programme has been partly remade and the old footage added. It’s quite confusing.

Amaral footage: female voice commentating in French, apparently faithful in translation and intonation.
Return to the set with Amaral. Interview. (rough transcription from what I can remember, but there are certainly gaps) Transcription by frencheuropean.

L: You were taken off the investigation. Why does it bother you?

A: Before replying, I’d like to clarify one point. The parents were not innocent. That’s wrong. The case was closed, the parents could have opposed it but they preferred to use private detectives. It’s wrong to say that they were innocent.
It bothers me because I am telling the truth. The book represents 5 months of the investigation: the theory from the investigation. It’s the conclusion of the process in September 2007. Afterward, only one theory was retained, that of kidnapping. Other people were asked to keep quiet (myself and others)

L: I have experience of police investigations and sometimes the police have convictions and want to fit everything into that conviction. That’s the feeling I have here. No other theory seems to interest you.

A: That’s wrong. There is a beginning, a middle and an end to an investigation. The book ends in the middle of the investigation. At one time it was leaning towards kidnapping. But an investigation needs to run its course. Well, the investigation was prevented from concluding. The book is police work that some would like to be kept hidden.

B: I don’t understand why you attach so much importance to the fact that Kate did not shout from the balcony, took the long way round rather than the shorter route to warn the tapas, bearing in mind the dark night and the cold.

L: It’s a minor point but specialists say that the first reaction is to protect the remaining children. Kate left them alone (in these circumstances)

B: Why not have taken the little girl to the hospital (in the case of an accident)?

A: The investigation was half-way through. We were just beginning to see things. It should have run its course. There were perhaps other theories: a burglar who could have killed the child and taken her body elsewhere, for example….other tracks. (Note: the reply does no really relate to the question. There is a cut in the interview?)

L: OK, you say that the police officer who followed you gave up, lay down and that there was political pressure.

A: Your interpretation is correct.

L: (Explains the different roles of the two dogs) What were the English dogs looking for, a living or a dead person?

A: They were looking for a body.

L: You say the child was killed falling from the sofa. Can a child really be killed falling 60 centimetres?

A: It’s possible.

B: What more could you have done?

A: Look for the freezer, who had one. At that time I was dismissed and nobody looked in that direction.

L: How could the parents have got rid of a body? They were under constant surveillance that evening.

A: We should bear in mind that the police were informed well after the alert was raised. The alert doesn’t coincide with the “kidnapping,” any more than the witness statement from Tanner who says she saw the kidnapper at 9.30pm and didn’t alert the police. Why? In reality, when the parents gave the alert, all worries about transport (of the body) were taken care of.

McCanns’s documentary. Return to the set.

L: 3 witnesses (those who saw a man watching the apartment) were heard by their detectives: did you rule out these witness statements or did you miss this?

A: Everybody near that busy road was interrogated. The police interrogated all the witnesses, even a musician who was sleeping in his car.

L: Did you find that man?

A: It was D Payne, the McCanns’ friend who was often with them and the witness statement of the young girl was not reckoned to be of any value. (Note: the one who saw the horrible spotty man, I assume)
Concerning the man carrying the child seen by Tanner: there is a huge problem. J Tanner produced a lot of discrepancies, going from great uncertainty at the beginning through certainty with the progression of successive statements.
The Smiths were 80% sure that it was Gerry McCann…The film (the McCanns’) speaks of two witnesses (with similar statements) but Smith talks about the child carried with her head on the shoulder and Tanner across the arms.

L: You are a well-known man in Portugal, a man of experience. Do you really think that this nice, middle-class English couple, are calculating and Machiavellian enough to have done this?

A: It’s not the problem posed by an individual who believes something. It’s a police investigation, within the context of police work
Someone goes on holiday in a foreign country and thinks the laws are the same. Concerning the law, in England abandoning children is severely punished…

L: (cutting Amaral off by bursting out laughing) Everybody does it!

A: (Raising his voice, sounding angry) Yes, it’s abandonment to leave children on their own like that….it’s non-punishable negligence in Portugal. In England it’s punishable and the tapas know it.

L: Is that why they concealed the body?

A. There could be other reasons: so that the state of the body would not be known. But there wasn’t time to explore the theories. Perhaps if the investigation had been completed they’d all have been done?

End of the interviews. S. Bonnec concludes by saying:

“Maddie’s parents did not wish to come and have their say.”

McCanns' appeal against lifting of ban on Gonçalo Amaral's book turned down by Portugal's Supreme Court of Justice

.........................................
.........................................

According to today's online edition of Sol.pt the Supreme Court of Justice has turned down the McCanns' appeal against the lifting of the ban on Gonçalo Amaral's book 'A Verdade da Mentira,' by the lower court.

The McCanns' lawyer, Isabel Duarte, must now return all copies of Amaral's book, which were seized following the original order to ban the book.

Contacted by Sol, Isabel Duarte refused to comment on the ruling.

Madeleine McCann: The Truth of The Lie and a browse through a few other books about her disappearance.

...................... ....................

Well, this one should be well known by now, since its banning attracted world-wide attention: published in Portugal in July 2008, it was subject to a temporary injunction which was upheld in January of this year. The banning more than the publication attracted attention, but seemingly, the latest ruling by the Appeal Court in Lisbon has not been considered quite so newsworthy by the UK press.

