Kate and Gerry McCann playing the waiting game

When there was a dig on a Greek island in the search for Ben Needham, who went missing as a toddler, his mother, Kerry, was there while the work was being carried out. Kate and Gerry McCann, on the other hand, decided not to go to Portugal while digging was going on in the search for their daughter. Their official Facebook page carried a message that they had been asked not to go, but I'm sure they could have gone anyway. No one forced them to stay away. However, last weekend, Kate and Gerry found time to fly to Portugal for their libel case against Dr Gonçalo Amaral, which was scheduled to start today at 9am. Kate and Gerry had been hoping to give statements to the court on how Dr Amaral's book had affected their lives, but this was not to be because the case has been postponed, following a letter delivered to the court this morning by Gonçalo Amaral.

Oh dear!

Thanks to HiDeHo4, we have the video of Kate and Gerry outside the court this morning. I'm not going to transcribe the whole of that video or comment on all of it: it's the Kate and Gerry pity party and I haven't had my supper!

Just a few extracts then.

Gerry McCann: "..it's a blatant and cynical attempt to wear us down and it's Madeleine who's suffering."

Well, Gerry, you didn't wear yourselves down searching for your daughter the night she disappeared. Neither of you went out looking for her, preferring to spend your time phoning all the friends and relations and telling them about the "jemmied shutters," which weren't actually damaged at all. You have also put a great deal of energy into having Dr Amaral's book banned (subsequently overturned) and pursuing this libel action.

So, it's "Madeleine who's suffering."? In what way might Madeleine be suffering, if she were alive, because this libel case has been postponed? I'm not with you there, but hey, let's just throw that line in to get some sympathy! None from this quarter! I believe that Madeleine's suffering was over a long time ago.

Kate McCann talks about "the pain and stress that Mr Amaral has brought to us and our children." Dr Amaral's book was published soon after the case was archived in July 2008. Let's talk about the waiting game here. It wasn't until May 16th 2009 that the media carried the story that you and Gerry had found that the book had caused you great distress and suffering and that you had decided that you would take legal action. Why wait so long? It didn't cause great distress and suffering immediately? Or maybe you hadn't expected it to be so successful. Or maybe, once you had counted up what you thought Dr Amaral had earned from the book, you began to feel upset and distressed. All that money! Waaaaaaah! Let's sue him for the lot!

Moving on, Kate McCann tells the eager reporters that every time she and her hubby have to go to Portugal, "we have to make arrangements for our children to be looked after." Good God! They're now using babysitters! If they had paid out a few quid for a babysitter in May 2007, they wouldn't be in this position. Enough with the "poor me."!!

They have to book flights and hotels? What a hard job that must be! And I don't believe for one minute that even a penny of their own money was used in the process, not with a fund produced from public donations to dip into, that fund that was supposedly set up to look for Madeleine. Madeleine was not at the Vatican and she's not in the court in Lisbon.

The next part of Kate McCann's spiel is rather worrying. She states that Gonçalo Amaral, with reference to the search for Madeleine, is trying to, "stop her that human right of being looked for and found." Really? With all the suspects that have been lined up since the book was published? Kate and Gerry, instead of hiring dodgy detectives, you could always have looked for her yourselves, especially on the night she disappeared. But it's the next part that's really worrying. Kate McCann goes on to say, "It has happened to other children. It can happen to Madeleine." Is there a direct link there? Is she implying that Snr Amaral has stopped other children being looked for and found? It certainly seems like that to me. Sounds rather libelous if that is what she's implying.

So, here we have Kate and Gerry playing the waiting game. They've played that game rather a lot since their daughter disappeared into thin air. I believe they waited from 10pm, when Madeleine was said to have been found to be missing, until around 10.40pm before one of their holiday companions called the police. They waited nearly a year to decide to sue Gonçalo Amaral because of hurt and distress caused by his book. Their lawyer, Isabel Duarte, waited some considerable time after the ban on Amaral's book was overturned to actually comply with a court order to return those books. Well, now it's their turn to wait a little longer. They could always spend some time investigating those "hellish lairs," in the "lawless villages," around Praia da Luz that two of their detectives spoke of.

Gonçalo Amaral has also been waiting. As a result of this court action, his assets were frozen and he has had to rely on his father for a roof over his head. He hasn't had access to a few million quid in publicly donated money to pay his bills and fund a few jaunts around Europe. He has waited five years and I guess he can wait a little while longer.

Good luck Dr Amaral. You have many friends around the world who are on your side, the side of justice for Madeleine.

Kate and Gerry McCann, may you live in interesting times.

"May you live in interesting times," is reputed to be the English translation of an ancient Chinese proverb or curse, though it may have originated with the English or the Americans. Wikipedia

It is said to be the first of three curses of increasing severity, the other two being:

  • May you come to the attention of those in authority.
  • May you find what you are looking for.
So, Kate and Gerry McCann, you already appear to be living out the first part of this three-fold ancient curse, which I hasten to add, you have brought entirely upon yourselves. Interesting times indeed have beset your lives since the beginning of this sad tale of your daughter's disappearance.

You could have gone out on the night your daughter disappeared and searched for her. Instead, you were otherwise engaged, phone pressed to your ears, calling all your friends and relations, telling them that Maddie's bedroom shutters had been "jemmied," the window broken open and Maddie taken. This lie was readily refuted because there was no evidence of a break-in, but this was the start of your interesting times, since we know you lied and Gonçalo Amaral knows you lied and you have been forced to revisit your lies and come up with new explanations. Although the only fingerprints on the bedroom window were Kate's, she is sticking to the part about the window having been opened by the abductor, as a "red herring," to fool people? Ha! More fool you, Kate McCann!