The full English translation of the decision by the three judges sitting at the Appeal Court can be read here (Joana Morais)

Gonçalo Amaral's book was only banned in Portugal as a result of the injunction in January and was still available in France, Spain, Holland, Belgium and Germany. For those German tourists whom the McCanns are now trying to reach with their new appeal, German people who were on holiday in Praia da Luz at the same time as the McCanns, whom I can only assume must have been in a coma since then if they haven't come forward with information, Gonçalo Amaral's book, with the German title, "MADDIE - Die Wahrheit uber die Luge," is available from bol.de and is a good way to catch up on what you've been missing.

German

The first book to be published about Maddie's disappearance was, "MADDIE 129," by Hernâni Carvalho and Luis Maia, first published in Portuguese and available in English by November 2007. 129 was the number of days that Maddie's parents spent in Portugal before their quick flight back to the UK, following being constituted as 'arguidos,' or official suspects. The writers examined the contradictions found in statements given by the main characters: Gerry and Kate McCann and their holiday friends.

In no particular order of publication date, a look at a few more books.

"Vanished: The Truth About The Disappearance Of Madeleine McCann," by Danny Collins. From a review of the book on Amazon:

There are three possible explanations for the disappearance of Madeleine McCann: Either she was abducted from inside her bedroom, or she woke up and wandered outside the apartment looking for her parents and was abducted in the street, or she died "accidentally" in the flat and the abduction claim by her parents is false. Danny Collins makes fair and reasoned judgements on the grounds of probability, opportunity, known evidence, the behaviour of the main characters and the circumstances relating to similar missing children cases.

I don't know if Mr Collins reached a decision about which of the three explanations was most likely, because I haven't read the book, which was published in May 2008 in paperback, but since we still don't know what happened to Madeleine, I don't think Mr Collins arrived at the truth.

"THE MADELEINE INVESTIGATION: INCOMPETENCE OR CORRUPTION?" by members of the "Justice for ALL the McCann family forum."

I guess the title gives the game away a bit here. Two choices: incompetence or corruption! So, we don't really need to look inside to have a good guess at the slant taken by the authors, who ask at the beginning of the book, "Why are Madeleine's abductors still at large? We ask questions the Portuguese police must answer." I think the authors are probably still waiting because I doubt the Portuguese police have felt compelled to respond!

A few pages later, the authors of the above work inform that from day one Kate and Gerry McCann were being considered as suspects to the exclusion of all other options, that the police lied about the DNA evidence, distorted the value of the sniffer dog evidence, and made the parents suffer almost a year of torment as arguidos, "without so much as a scrap of evidence."

Oh dear! There might be a case for libel there folks! Watch your backs now that Dr Amaral's book is back on the shelves of bookshops in Portugal and the three judges consider that there was enough evidence to constitute the McCanns as arguidos!

"Faked Abduction," by Brian Johnson.

A look at the conclusions of Gonçalo Amaral and Chief Inspector Tavares Almeida with opinions from a criminal psychologist. Published in the US and not available from Amazon, another book whose conclusions we can guess at. As far as I am aware, the book is still available from the author and there has been no attempt to have it banned. Still, since the Amaral book was only actually banned in Portugal and not in the rest of Europe, the McCanns were unlikely, in my opinion, to spend thousands on lawyers to stop a book which was not as generally available, if they didn't do a banning tour of Europe!

And now another fine book in the German language for those tourists emerging from a three and a half year coma!

"Analyse des Vermisstenfalles Madeleine McCann," by Daniela Prousa

Published July 2010. Available from Amazon

Daniela Prousa is a psychiatrist, who concludes that Madeleine McCann died as a result of an accident in her parents' holiday apartment in May 2007. I have not heard of any attempt to ban this book, but since Gonçalo Amaral, as a police officer with over 26 years of experience in criminal investigation, was judged to be qualified to express an opinion, so might Ms Prousa, as a forensic psychiatrist.

The following is an extract from an excellent review of the book, which can be read in full on the McCann Exposure blog.

Analyse des Vermisstenfalles Madeleine McCann is written by German author and psychiatrist, Daniela Prousa. It is essentially an interpretative phenomenological analysis (IPA) of the McCann’s given accounts regarding the disappearance of their daughter Madeleine McCann. Prousa examined in detail how the McCann’s make sense of and perceive significant events in their lives, namely the events conceived on the evening of May 3rd 2007, the night Madeleine disappeared. She obtained data from many written and visual expressions of the McCann’s, via their blog on their website, media statements and interviews and television appearances. During her study she asked curious and critical questions of their accounts, actions and emotions – verbal and non-verbal – such as “What is this person trying to achieve here?” and “Is something leaking out here that wasn’t intended?”

Through her analysis, Prousa concluded that Madeleine McCann died because of an accidental fall off the sofa, either immediately after her parents left the apartment or shortly after Gerry McCann’s check at around 9.10pm. Further, she believes that it was Kate McCann who initially found Madeleine and that Gerry came in later to support her in covering up the accidental death of their daughter.

The Maddie Case: police officer regains his right to free speech.

After a number of events that followed little Madeleine McCann's disappearance in May 2007, in Portugal, the director of the investigation, Commissioner Gonçalo Amaral, was persuaded to keep quiet and his book, which recounted the details of his investigation, was withdrawn from sale by court order.

A best seller in Portugal, in it Amaral considers that the Policia Judiciaria were hampered in their investigation by the behaviour of the little girl's parents. He puts forward the hypothesis of accidental death due to lack of supervision, or even the misuse of a sedative. The McCann couple then allegedly concealed their child's body to evade responsibility, deliberately sending the investigators on the track of an abduction. Without concrete evidence, the police officer wove a number of givens into the thread of a story. From worrying details.