Yes, you have been living in interesting times. Jane Tanner's ever evolving description of the man she allegedly saw; hiring PR representatives, big-time lawyers, private detectives; setting up a tacky online shop with "best selling items," and "good quality wristbands"; feeling the need to silence anyone who does not accept your mantra about the invisible man who took your daughter, leaving no evidence behind of his presence.

"It's better to be a dog in a peaceful time than be a man in a chaotic period" (Chinese proverb) The question has been asked many times: why didn't you just slip quietly away and let it all die down? Because you knew that a particular Portuguese police officer would not allow that to happen?

  • May you come to the attention of those in authority.
Well, you certainly did that! Your lies thrown up by inconsistencies in your statements and those of your holiday friends, most certainly brought you to the attention of those in authority, who seriously began to investigate your possible involvement in your daughter's disappearance. You must have thought this attention would be abated when Dr Amaral was removed from the case and the investigation was archived, but your interesting times were not over: the "disgraced," police officer bounced back with a book about the investigation, and thus began your frantic search, via various private detectives, for new information, for new witnesses, for new sighings of your daughter.

And so, you have brought yourselves, once again, to the attention of the authorities, by proceeding with your attempts to silence Gonçalo Amaral, and once again, through what has come out in court during that process, you have created interesting times for yourselves. The world and his dog now know more of what is in those archived police files.

And the third part of the "Chinese curse."

  • May you find what you are looking for.
You claim to be searching for your daughter. You claim that Dr Amaral's book is hindering that search, yet you yourselves do not appear to have done a great deal of searching. Although you do not appear to be genuinely looking for Maddie, I do believe that you are probably the only ones who can find her, not your private detectives. Maddie needs to be found, if, as you say, she is "findable," and laid to rest. We all know that that "spare place," at your dining table will never be occupied by Maddie. So, may you find what you say you are looking for.

Gerry McCann: "There is no evidence that Madeleine is dead."

So, going back to how this all started, what reasons did the McCanns give for taking this legal action against Gonçalo Amaral to have his book, "The Truth of the Lie," banned?

"In a statement, the parents of the missing girl said: "We - together with our three children Madeleine, Sean and Amelie - are taking this legal action against Goncalo Amaral over his entirely unfounded and grossly defamatory claims. "[They were] made in all types of media, both within Portugal and beyond - that Madeleine is not only dead, but that we, her parents, were somehow involved in concealing her body."

"We can no longer stand back and watch as Mr Amaral tries to convince the entire world that Madeleine is dead. "Nor can we allow this blatant injustice to Madeleine, with its obvious risk of hindering our attempts to find her, to continue." BBC 17/05/09

So, the McCanns were seeing the book as Mr Amaral's personal opinion, his trying to convince the world that Madeleine was dead and that this would stop people searching for their daughter. Yet, the McCanns were amongst the first people to lay their hands on the police files of the investigation when the case was archived, in which they could read, as any one else could, that the theory of Madeleine's being more likely to be dead was not Gonçalo Amaral's personal opinion, but the conclusion of the joint English and Portuguese police teams who investigated Madeleine's disappearance.

Gerry McCann has stated that the thesis of death was investigated to the exclusion of other theses, because the PJ were convinced that Madeleine was dead and so were blind to other ideas. Not true.


"On reading this report, which was given to me on the morning of May 4th, I understand that there is no evidence sufficiently convincing to tip the investigation in one direction rather than another. There are many possible leads: voluntary disappearance - the child could have wakened and not seeing her parents, gone off to look for them; accidental death and concealing of a body; physical abuse causing death; murder by negligence or premeditated; an act of vengeance; taken hostage followed by a ransom demand; abducted by a paedophile; kidnap or murder committed by a burglar." "The idea of a robbery gone wrong is not to be ruled out either. During the holidays, burglaries are not rare, and the police are not always informed, because hotels avoid spreading this kind of information. Even if the examination of apartment 5A reveals no trace of a break-in - contrary to what the parents insist and that Sky announced - we have to take stock of the petty crimes committed in the seaside resort and at the tourist complex. We are counting on the management of the hotel so that no incident of this nature remains hidden. Even if we don't have much belief in the scenario of a burglar who enters the apartment for a burglary and leaves it with the child, dead or alive, this hypothesis, as ridiculous as it may be, must not be neglected" (Chapter 3: link above.)


In July 2007, the hypothesis of death was being considered by the joint investigating teams of English and Portuguese police. The English police suggested bringing in specialist a dog team, trained by South Yorkshire police. Mark Harrison arrived to assist with the investigation.

".........we welcome Mark Harrison, a specialist in murder, and the search for missing persons and victims of natural disasters. National advisor to the British police, he is well known for his exceptional professional experience. He has already participated in dozens of international criminal investigations.

His work consists of defining new strategies for research. He gets to work immediately, supported by the Portuguese PJ and the investigators from Leicester and Scotland Yard. On his arrival, we place at his disposal details of the case, as well as all our material and human resources. Harrison reads up on the statements and interviews from the principal witnesses - including, of course, those of the parents and friends -, all the analyses, simulations, hypotheses and cross-checking already carried out. He carries out a reconnaissance on the ground, by helicopter and then on foot. He paces the streets and the access roads to Vila da Luz and compares them to the diagrams created in the course of the investigation. Nothing is left to chance: measurement and timing of possible routes between buildings, apartments and restaurants; analyses, with the help of the best specialists, of weather, geological and maritime factors in relation to the investigation; consultation with the best forensic anthropologist in the country, who indicates for us what would be the actual state of the body in the hypothesis of death occurring on May 3rd; study of the region's natural carrion predators. All the research already conducted by hundreds of people - GNR, civil defence, firemen and other volunteers - is re-examined in detail and re-analysed.