The most recent ruling by the Court of Appeal took the opposite view to the previous decision. It said that, "the contents of the book do not infringe any fundamental right of the McCanns," and that the ban with which he was sanctioned was an attack on freedom of expression such as is guaranteed to all by European Convention on Human Rights and the Portuguese Constitution. And there could not be a violation of the McCanns' privacy in so far as they themselves had freely used the media and provided private information to the press: "It was they themselves who, voluntarily, decided to limit their right to privacy."

So, Amaral regained his right to express himself and to defend himself. However, he has two other accusations to face. In fact, he is still the subject of an action for defamation on the part of the McCann couple, who are claiming 1.2 million Euros from him in damages and compensation, and a complaint for violation of, "secrecy of justice."

His book, "A Verdade da Mentira," published in France by Bourin, is to be returned to the shelves in the bookshops. Also, the ban which affected the documentary about the case, has been lifted. It can now be broadcast on a French TV Channel.

Meanwhile, we still don't know what has happened to little Maddie. Recently, an Englishman, a convicted paedophile, who figured amongst the suspects, allegedly made a deathbed confession. In a letter addressed to his son, he stated that the little girl was allegedly chosen from a photo, by clients of an, "illegal adoption gang." A pretty weird story, into which dived the private detectives paid from the support fund set up by the McCanns.

In his exposé, Amaral accuses the child's parents, but the way in which the investigation got going could also be questioned. Notably (easy in retrospect) the delay in putting out a general alert...In identical circumstances, would we in France have triggered the "Alerte enlèvement," plan? *

In an attempt to harmonise procedures when such an event occurs, a plan is being studied at European level. Last month, an exercise was carried out between France, Britain and Belgium, around the following scenario: a little girl was abducted in Britain by a man on his own. It is believed that he reached France with his victim, then Belgium. The success has been mixed: collaboration between the different services is good, but means of communication must be improved. the creation of an extranet site is envisaged.

For us, when this plan has been triggered, it has shown its effectiveness. The main difficulty is still in taking the decision: have the criteria been fulfilled for launching an alert? To take an example, after the disappearance of little Antoine, in September 2008, should the Alerte Enlèvement plan have been set in motion? In hindsight, you could think yes, since we still don't know what has become of the child...

There are criminal cases that stand out more than others. The disappearance of little Maddie is one of them. And 26 years later, the mystery of little Gregory's murder is still firmly rooted in the mind. And there are others that are forgotten.

Georges Moréas 25/10/10

(*Note: I don't think the Alerte Enlèvement would have been triggered in France in Maddie's case. According to the criteria set out by the French Justice Minister, Rachida Dati, there would have to be: a definite abduction; a description of an alleged abductor that could help locate the abductor and the child; a description of any vehicle involved. In Maddie's case, there was no trace of an abductor, apart from Jane Tanner's vague description of an egg with hair, which would not have been helpful, and no vehicle description. So, an alert would not have been practicable.)

Kate and Gerry McCann "Torn apart by his lies," to continue with libel action against Gonçalo Amaral.

.....................................
.....................................

Image from the Sunday Mirror - 12/07/09 (Pamalam)

The news this week that the Lisbon Court of Appeal had overturned the ban on Gonçalo Amaral's book, "A Verdade da Mentira," (The Truth of the Lie) elicited the following response from a spokesperson for the McCann family:

"A spokesman for the McCann family said the decision did not stop the defamation case. "The defamation action against Mr Amaral is very much continuing," he said." The Guardian 19/10/10

And this, in the light of the fact that the Appeal Court judges considered that:

“The contents of the book does not offend any of the fundamental rights of the applicants [the McCann couple and their three children]” and “the exercise of its writing and publication is included in the constitutional rights that are assured to everyone by the European Convention for Human Rights and by the Portuguese Republic’s Constitution”, reads the decision, to which JN [Jornal de Notícias] had access. ( Joana Morais)

It could be considered that the McCanns' decision to sue Gonçalo Amaral in the first place was rather ill-considered. Perhaps their success with their claim against the Express newspaper group helped them get that confident, onto a winner, feeling.

What might ordinary Joe Public do if there were potentially damaging press articles about him? He would have recourse to take his complaint to the Press Complaints Commission and if he had no joy there, perhaps to take legal action, though since Joe Public would be unlikely to get Legal Aid, this course of action might not be available to him. Still, the PCC is there for, as the name sounds, complaints against what is written in the press. Did the McCanns consult the PCC before taking legal action against Express newspapers? No, they didn't!

"Baroness Buscombe, the chairman of the Press Complaints Commission, today defended the regulator's failure to launch an inquiry into press coverage of the disappearance of Madeleine McCann in 2007.

Buscombe, who took up her role in April last year, was speaking after the House of Commons culture, media and sport select committee criticised the PCC for staying silent for 10 months after McCann went missing while newspapers were apparently breaching its code of practice.

"In any other industry suffering such a collective breakdown ... any regulator worth its salt would have instigated an inquiry," the MPs said in their report. "It is an indictment on the PCC's record, that it signally failed to do so."

But Buscombe said the PCC had been constrained to act because the McCann family had not made a formal complaint to the watchdog about newspaper coverage.

The McCanns instead took legal action that resulted in a £550,000 payout from Express Newspapers, a private settlement with Associated Newspapers and an apology from the News of the World.