After a week of intense work, Harrison presents the results of his study to my coordinating group. Even if we were expecting it, his conclusions confirm our worst fears. The most plausible scenario is the following: there is no doubt that Madeleine is dead, and her body is hidden somewhere in the area around Praia da Luz. He praises the quality of the work carried out by the Portuguese authorities in trying to find the little girl alive. According to him, the time has come to redirect the searches in order to find, this time, a body hidden in the surrounding area.
Chapter 16: The Truth of the Lie


Mark Harrison showed the PJ a video of the work done by Eddie and Keela, the two specialist sniffer dogs trained by Martin Grime of South Yorkshire police. The dogs were brought in on Mark Harrison's recommendation. The results are widely recorded.

Mark Harrison's conclusion, which is recorded in the police files, was that there was no doubt that Madeleine was dead and that her body was hidden somewhere in the area around Praia da Luz. This, therefore, was not Mr Amaral's personal opinion, but the conclusion reached by the English specialist, based on painstaking work on the ground, before the dogs were brought in. The dogs were brought in as a result of conclusions drawn by Mark Harrison.

Gerry McCann's repeated mantra is that there is no evidence that Madeleine is dead. Even if we rule out the work done by the specialist dogs, Eddie and Keela, there is no evidence to support the idea that Madeleine is not dead: there is no evidence of a break-in at apartment 5A; a witness for Gonçalo Amaral, during the process in Lisbon in January, stated that it would have been impossible for an abductor to have got through the narrow bedroom window, carrying a child; there was no forensic evidence left by an alleged abductor; the only witness is Jane Tanner, whose evidence has changed several times. Added to this, we have the many reported sightings all over the world, all of which have been ruled out. All of this would logically point to the fact that Madeleine has not been found because she is not alive to be found and her body has been disposed of in such a way that it will probably never be found.

There is actually no evidence of an abduction and there have been no credible sightings of Madeleine, in spite of the huge reward that was offered. Two dogs with a 100% success record separately alerted in the same areas of the McCanns' holiday apartment and in the car they rented three weeks after Madeleine's disappearance. And this is all in the police files of the investigation and described in Gonçalo Amaral's book as his personal story of that investigation.

Should police officers be liable to being prosecuted for leads they follow as part of an investigation? Should they be sued for investigating certain people as suspects? If so, there would be very few cases being properly investigated and brought to trial.

In my opinion, the McCanns' decision to sue Gonçalo Amaral was very ill-advised. The information which has come out in the course of the four days of the process in Lisbon cannot have helped the reputation they claim has been damaged by Amaral's book or their repeated mantra that there is no evidence that Madeleine is dead. The most damning piece of information to the cause of pinning the thesis of Madeleine's death squarely on Dr Amaral's shoulders came in the reading of a hitherto confidential report by Criminal Profiler, Lee Rainbow, of the National Policing Improvement Agency, which was sent to Portugal in June 2007, just one month after Madeleine's disappearance.

"Gerry McCann was made a suspect in his daughter Madeleine's disappearance after a British expert said he should be investigated for 'homicide', a Portuguese court heard yesterday.

Criminal profiler Lee Rainbow recommended that police on the Algarve investigate the doctor and his wife Kate because of 'contradictions' in his statement.

The report by Mr Rainbow, of the National Policing Improvement Agency, was sent to Portugal in June 2007, a month after the three-year-old disappeared.

His (Gonçalo Amaral's) lawyer Antonio Cabrita, reading from a Portuguese translation of the previously- confidential report, said: 'The family is a lead that should be followed.

The lawyer added: 'Portuguese police had only considered the abduction theory. It was British police who said they must consider homicide as well.' Daily Mail 11/02/10

The Circus Is Back In Town!

Roll up, roll up, folks, the circus returns to the Civil Court in Lisbon tomorrow, Tuesday January 12th. On my right is the "disgraced," former policeman who initially led the investigation into Madeleine McCann's disappearance. On my left, Madeleine's parents, who will return to Lisbon for the three days of the hearing.

We've seen the trailers for this momentous occasion.

Leicestershire police will keep all the information they hold on the case under wraps, some of which may be made public once those responsible for Madeleine's disappearance are brought to justice and all appeals have been exhausted. (The Express Sunday January 3rd)

There was much speculation as to the timing of this press release. What transpires is that this was advance notice for the statement that one Sgt José de Freitas, an English police officer who was sent to Portugal to act as liaison officer between the Portuguese and British police and to give support to the McCann family, will not be able to appear as a witness for Dr Amaral in the hearing about the temporary injunction on his book, "A Verdade da Mentira."

Now, hang on a minute, I say, wasn't/isn't this a Portuguese police investigation? Logically and in some kind of fairness, doesn't all the information relating to this case belong to the Portuguese police? It seems that logic and fairness doesn't come into this. All the work that Sgt De Freitas carried out in Portugal was recorded and is now subject to the UK laws of state secrets. Which raises the question for me as to should liaison be a two-way process? Seemingly not since the communication that took place between De Freitas and the McCanns is officially now state secrets.

"The English cop, incidentally with a Portuguese name (José de Freitas), was the liaison officer between the Portuguese and English authorities and the McCann couple. On several occasions he accompanied Kate and Gerry, who would be constituted as arguidos, after being confronted with evidence of human blood and cadaver odor in the apartment at the Ocean Club in Praia da Luz, Lagos. The traces - remember - were detected by the English dogs "Eddie" and "Keela."

"As an usual standard in the procedures of the British, all the contacts and signals expressed by the McCanns were registered, including those that contributed to support the decision to constitute them as suspects. And it's relating to that, and to other data, that Gonçalo Amaral seeks a statement."

"Any potential evidence [testimonial] that I can give may be subject to confidentiality and Immunity of the English Public Interest. Furthermore, since all the services that I performed were official, it is applied the principle of State immunity and it will be necessary the consent of the United Kingdom authorities to waive that State immunity before I could be subject to the jurisdiction of the Portuguese courts and to be able to give any evidence, whether relevant or not. The State immunity covering my official acts is that of the United Kingdom and not mine, and can not be renounced by me, but only by the United Kingdom", wrote José de Freitas to the judge of the Civil Court of Lisbon after having been notified, in a letter that JN had access." And of course the UK media has made sure that the appearance of the golden couple, Mr and Mrs McCann, who left their three children alone in an unlocked apartment, night after night, but don't we all do it, and it was, "just like dining in your own back garden," has been well featured in their preparations for sending their journalists out to Portugal. Wey hey! Lights, camera, action!

Sky News "McCanns Return To Portugal For Libel Case."

Well actually, like most of the UK media, Sky has got it wrong: this is not the libel action, this is the hearing to decide on the temporary injunction on Snr Amaral's book, the English title of which is, "The Truth Of The Lie."

"Family spokesman Clarence Mitchell said: "I can confirm that Kate and Gerry McCann will be returning to Portugal on Monday to attend the resumption of the Amaral trial on Tuesday.

"The details of their travel plans and itinerary will remain private at their request."

Their itinerary will remain private? Does he mean private as in there will be no details given out or private in that we will be swamped with photos of them wherever they go and only pre-prepared statements will be presented by them?


"The couple have previously said any money awarded in damages by the courts would go towards paying for private investigators to look for their daughter."

Oh dear! More private investigators? Like Metodo 3, the bunch of Spanish goons, who had never investigated even one case of a missing child, who claimed to know who had kidnapped Madeleine, exactly where she was being held and that she would be home in time for Christmas 2008? The bunch of cowboys who are suspected of paying witnesses in Morocco to report sightings of Madeleine?

More private investigators like Oakley International, whose boss is now languishing in jail on fraud charges?

"Kevin Halligen, from Surrey, was hired by the Find Madeleine fund as a security consultant. His Washington-based company, Oakley International, was awarded a six-month £500,000 contract by the fund, but Mr Halligen allegedly disappeared with £300,000."

And what about the intrepid duo Dave Edgar and Arthur Cowley, retired UK police officers, who:

Flew to Germany, insisting that convicted paedophile Raymond Hewlett spoke to them to, "clear his name," as a suspect in the Madeleine McCann case. They issued a 15 year-old photo of Hewlett and claimed some resemblance to an e-fit image of Maddie's alleged abductor.

Received and acted on a report, two years after the event, from a British man on holiday in Barcelona, that he had been approached by a "Victoria Beckham look-a-like," who asked if he had come to, "deliver her daughter." This invoked a massive hunt in Australia for the woman who was said to have been voyaging in a luxury yacht from Australia. However, the dedicated duo of investigators appear not to have actually investigated very thoroughly.

"The Mail on Sunday however, has established that members of Mr Edgar’s team who had visited Barcelona:

  • Failed to speak to anyone working at the seafood restaurant near where the agitated woman was seen at 2am.
  • Failed to ask the port authority about movement of boats around the time Madeleine disappeared.
  • Failed to ask if the mystery woman had been filmed on CCTV.
  • Knew nothing about the arrival of an Australian luxury yacht just after Madeleine vanished until told by British journalists, who gave them the captain’s mobile phone number.
  • Failed to interview anyone at a nearby dockside bar where, according to Mr Edgar, the mystery woman was later seen drinking.
  • Failed to ask British diplomats in Spain for advice before or during the visit.

Also, Spanish police could not confirm that they had been contacted by the British investigators."

So, should they by any chance win their libel action, who next? There must be some reputable private detectives in the world, who would seriously and efficiently put their experience to work in searching for a missing child. Are the McCanns just unlucky or have they knowingly thrown money, other people's money, at a few posses of detectives who were never going to find their way out of the bank?

What else has been brought to our attention in the run-up to this media event in Portugal? Well, for some reason, creating a negative image of Snr Amaral maybe, by piling on as much negative guff as possible, several newspapers have dug up a story from last year about The Madeleine Foundation's invitation to Gonçalo Amaral to attend a meeting in the UK in February this year.

Not content with telling its readers about the invitation, which has not been accepted, the Scottish Daily Record/, takes this opportunity to purge itself of some of the rubbish relating to Snr Amaral, which it has fondly cherishing in its bosom, like a half-warmed fish.

"THE cop who led the hunt for Madeleine McCann plans to visit the UK to talk about his claims that her parents are to blame for her disappearance.

Portuguese former police chief Goncalo Amaral also criticised British police involvement in the case.

And he was pictured enjoying

boozy lunches when he should have been working. He was eventually sacked."

Amaral was not "sacked." He was removed from the invesigation and re-assigned to the PJ's offices in Faro. The Record adds something closer to the truth at the end of this piece of journalistic licence.......

"He was the one who authorised their status as arguidos, or official suspects.

But he was removed from his post after five months and then retired."