"It's very important to put it in context," Buscombe told The Media Show on BBC Radio 4 today.

"What actually happened was that as soon as the story broke, the PCC was very much in touch with the McCann family and repeatedly offered to help.

"The McCanns and the PCC over the months that followed were in touch and indeed Gerry McCann in this inquiry actually praised the PCC for helping very much in terms of privacy matters relating to their other children."

Buscombe said the PCC had held "numerous discussions internally" about the McCann case.

"The difficulty that it had was that it's very difficult for a self-regulatory body such as ours to actually pre-empt and decide in some ways whether a headline or statements that are being made are something that we should be tackling without proper engagement of the complainants."

The important points I would extract from the above article are:

1) As a self-regulatory body, the PCC was constrained from acting without formal complaints from the McCanns.

2) The PCC offered to help the McCanns.

3) Instead of accepting PCC assistance, and making formal complaints, the McCanns launched legal action and were awarded £550,000 as an out of court settlement from the Express Group.

The problem is, I guess, that making formal complaints and possibly extracting retraction and apologies via that route does not net any cash! Just let the newspapers get on with it and then sue them! Good little money-spinner there! (This blog 24/02/2010)

It might even be considered that the McCanns were not particularly bothered about Gonçalo Amaral's book until it looked as though it was about to be published in the UK, after all the book was published in July 2008 and the McCanns did not initiate legal action until May 2009. It also might be considered that they weren't particularly bothered about the book until they found out how many copies it had sold in Europe and how much money could have been made from it.

The McCanns decided on the figure of £1 million (£1.2 million Euros) as the sum they wish to claim for defamation against the former PJ police officer. Now, where did they get that figure from?

What they are demanding

£430,000 damages for Madeleine which will be used to continue the search for her.
£215,000 for each parent for the emotional distress the book has caused them. They say they suffer 'permanent anxiety, insomnia, lack of appetite, irritability and an indefinable fear'. The writ also says Kate McCann is 'steeped in a deep and serious depression'.
£86,000 for each of their twins Sean and Amelie, who could hear his allegations when they start school in September.

How he made his money

£500,000 from the book which has sold 180,000 copies in Portugal alone.
£430,000 from the extra 150,000 books which have been sold in Brazil, France, Germany, Italy, Spain and Holland.
£100,000 for a TV documentary watched by one in five people in Portugal - 75,000 copies have sold on DVD. (The McCann Files)

For me, it looked rather like Mr Gerry and Mrs Kate did a few sums and, having worked out that there was a bit of dosh there, decided that Dr Amaral was worth suing, just like the Express was worth suing!

Gonçalo Amaral's book was not the first to question the McCanns' version of events in the disappearance of their daughter.

So, it rather looks like the McCanns waited, once again, to take legal action, this time until it appeared that Gonçalo Amaral had made a significant amount of money from his book, and was therefore worth suing. One wonders why the McCanns didn't sue the author of the book A Culpa dos McCann (The McCanns' Guilt.) Manuel Catarino. Never heard of this book, whose publication pre-dates that of Gonçalo Amaral by seven months? Perhaps that's why the author has not been sued! The book didn't sell! He wasn't worth suing! (This blog 24/02/2010 - link above)

Looking again at what the McCanns are demanding in the way of damages from Gonçalo Amaral, it's worth noting the psychological damage claimed.

£215,000 for each parent for the emotional distress the book has caused them. They say they suffer 'permanent anxiety, insomnia, lack of appetite, irritability and an indefinable fear'. The writ also says Kate McCann is 'steeped in a deep and serious depression'.

Now, for me, the above could be a description of how a parent may react following the loss of a child. It would accurately describe how my own sister suffered, several years ago, following the tragic death of her baby daughter, but when Kate McCann was interviewed for the BBC's Woman's Hour in August 2007, she did not appear to be suffering from insomnia at that time.

Jenni Murray: Do you sleep at night?......

Kate McCann: ..... Kate interupts Jenni, just as Jenni gets her question acrossWe tend to, we tend to have, replies to Jenni's question with 'Yeah' then carries on dinner together, certainly still lunchtimes and evening meals are spent together as a family. And I describe those as very normal.

Large audible intake of breath Ermm, sleeping through the night, yes. I do actually. I mean, the first four or five days was ermm, does that tongue clicking noise I didn't sleep really, ermm, as I mentioned earlier it was very hard t.. to function at all. Ermm, but now I'm fine, actually I don't I'm usually quite tired to be honest by the time we get to bed. But I haven't had any problems sleeping.

So, in August 2007, Kate McCann confidently told the BBC's Jenni Murray that after the first four or five days following her daughter's disappearance, she had no trouble sleeping, yet the publication of Amaral's book led to insomnia? Her daughter's disappearance didn't provoke such a reaction, but the book did? One wonders if it was the thought of Dr Amaral possibly making all that money that was keeping Mrs Kate awake at night!

The writ also says Kate McCann is 'steeped in a deep and serious depression'.

A deep and serious depression? So, when did that come on? When the book was published? Well, no way of knowing that, really, since it wasn't mentioned until 10 months after the publication. In the weeks and months after Maddie disappeared, depression, anxiety and fear would have been a "normal," if I can use that word, reaction from a woman who had lost a child to an abductor who had snatched her from her bed in a foreign country. However, on what would have been Maddie's fourth birthday, Kate McCann looks so radiant as she leaves the church in Praia da Luz, you'd think she'd just got married or won the lottery!