.........which makes it appear that retirement was imposed on Inspector Amaral, whereas he took early retirement in order to write his book, express himself clearly and recover his reputation which had been tarnished by the likes of the Daily Record.

So, tomorrow it kicks off! Clarence Mitchell, PR spokesperson for the McCanns has obviously been very busy making sure the Teflon Two get their great tranche of publicity in advance of their trip to Portugal. We've seen the videos, we've seen the photos, we've seen the comments about the supposed visit of Gonçalo Amaral and we even know that the McCann twins want to go back to Praia da Luz, from where their sister disappeared in 2007, when they were just two years and three months old, who, in Kate McCann's own words, had never spent much time with Madeleine. Perhaps in going there they will hope to see some evidence of the existence of the sister they probably hardly knew, whom they cannot possibly remember very well by now. Or perhaps, like most four-year-old children they see their parents upset and want to please them.

It appears that there has been an effort to tarnish the image of Gonçalo Amaral, at least in the eyes of the UK reading public in advance of the commencement of the hearings on Tuesday.

Only the Mail On Sunday, in reporting the invitation to Snr Amaral from The Madeleine Foundation, gives an accurate summing up of the reasons he was removed from the case.

"Next week, Amaral is due to appear in a Lisbon court to fight a £1million libel action brought by the McCanns over his book on the case.

In it, he accused the couple of neglecting their children, questioned their need to employ a spokesman and claimed British police were ‘too close’ to them."

Gonçalo Amaral: Here's to the glorious twelfth!

As most of the world knows, in September, the McCanns obtained a temporary injunction on the sale of Gonçalo Amaral's book, the English title of which is "The Truth of the Lie."

The hearing, at which Gonçalo Amaral was due to present witnesses in an attempt to overturn the injunction was postponed due to staff sickness in the office of Snr Amaral's lawyer. Outside the Civil Court building in Lisbon, Kate and Gerry did a 1-2 double act about how they weren't disappointed and Kate MCann asserted the rights of "human beings," above the right to freedom of speech. She sounded like she was trying hard to remember the words used by her lawyer in some kind of pep talk. "Mrs McCann your human rights are being infringed," but Kate asserted the rights of human beings, which being a rather pedantic person led me to wonder if she was therefore stressing the rights of human beings over the rights of, say, jelly fish or orangutans. Free the Chiltern Hundreds I say. They have rights!

Anyway! The delayed hearing has been rescheduled for Tuesday January 12th. In the past week or so, there have been interesting developments, both in the mainstream media and on various blogs.

On Sunday January 3rd, the Express
reported...

"Thousands of British police files detailing the hunt for Madeleine McCann will not be released unless those behind her disappearance are brought to justice." (Emphasis mine.)


.......and in the Monday 4th January edition of the Express, we were given...

"THOUSANDS of police files detailing the British involvement in the hunt for Madeleine McCann will remain secret until her kidnappers are brought to justice, it emerged yesterday." (Emphasis mine.)


Those behind Madeleine's disappearance are not necessarily kidnappers and this appears to be what the original press release, presumably from the police force "Operation Task," investigating Madeleine's disappearance, is stating by their more generalised phrasing. What happened in the 24 hours between those editions? A press release from the McCann team? "You promised Mr Express editor, to make sure our comments were published on any news story relating to Madeleine."?

The question arises about why this statement now. Is there a connection between the timing of this press release and the upcoming hearing in the Lisbon Court? If so, what? Several theories have been mooted: the McCanns made a request to Leicestershire police for access to the files and they were turned down; the Leicestershire police were sending a message to Gonçalo Amaral that if he had wanted to use anything contained in those files, he could whistle Dixie! In all likelihood, this is just coincidence, because in the UK, police files would never be released while, as the press release states, the investigation is ongoing. Also, I would have thought that the court in Lisbon would have the power to requisition the information from Leicestershire police in what is, after all, a Portuguese police investigation.

THE HEARING WILL BE BEHIND CLOSED DOORS?

On Thursday January 7th, John Blacksmith reported on his blog, The Blacksmith Bureau
, that next week's hearing would be behind closed doors. John does not reveal a source for this news, but he does go on to say that the details will emerge from behind those closed doors, bit by bit, inexorably.

"Whatever the verdict, the key elements of the court proceedings will come out, one way or another, during the coming months, like a dripping wound.

In July 2008 the Coffin and Gerry McCann, the latter with a spring in his step, the former lurching behind, shedding pine chips, were able to twist the meaning of the Portuguese prosecutors’ report because they had privileged access to it in translation. This time? Oh, no - there are plenty of Portuguese civil libertarians, volunteers for a cause they believe in, to ensure that the information will flow freely. The Team, from next week on, are going to be unable to stop the bleeding."


If John Blacksmith's information has come from a reputable source and the hearing is to be held in camera, for whose benefit is this likely to be? The McCanns' because they have reason to be concerned about how this is reported in the Portuguese media and the presence of members of the Portuguese public, who were vocal in their dislike of the McCanns in December? Gonçalo Amaral's in that his lawyer may wish to ask Snr Amaral's witnesses certain question which would touch on information contained in the thousands of files which have not yet been made public by the Portuguese police?

Outside the court in Lisbon in December, Snr Amaral appeared to quite relaxed, composed and confident: no ummms, errrrs, or you knows from him! He has always affirmed that his book, "A Verdade da Mentira," is nothing more than a narrative about the investigation into Madeleine McCann's disappearance, which was carried out by teams of Portuguese and English police officers. As far as I can tell from reading the said book, that is exactly what it appears to be.

Gerry McCann's assertion is that people will stop looking for Madeleine if they believe Amaral's thesis that, "an innocent little girl is dead." (Gerry's words.) There's something about Gerry's words that makes me decidedly uncomfortable. Implicit in the phrase, "..an innocent little girl is dead," seems to be some kind of implication that a little girl was being blamed for her own demise. Why does Gerry have to keep stressing, "innocent."? Could a little three-year-old girl be described as guilty? And if so, would her death not be such a crime or so significant? The use of the "innocent little girl," mantra would, in my opinion, be a plea to the mentality of the tabloid-reading public. "Innocent grandmother of 4 bitten by viscious unemployed teenage hoodie's ferret."

The MCanns and their backers have thrown oodles of dosh at expensive legal firm Carter Ruck, (They of the Trafigura injunction in which they sought to prohibit an MP's question in the House being made public), Portuguese PR firm "Lift Consulting," and Portuguese lawyers, in an attempt not only to ban Snr Amaral's book and prevent him from even talking about it, but have sought to silence bloggers who have dared to question their abduction theory. To me, though, in spite of all that, for all his posturing and ranting through his puckered, spaghetti-hole mouth, Gerry McCann's threats still sound as scary as Achmed, the dead terrorist! I keeeel you!



The McCanns' abduction theory has as much substance as Achmed's body. There is no substance to it. In nearly three years they have tried to pad it out with Jane Tanner's still being updated story and description of an elusive abductor, with sightings from all over the world, and simply their repeated protestations that it is so.

And finally, the television programme, which was broadcast on Portuguese TV, released on DVD, and included in the temporary injunction obtained by the McCanns, is available (of course!) on the internet. Here for the convenience of my readers, is the video with English sub-titles.

Aw Gerry McCann! Who stole yer scone then?

That's what my father used to say when somebody looked miserable, Gerry, and you really don't look too happy in that photo. And you looked a wee bit scunnered in that kind of interview when reporters pressed you for a comment at Lisbon airport.

You were asked how you felt about meeting Mr Amaral and you said, "Haven't thought about it. Thank you." Gerry, I think you're telling porky pies! You reckon Dr Amaral's book has hindered the search for your daughter and you are trying to permanently ban the book and also claim over a million quid in damages, but you haven't thought about coming face-to-face with that man? Gerry, if you told me it was raining, I'd have to look out the window to make sure.

Oh dear! Kate looks like she's had her hair done specially for the trip. It's got that just out of the salon look! So, what now that the process has been postponed? A visit to Praia da Luz? Will you and your wifie now do some searching for your daughter? Maybe you could get in touch with the PJ, get your mates over too and finally do an official reconstruction of the events of the night your daughter disappeared from the unlocked apartment. Or maybe Kate could now answer the 48 questions the Portuguese police put to her, the questions that included one about how her not answering could harm the investigation.

Now you've got some spare time on your hands since the trial has been postponed, you could surely put it to good use. Why not see the PJ and ask for the investigation to be re-opened?

So, who stole your scone, Gerry? Was it the sight of the list of witnesses being presented by Dr Amaral? Or maybe the fact that Gonçalo is publicly launching another book this very day?

Gonçalo Amaral: the McCanns' spokesman comments on new book launch.


The headline in today's
Metro reads, "Libel cop launches new Maddie Book on opening day of trial."

Clarence Mitchell, for the McCanns appears to be none too impressed!

"It's regrettable that Mr Amaral chooses to do this on the same day as the trial opening," said Clarence Mitchell."


Regrettable, Mr Mitchell? Who do you think regrets this timing? Carefully planned by Dr Amaral, I would say, and should attract a great deal of publicity. Is that what is regrettable? Too many of the world's journalists around, who will no doubt be giving free publicity to this new venture from Dr Amaral? Bit too close to the truth the title?

Clarence Mitchell goes on to say:

"Most people would expect him to concentrate on the trial rather than launching any new book and the court will take its own view of his activities."


There are people all over the world, Clarrie, who wonder why your clients went jogging while residents of Praia da Luz took a week off work to look for their daughter. I have often wondered why Kate McCann sat in the apartment all night on the night of May 3rd, 2007, rather than getting out there desperately hunting for her daughter.

"In his book The Truth Of The Lie, Mr Amaral - who was involved in the initial investigation but later taken off the case - claimed Madeleine was dead and questioned the McCanns' account that she was taken while they were eating with friends."


Now, the first person to suggest that Madeleine McCann was dead and that her body was hidden somewhere in the Praia da Luz area was Mark Harrison, an English specialist who was called in to help the Portuguese police. In his book, Dr Amaral simply reports Mark Harrison's conclusions. (See chapter 16 of The Truth Of The Lie)

"A year-long campaign by the McCanns' lawyers to prevent the publication of the book and a subsequent DVD led to an injunction banning its further sale or publication being granted in September."


The book was published, in fact, and sold well all over Europe before the McCanns went to court to apply for the injunction, which was, I hasten to add, a temporary one.

"Mr Amaral says his new book has emerged from his indignation in the face of censorship."


And for that I commend the good doctor and wish him the very best of luck in court tomorrow and every day of this process.

Intellectual Property

It has come to my attention today, that someone is seeking to publish an English version of the book by Gonçalo Amaral, English title, "The Truth Of The Lie." That person has views of opened pages of the book on his web site and it can be read easily. The wording is identical to my translation. Now, since no two people translate exactly word-for-word, I suspect that the contents of this book are my translation.


If this is my translation, I have not been approached for my permission to use this version, which I have spent months working on.

I hereby state that everything on this blog is my intellectual property and that I have not given anyone permission to transmit any of it in printed form.