Birthday

And just a few weeks later!

Zoo

I'm sure there is no need for me to remind anyone just how the McCanns courted the media, from all those early photos of the couple walking hand-in-hand along the beach in Praia da Luz, the interviews, the statements from the couple whenever a small child went missing anywhere around the globe, the sightings and rumours of sightings and interviews about how the Portuguese police failed to follow up the sightings etc etc.

The British media has been curiously silent this week following the decision from the Lisbon Court of Appeal that "A Verdade da Mentira," can now go back on the bookshelves in Portugal. And apart from 'a spokesman,' telling us that the libel action is going ahead, and Kate McCann stating that the decision was, 'unbelievable,' the depressed and insomniac couple have also been uncharacteristically quiet.

Going ahead with that libel action? Oh dear! A fine mess you may have got yourselves into! The Court of Appeal judges are of the opinion that the book does not infringe any of your fundamental rights and now Dr Amaral is considering legal action because his rights have been infringed! Oh dear!

"Gonçalo Amaral to countersue the McCanns."

“We are going to court and file a claim for damages against the McCann couple, of that there are no doubts whatsoever”, stated yesterday to DN the former Judiciary Police Inspector Gonçalo Amaral after the Lisbon Court of Appeals ruling annulled the prohibition to market the book 'Maddie, The Truth of The Lie'.

“We haven't yet determined the losses”, added Gonçalo Amaral.

“The book is an exercise of Citizenship and of Freedom of Expression. With this decision made by the Appeals Court, it was the Portuguese democracy who has won, since the ban on the sale of the book was unconstitutional”, said Gonçalo Amaral. (Joana Morais)

Oh dear! How very depressing!

Duarte Levy: Court of Appeal annuls the McCanns' injunction.

19/10/2010

Update

(More information here ) -This Tuesday, the Appeal Court annulled the injunction files by Madeleine McCann's parents against the book written by the former Portuguese Policia Judiaria (PJ), Gonçalo Amaral.

The decision to ban the sale of the book and the video was handed down on January 14th by Lisbon's Civil Court judge Cunha Rodrgues, following a previous preliminary decision in September 2009. The injunction followed a request by lawyer Isabel Duarte in the name of the five members of the McCann clan, which included the missing child Maddie.

The decision banned the marketing of the book, "Maddie: The Truth of the Lie," - in Portuguese, "Maddie: A Verdade da Mentira." - and the distribution of a documentary of the same title which had initially been broadcast by the television channel TVI and marketed with the newspaper Correio da Manha.

According to a source close to Gonçalo Amaral, the former coordinator, who defends the theory of Kate and Gerry McCann's involvement in the disappearance of their daughter in May 2007, received the news, "with satisfaction and relief to see that justice has been done."

In France, the news was also well received by officials of a television channel which had previously bought broadcasting rights for the documentary. This morning, the court accepted the petition introduced by lawyer Antonio Cabrita and ordered the immediate replacement of the work in the usual points of sale.

The court's decision also recognised the rights of speech of the former investigator, who was until now banned from giving interviews in Portugal and abroad.

The former coordinator - police chief - regains freedom of speech.

Gonçalo Amaral received the news with satisfaction, considering that the decision by the Court of Appeal had just "reinforced Portuguese democracy," stressing that his book, "was an exercise in citizenship and freedom of expression and that to ban it was unconstitutional."

The former coordinator - chief of the Portuguese PJ, admitted that he was now more calm to face the two other court cases against him on behalf of Kate and Gerry McCann.

Madeleine's parents, as they have done in several instances in the past, have initiated an action in the civil courts accusing the former police officer of defamation, demanding this time 1.2 million Euros in compensation. In a second action, Gonçalo Amaral is accused by the couple's lawyer of having violated the secrecy of justice.

"This decision means that Dr Gonçalo Amaral is now free to express himself on all aspects of the McCann case. It means that the Lisbon Court of Appeal considered that there isn't, and there never was, in the book and in the video, any offence to the McCann couple's good name and considered that Dr Gonçalo Amaral did nothing but exercise a legal right, moreover backed up by more than twenty-six years of experience in criminal investigation," stated Antonio Cabrita, the lawyer representing the former coordinator, chief of the Policia Judiciaria.

As a reminder, the book, "Maddie: The Truth of the Lie," maintains the theory that Madeleine McCann died in the holiday apartment occupied by her family in the south of Portugal in May 2007 and that her parents hid her.

The decision to ban the sale of the book and the video was handed down on January 14th by judge Cunha Rodrigues, of the Lisbon Civil Court, following a previous preliminary decision in September 2009.

The McCanns voluntarily limited their right to a private life.

Today the judges revoked the injunction, considering that, "the contents of the book do not infringe any of the fundamental rights," of the McCanns.

"The exercise of its writing and publication is contained in the constitutional rights guaranteed to all by the European Convention on Human Rights and by the Constitution of the Portuguese Republic (relating to freedom of expression and information and freedom of the press and the media)," states the ruling from the judges, Francisco Bruto da Costa, Catarina Arelo Mando and Antonio Valente.

With regard to the accusations that Gonçalo Amaral had damaged the couple's reputation and infringed the McCanns' privacy, the judges concluded that it was the couple themselves who, "opened the door," and therefore others may express themselves concerning Maddie's disappearance.

"As regards that which concerns the private life of the claimants (the McCanns), it is they themselves who were everywhere at once in interviews and talks before the media, providing them with information which, otherwise, would never have been disclosed." It is they who, "voluntarily decided to limit their right to a private life," states the ruling.