Kate And Gerry McCann Planning To Sue Gonçalo Amaral.


"It is the first time Mrs McCann has returned to the country since being quizzed by police over her daughter's disappearance.

They are considering suing the former Portuguese police officer Goncalo Amaral over his book, In The Truth Of The Lie, in which he claims that Madeleine is dead and questions the McCanns' account that she was taken while they were eating with friends nearby." (Daily Telegraph 24/09/09)

Having read Gonçalo Amaral's book, "The Truth Of The Lie," I can say that, as far as I can see, the book is simply a narrative about the investigation and the avenues being explored by joint working teams of British and Portuguese police officers. In fact, the original hypothesis of death came from an English expert, Mark Harrison.

From chapter 16 of Amaral's book:

"After a week of intense work, Harrison presents the results of his study to my coordinating group. Even if we were expecting it, his conclusions confirm our worst fears. The most plausible scenario is the following: there is no doubt that Madeleine is dead, and her body is hidden somewhere in the area around Praia da Luz. He praises the quality of the work carried out by the Portuguese authorities in trying to find the little girl alive. According to him, the time has come to redirect the searches in order to find, this time, a body hidden in the surrounding area. "

And:

"Great Britain has at its disposal the world's biggest data bank on homicide of children under five years old. Since 1960, the count is 1528. Harrison is well acquainted with its contents. He often draws information from there which helps him to resolve similar cases. Valuable information can be found there on on various criminal modus operandi, places where bodies are hidden, techniques used to get rid of a body. He relates that on one occasion, thanks to the data, he was able to deduce the maximum distance a body might be found in relation to where the crime had been committed.

The figures quoted in the report he hands over give us the shivers. The crimes, including those of a sexual nature, are committed by the parents in 84% of cases; 96% are perpetrated by friends and relatives. In only 4% of them is the murderer or abductor a total stranger to the victim. In this roundabout way, Mark Harrison points out that the guilty party may be a person close to Madeleine, and even her own parents. From now on, we have to explore this track, especially as the others have proved fruitless."

So, Kate and Gerry, you may be suing the wrong person as it was Mark Harrison who put forward, very strongly, the case for Madeleine's being dead and the idea that someone close to Madeleine, even her parents, may be the guilty party. Being of a rather cynical nature, though, Mark Harrison probably isn't worth suing and I guess you have calculated how much money may have been made by the sale of Dr Amaral's book.

Gonçalo Amaral Goes To Spain To Talk About The Maddie Case


Forbidden to talk about his book, "The Truth of The Lie," and his conclusions about the case, 24 Horas reports that Gonçalo Amaral crossed the border into Spain to be able to express himself. The order by the court in Lisbon, prohibiting him from speaking about the case, is only effective in Portugal.

Gonçalo Amaral leaves the Country to Accuse the McCanns


Forbidden to speak about his version of the Maddie Case, which puts the parents at the origin of the child's disappearance, the former Inspector gives an interview to TV Record, in Spain.

Silenced in Portugal, Gonçalo Amaral went to Ayamonte, Spain, to tell again his version of Maddie's story, exposed in his book «The Truth of the Lie».

The Former Inspector of the Maddie Case bypassed in this way the injunction that prevents him to speak freely on the thesis of the child's death and the concealment of the corpse by her parents. However, the daily Press today reveals that the ban to Gonçalo Amaral will be enforced anywhere in the world.[this could only be achieved if the McCanns process Mr. Amaral in every Civil Court of every and each Country, no Court has jurisdiction to forbid a Citizen to speak abroad]

The McCann were in Lisbon yesterday in a meeting with their lawyers to proceed with the reopening of the inquest* to their daughter's disappearance and «refresh the searches». The Couple refused to make any comments regarding their conflict with the former PJ inspector.

Gonçalo Amaral's interview to TV Record will be broadcast in 70 Countries, the date is still unknown.

*This is a gross mistake, the McCanns confessed that "they wished to reopen the process", obviously they won't even bother to try to reopen the process, which they could as it's in their legal right as assistants to the process. They could, for example, answer the PJ questions or request that an official reconstruction of the events of 3rd of May 2007 is made. The Public Ministry would no doubt reopen the process to the investigation of Madeleine Beth McCann' disappearance again.

A Verdade da Mentira - The Truth Of The Lie, by Gonçalo Amaral, is still on sale.

On September 10th, Duarte Levy reported that Gonçalo Amaral's book about Madeleine McCann's disappearance was still on sale.

The ruling by judge Amelia Puna Loupo that bans the sale of "Maddie: The Truth Of The Lie," will not have a direct impact on sales for the moment, in Portugal and anywhere else. This is because the order has not been completely formalised, as has been admitted by the lawyer representing the McCann family in this case.

Isabel Duarte noted that "the process has been secret until now to retain the utility of the decision obtained." In this case, the other parties have still to be heard - Gonçalo Amaral (author), Guerra y Paz (publisher) and Valentim de Carvalho (responsible for the screening of the TVI video)

As if that wasn't enough, there is also a 10 day delay to allow the three parties to oppose or 30 days to present before the Lisbon Court Of Appeal an appeal against the decision by the judge for the Third Civil Section of the 13th Lisbon Court. "As long as we have not received notification, we will continue to sell the book. When we have received notification, we'll see," a public relations officer for the publishing house Guerra y Paz, was quoted as saying by the press agency, Lusa.

The preventative order involves the publishers being banned from selling the books and videos, "that remain on their shelves or in shops and warehouses, and the requirement to collect (the copies) and hand them over to the authorised agent."

"The decision takes effect, despite the fact that it's not final, since the opposing parties, in keeping with, "the conflict principle," have the opportunity to express themselves," lawyer António Pinto Pereira explained to 24 Horas.

If Amaral and the publishers present arguments capable of convincing the judge that the decision carries serious and irreparable prejudice, "that would mean the results of the decision by the preventative order would be suspended."

Pereira Pinto would actually, "make a hybrid decision": not to produce any further editions of the book, but not to void the stocks or withdraw the books already on sale until there was a decision from the higher court.

If the higher court decides in their favour, Amaral and the publishers can go ahead with demands for compensation against the McCanns (for actual damage caused) and as individuals, against the judge Amelia Puna Loupo (for an illegal decision causing serious prejudice).

Elsewhere, it's business as usual.

"We have neither been notified nor informed of the decision of the Portuguese court, and we shall continue to sell the book," stated Isabelle Mazzaschi, representing the publisher Bourin distributor of, ""Maddie : L'enquête interdite," (the French title of Gonçalo Amaral's book) in France, Belgium, Switzerland and Luxembourg.

In Paris, Brussels and Geneva, the French version of the book by the former PJ coordinator was available yesterday afternoon in all the main outlets in spite of the fact that the order by the Portuguese court had been all over the media.

"The sale of the book will continue until we have been notified by the French courts," Isabelle Mazzaschi confirmed for 24 Horas, adding that, "the Portuguese decision has no weight in France." And she is right.

According to Pinto Pereira, "outside our country, the order is totally ineffective, because the principles of territoriality and sovereignty of other states cannot be violated."

The publisher, TM Publishers, which distributes the book in the Netherlands and in the Flemish region of Belgium, has also told 24 Horas that Amaral's book will stay on the market.

Delighted with the publicity surrounding the court's decision, this publisher (TM) has decided to place the cover of the book - "Maddie, De waarheid achter de leugen" the Dutch title, on the home page of its web site: www.tmpublishers.nl

"The book has made it into the top 10 best sellers and has been well received by the public," the publisher's spokesperson acknowledged, stressing that, "that is not a logical or normal decision in a European country."

"The book has been on sale for some time in our country and without a legal order we are not going to change anything," he insists.

All foreign publishers of "Maddie : L’enquête interdite", contacted by 24 Horas, have refused to withdraw the book from the shelves without a local court order, at the same time as they admit that they will be contacting their lawyers and the Portuguese publisher to decide the book's future.

Among the best sellers.

According to the publisher Guerra & Paz, the book "A Verdade da Mentira," has sold in Portugal alone ( because there are editions in Belgium, the Netherlands, France, Spain, Luxembourg, Italy, Switzerland, Germany and Denmark) close to 175 thousand copies (including copies sold through the daily newspaper, "Correio da Manhã"), a much higher number than other Portuguese authors, according to the sales figures for 2008. "A vida num Sopro" by José Rodrigues dos Santos, was the next best seller by a Portuguese author last year, with 115 thousand copies, followed by "A Viagem do Elefante" by José Saramago, with 100 thousand.

Amongst the top sellers is "Equador", by Miguel Sousa Tavares, which has sold close to 370 thousand copies. With a cover price of 13.30 Euros, Gonçalo Amaral's book has already taken 2.3 million Euros - the profits are divided between the publisher and the author, with the author receiving a lower percentage.

It Wasn't Dr Amaral Who Sniffed Out The Cadaver Odour!

"The lawyer for former PJ inspector Gonçalo Amaral said today that he “deplores” as a citizen that the selling of the book about the disappearance of Madeleine McCann was prohibited, which will limit the “freedom of expression” in Portugal.

In statements to Lusa agency, António Cabrita said that he has not been notified about the decision concerning the injunction that forbids the sale of the book “The Truth about the Lie” yet, and he doesn’t wish to take a juridical position about the matter without previously speaking with his client, Gonçalo Amaral.

Nevertheless, he observed that, if the decision’s tenor, as divulged by the media, is confirmed, then it is the “freedom of expression” that may be being limited, because the book about the disappearance of the English child in the Algarve emits an opinion about “certain facts” that took place.

Gonçalo Amaral’s lawyer said it was “strange” that, with the book having been published over a year ago, an injunction has been served only now in order to forbid the book, when the book’s sales have “already attained their peak”.

“As a citizen, this worries me”, António Cabrita commented, further noting that this measure appears at a time when the possibility of translating the book and an eventual interest in selling it in the United Kingdom were being mentioned. “If this is true, then it’s possible that this reaction is related to that”, the lawyer admitted, adding, nevertheless, that he “deplores” what is happening.

Among other statements that are related to the prohibition of the book about the investigation into the English girl’s disappearance, António Cabrita stressed that “it was not Gonçalo Amaral’s pituitary that was sniffing the cadaver odour”.

Indeed it wasn't Dr Amaral's pituitary! Eddie, the Enhanced Victim Recovery (Cadaver) Dog, claims that discovery.

So, the McCanns are saying that Dr Amaral's book has hampered the search for Madeleine? What search? They have paid out a small fortune in other people's money for all sorts of weird and wonderful private detectives, who have basically come up with nothing but empty promises, like...Madeleine will be home by Christmas....and chased sightings all over the world. The search for Madeleine? Well, the McCanns didn't physically search for her when she went missing. Some local people in Vila da Luz stayed away from work for a week, but what did Kate McCann do? Well, she certainly didn't answer the question about why she didn't get out there! (As well as those 48 questions the PJ wanted to ask about her daughter's disappearance!) She seems to have turned the answer into one she prepared earlier!