Gonçalo Amaral's book "The Truth of the Lie," - what the Appeal Court judges said.

..................................
..................................

Reported by Ana Paula Azevedo 19/10/10

http://sol.sapo.pt/inicio/Sociedade/Interior.aspx?content_id=2505

The Lisbon court of Appeal has awarded judgment in favour of the former Policia Judiciaria inspector, Gonçalo Amaral, concerning the injunction that had been filed by Madeleine McCann's parents.

On Thursday of last week, the Appeal Court judges overturned the ban that had been imposed by the Lisbon Civil Court on the distribution and sale of the book, "The Truth of the Lie," (A Verdade da Mentira) as well as on interviews and television reports about the same in Portugal and abroad.

The McCanns claimed that Gonçalo Amaral's book and his interviews about it, had caused, "very serious and irreparable damage," to their family and in particular to their children, twins Sean and Amelie. They invoked infringement of their privacy and family life and damage to their reputation and good image.

However, for the Lisbon Court of Appeal, "the book's contents do not infringe any of the claimants' fundamental rights. The exercise of writing and publication is enshrined in the constituional rights granted to all by the European Convention on Human Rights and by the Constitution of the Republic of Portugal." (Relating to freedom of expression and information and freedom of the press and the media.)

We note that the investigation into Maddie's disappearance, which was coordinated by Gonçalo Amaral, ended by being archived without any conclusive certainty about what had happened to the three-year-old child. In the book, "The Truth of the Lie," the former inspector claims that Maddie died in her parents' holiday apartment in Praia da Luz, probably as a result of an accident, on May 3rd 2007 - after which the McCann couple, with the help of their holiday friends, hid her body. Gonçalo Amaral also claims that he was forced to write the book to defend his reputation and to restore his professional honour, since at a certain point, he was removed from the investigation before it was concluded by a decision from the National Directorate of the Policia Judiciaria.

The Appeal Court judges compared the contents of the book with the final report of the investigation into Maddie's disappearance, "The book does not include any facts which are not also included in that final report. Where the author differs from the attorneys who drafted that report is in the logical interpretation of those facts from a police work point of view. In this respect, there is the right of opinion, moreover in an area in which the author is an expert, since he had been a criminal investigator for 26 years."

"With reference to the complainants' (the McCanns') privacy, they themselves have given many interviews and talks for the media with information that would not otherwise have been made public," and that, "they voluntarily placed limits on their rights to privacy, in order to achieve higher goals such as the discovery of their daughter's whereabouts."

In doing so, "they opened the doors for others to express their opinion on the subject, about what was being said and also to contradict what was being said, always within a legal and constitutionally guaranteed right to respond and freedom of expression of opinion."

The judgment was handed down by judges Francisco Bruto da Costa, Catarina Arel Mando and Antonio Valente.

Report ends.

News release from The Madeleine Foundation...

..........following the lifting of the ban on Gonçalo Amaral's book, "A Verdade da Mentira," by a Portuguese court in Lisbon.

This morning, a Portuguese newspaper, Diário de Notícias, reported that the Portuguese Court of Appeal had overturned the draconian orders of two previous lower Portuguese courts, and has allowed Goncalo Amaral once again to sell his book ‘The Truth About A Lie’.

The news reached the English-speaking world through the blog of Portuguese blogger Joana Morais, who rapidly translated the news report, as she has translated so many Portuguese reports for an English readership over the post three years.

Tonight we learn that this news has been confirmed by all the major Portuguese newspapers in their online editions; these include Sol, Jornal de Noticia, Correio de Manhaã, TVI24, and A Bola. According to Google News tonight, there is a totals of 33 news items on the internet tonight, all apparently so far in Portuguese, about this stunning news. So far as we are aware, not one British newspaper has yet reported on this news, despite the saturation coverage the British press gave to the original banning of Mr Amaral’s book in September last year and to his unsuccessful appeal in January and February this year.

The Portuguese press is tonight quoting Dr Kate McCann as saying that the Portuguese Appeal Court’s decision is ‘unbelievable’. Given all the significant contradictions amongst the police witness statements of the McCanns and their ‘Tapas 9’ friends, some might say the same about their own accounts of what really happened to Madeleine McCann.

All members, supporters and followers of The Madeleine Foundation will want to join with us in congratulating Mr Amaral on a courageous and sustained fight to win the right to publish his book.

At the same time we remember that the Portuguese judicial system has yet to find judicial time to hear Mr Amaral’s appeal against his conviction last May for allegedly filing a false report, and that he also faces a further criminal case on the basis of what we say are unfounded accusations against him by the partner of serial liar and murderess Leonor Cipriano, now serving a 16-year jail term for murdering her own eight-year-old daughter, who she claimed had been abducted.

The news comes just 17 days after The Madeleine Foundation held a series of events in support of ‘Goncalo Amaral Day’ on 2 October, a day we established in honour of a man who has sacrificed much to bring us the facts about the Madeleine McCann investigation.

Though many people scoffed at our efforts, thousands of British people are now better informed about Mr Amaral through our leaflet: ‘Your Questions Answered about Goncalo Amaral’, which has been distributed in many British towns.

Finally, we have been asked about the continuing ban on our own book: ‘What Really Happened to Madeleine McCann? - 60 Reasons which suggest she was not abducted”. Whilst it is true that an undertaking was given by the book’s author, Tony Bennett, not to further sell or distribute it, as we said at the time, circumstances might lead to that undertaking no longer being appropriate.

We will be reviewing the situation at a forthcoming Committee meeting and it is possible that Tony will make an application to the High Court to be freed from his undertaking not to sell the book. High Court undertakings may be varied or nullified at any time if circumstances change.

Amaral's book ban lifted. Kate McCann says it's "unbelievable."!!

........................................
........................................

Noticias Terra
English translation of the above:

The advocate of the parents of Madeleine McCann, Isabel Duarte, confirmed the decision to Efe News Agency, against the claim to her clients, which was issued today by the Court of the Collegiate in Lisbon after an appeal by the author of the book.
The girl's mother, Kate McCann, considered the judicial decision "unbelievable", said the lawyer, who is studying the possible measures that will be adopted.

You'd better believe it Mrs Kate. The book ban has been lifted and Dr Amaral is now free to express himself with his book back on the shelves, in writing and in interviews.

What is unbelievable is that you left three small children alone, night after night, in an unlocked apartment in a foreign country. You went out jogging when locals in Praia da Luz were blistering their feet looking for your daughter, you trademarked her name a few days after she disappeared and you have engaged the most dodgy detectives I reckon anyone could find, supposedly to look for her.

And still you called yourself a responsible parent!

Now, that's unbelievable!

I don't know how you could seriously publish all those images of suspects, so many and so different that all over the world and in every home in the UK, we could probably all find a friend or relation to grass up!

That's unbelievable!

Kate McCann, you believe, or would have us think you believe, that your daughter was abducted, and yet there is no evidence that she has come to harm!

Unbelievable I say!

Is that all you said, Kate McCann? That one word, "unbelievable."?

I don't believe that for a minute!

...........................
............................

I have just heard that the Tribunal da Relacao has overturned the ban on Dr Gonçalo Amaral's book and that it is to be returned immediately to the point of sale!

Thank you to Joana Morais for posting this brilliant news on her blog.

As you say, Joana:

"McCann Book Ban Lifted - Freedom has returned to Portugal."

So, it's congratulations from me Dr Amaral........

...............and from him!

The Circus Is Back In Town!

..................................
...................................

Roll up, roll up, folks, the circus returns to the Civil Court in Lisbon tomorrow, Tuesday January 12th. On my right is the "disgraced," former policeman who initially led the investigation into Madeleine McCann's disappearance. On my left, Madeleine's parents, who will return to Lisbon for the three days of the hearing.

We've seen the trailers for this momentous occasion.

Leicestershire police will keep all the information they hold on the case under wraps, some of which may be made public once those responsible for Madeleine's disappearance are brought to justice and all appeals have been exhausted. (The Express Sunday January 3rd)

There was much speculation as to the timing of this press release. What transpires is that this was advance notice for the statement that one Sgt José de Freitas, an English police officer who was sent to Portugal to act as liaison officer between the Portuguese and British police and to give support to the McCann family, will not be able to appear as a witness for Dr Amaral in the hearing about the temporary injunction on his book, "A Verdade da Mentira."

Sgt José de Freitas, in a letter to the judge, invokes English state secrets in his refusal to give evidence in court. (Jornal de Noticias 10/01.2010/)

Now, hang on a minute, I say, wasn't/isn't this a Portuguese police investigation? Logically and in some kind of fairness, doesn't all the information relating to this case belong to the Portuguese police? It seems that logic and fairness doesn't come into this. All the work that Sgt De Freitas carried out in Portugal was recorded and is now subject to the UK laws of state secrets. Which raises the question for me as to should liaison be a two-way process? Seemingly not since the communication that took place between De Freitas and the McCanns is officially now state secrets.

"The English cop, incidentally with a Portuguese name (José de Freitas), was the liaison officer between the Portuguese and English authorities and the McCann couple. On several occasions he accompanied Kate and Gerry, who would be constituted as arguidos, after being confronted with evidence of human blood and cadaver odor in the apartment at the Ocean Club in Praia da Luz, Lagos. The traces - remember - were detected by the English dogs "Eddie" and "Keela."

"As an usual standard in the procedures of the British, all the contacts and signals expressed by the McCanns were registered, including those that contributed to support the decision to constitute them as suspects. And it's relating to that, and to other data, that Gonçalo Amaral seeks a statement."

"Any potential evidence [testimonial] that I can give may be subject to confidentiality and Immunity of the English Public Interest. Furthermore, since all the services that I performed were official, it is applied the principle of State immunity and it will be necessary the consent of the United Kingdom authorities to waive that State immunity before I could be subject to the jurisdiction of the Portuguese courts and to be able to give any evidence, whether relevant or not. The State immunity covering my official acts is that of the United Kingdom and not mine, and can not be renounced by me, but only by the United Kingdom", wrote José de Freitas to the judge of the Civil Court of Lisbon after having been notified, in a letter that JN had access." (Joana Morais 11/01/2010)

And of course the UK media has made sure that the appearance of the golden couple, Mr and Mrs McCann, who left their three children alone in an unlocked apartment, night after night, but don't we all do it, and it was, "just like dining in your own back garden," has been well featured in their preparations for sending their journalists out to Portugal. Wey hey! Lights, camera, action!

Sky News "McCanns Return To Portugal For Libel Case."

Well actually, like most of the UK media, Sky has got it wrong: this is not the libel action, this is the hearing to decide on the temporary injunction on Snr Amaral's book, the English title of which is, "The Truth Of The Lie."

"Family spokesman Clarence Mitchell said: "I can confirm that Kate and Gerry McCann will be returning to Portugal on Monday to attend the resumption of the Amaral trial on Tuesday.

"The details of their travel plans and itinerary will remain private at their request."

Their itinerary will remain private? Does he mean private as in there will be no details given out or private in that we will be swamped with photos of them wherever they go and only pre-prepared statements will be presented by them?

"The couple have previously said any money awarded in damages by the courts would go towards paying for private investigators to look for their daughter."

Oh dear! More private investigators? Like Metodo 3, the bunch of Spanish goons, who had never investigated even one case of a missing child, who claimed to know who had kidnapped Madeleine, exactly where she was being held and that she would be home in time for Christmas 2008? The bunch of cowboys who are suspected of paying witnesses in Morocco to report sightings of Madeleine?

More private investigators like Oakley International, whose boss is now languishing in jail on fraud charges?

"Kevin Halligen, from Surrey, was hired by the Find Madeleine fund as a security consultant. His Washington-based company, Oakley International, was awarded a six-month £500,000 contract by the fund, but Mr Halligen allegedly disappeared with £300,000."

And what about the intrepid duo Dave Edgar and Arthur Cowley, retired UK police officers, who:

Flew to Germany, insisting that convicted paedophile Raymond Hewlett spoke to them to, "clear his name," as a suspect in the Madeleine McCann case. They issued a 15 year-old photo of Hewlett and claimed some resemblance to an e-fit image of Maddie's alleged abductor.

Received and acted on a report, two years after the event, from a British man on holiday in Barcelona, that he had been approached by a "Victoria Beckham look-a-like," who asked if he had come to, "deliver her daughter." This invoked a massive hunt in Australia for the woman who was said to have been voyaging in a luxury yacht from Australia. However, the dedicated duo of investigators appear not to have actually investigated very thoroughly.

"The Mail on Sunday however, has established that members of Mr Edgar’s team who had visited Barcelona:

  • Failed to speak to anyone working at the seafood restaurant near where the agitated woman was seen at 2am.
  • Failed to ask the port authority about movement of boats around the time Madeleine disappeared.
  • Failed to ask if the mystery woman had been filmed on CCTV.
  • Knew nothing about the arrival of an Australian luxury yacht just after Madeleine vanished until told by British journalists, who gave them the captain’s mobile phone number.
  • Failed to interview anyone at a nearby dockside bar where, according to Mr Edgar, the mystery woman was later seen drinking.
  • Failed to ask British diplomats in Spain for advice before or during the visit.

Also, Spanish police could not confirm that they had been contacted by the British investigators."

So, should they by any chance win their libel action, who next? There must be some reputable private detectives in the world, who would seriously and efficiently put their experience to work in searching for a missing child. Are the McCanns just unlucky or have they knowingly thrown money, other people's money, at a few posses of detectives who were never going to find their way out of the bank?

What else has been brought to our attention in the run-up to this media event in Portugal? Well, for some reason, creating a negative image of Snr Amaral maybe, by piling on as much negative guff as possible, several newspapers have dug up a story from last year about The Madeleine Foundation's invitation to Gonçalo Amaral to attend a meeting in the UK in February this year.

Not content with telling its readers about the invitation, which has not been accepted, the Scottish Daily Record/, takes this opportunity to purge itself of some of the rubbish relating to Snr Amaral, which it has fondly cherishing in its bosom, like a half-warmed fish.

"THE cop who led the hunt for Madeleine McCann plans to visit the UK to talk about his claims that her parents are to blame for her disappearance.

Portuguese former police chief Goncalo Amaral also criticised British police involvement in the case.

And he was pictured enjoying

boozy lunches when he should have been working. He was eventually sacked."

Amaral was not "sacked." He was removed from the invesigation and re-assigned to the PJ's offices in Faro. The Record adds something closer to the truth at the end of this piece of journalistic licence.......

"He was the one who authorised their status as arguidos, or official suspects.

But he was removed from his post after five months and then retired."

.........which makes it appear that retirement was imposed on Inspector Amaral, whereas he took early retirement in order to write his book, express himself clearly and recover his reputation which had been tarnished by the likes of the Daily Record.

So, tomorrow it kicks off! Clarence Mitchell, PR spokesperson for the McCanns has obviously been very busy making sure the Teflon Two get their great tranche of publicity in advance of their trip to Portugal. We've seen the videos, we've seen the photos, we've seen the comments about the supposed visit of Gonçalo Amaral and we even know that the McCann twins want to go back to Praia da Luz, from where their sister disappeared in 2007, when they were just two years and three months old, who, in Kate McCann's own words, had never spent much time with Madeleine. Perhaps in going there they will hope to see some evidence of the existence of the sister they probably hardly knew, whom they cannot possibly remember very well by now. Or perhaps, like most four-year-old children they see their parents upset and want to please them.

It appears that there has been an effort to tarnish the image of Gonçalo Amaral, at least in the eyes of the UK reading public in advance of the commencement of the hearings on Tuesday.

Only the Mail On Sunday, in reporting the invitation to Snr Amaral from The Madeleine Foundation, gives an accurate summing up of the reasons he was removed from the case.

"Next week, Amaral is due to appear in a Lisbon court to fight a £1million libel action brought by the McCanns over his book on the case.

In it, he accused the couple of neglecting their children, questioned their need to employ a spokesman and claimed British police were ‘too close’ to them."
